Every few years the State updates their building codes and the city must then update the references in our code to match the current reference for the state. There are no major changes. Opened public hearing 7:08 pm - No one came forward and the public hearing was closed. BUSINESS A. American Rescue Plan Funding Update Finance Director Steven Weber stated that the city must spend the $4.184 million in accordance with US Treasury Guidelines. The American Rescue Plan award is included in the City's 2021-2023 biennial budget. In April staff presented the city's initial allocation of the stimulus package that was approved by the Federal Government. Since that time, a final award allocation has been determined and additional guidelines were issued by the U.S. Treasury. Mr. Weber presented the calculations for revenue loss and it is estimated at $629,027. If we are reimbursed this amount it would be discretionary funds. We have not received specific guidelines for spending these funds as of yet. He presented a revised list of projects planned for the ARPA funds. Any needed amendments to the budget will be presented through a supplemental budget resolution at a future meeting. Kelley Johnson moved to approve the revised use of the American Rescue Plan Act Funds based on the City's final award allocation of 4.184 Million. Old Military Road City Manager Chris Clayton explained that in 1970 the city acquired a 7.41 acre parcel of land located on Old Military Road. The property is zoned County Aggregate Resource. The City purchased the land for use by the Public Works Department to be used as a site to move extra material such as rock, dirt and tree trimmings. The Council declared the property as surplus and noticed the property for sale with a minimum bid price of $350,000. The closing date for bids was August 27, 2021. We received zero bids and are requesting further discussion on how to proceed. Staff would prefer to lower the minimum bid price, re-notice the property for sale and set a new bid date for mid-October. The city could also hire a real estate agent and list the property. Some of the comments from inquiries were that the minimum bid was too high. There was discussion on the pros and cons of listing the property with a realtor or lowering the minimum bid. There was discussion regarding the current state of the property and Council directed staff to lower the minimum bid to $325,000 and republish the notice. RESULT: FOR DISCUSSION ONLY IX. MAYOR'S REPORT Mayor Williams reported that he helped film an ad for the Childerns Advocancy Center to help support the annual Cherish a Child Luncheon. The Childrens Advocacy Center is very important in the valley and does wonders for children who are victims. X. CITY MANAGER'S REPORT City Manager Chris Clayton reported that: The City has received a request from the Jackson County Library system asking if they could reserve parking spaces every other Friday for their DART van. Computers at the Library are a big draw for the community. The van will allow citizens to check out laptops. n March 2021 we had an OSHA complaint regarding hazards in the workplace. OSHA responded and thanked us for our response, no further action is required but they will visit us if they received another complaint. He did a walk around of the new Nelson Building on Freeman Road. It will be a nice addition to the area. Bliss Veterinary Eye Care has moved out of the shopping center and an Urgent Care facility will be taking its place. The Central Point Liquor Store is expanding. With the start of school this week we have been hearing several complaints about traffic concerns in those areas. Transportation funding is becoming a challenge for everyone. But we were awarded a grant for bike lanes and sidewalks along Hwy 99. They will be meeting with RVCOG regarding the right of first refusal for the Sr. Center building. We have received a clean title report for the Little League property. 6.A Packet Pg. 5 Minutes Acceptance: Minutes of Sep 9, 2021 7:00 PM (CONSENT AGENDA) City of Central Point City Council Minutes September 9, 2021 Page 4 XI. COUNCIL REPORTS Council Member Taneea Browning reported that She attended the Small Cities meetings which are guided topics by region. The Medford Water Commission has dropped the word Commission from their name. She has been attending LOC Executive Board meetings. Council Member Michael Parsons reported that VIPS does speed surveys. The community engagement during these times are very good. The neighbors engage with the volunteers thanking them for doing the surveys. They are in need of a new speed detector. Chief Allison stated that one has been ordered. Council Member Kelley Johnson reported that she attended the Fire District Board meeting and the Greenway meeting. Council Member Neil Olsen reported that he attended a Council on Foreign Relations webinar. XII. DEPARTMENT REPORTS Captain Scott Logue reported that: Ledger David was broken into this week, the suspects were in and out fast. We have some videos and hope to identify a suspect soon. The department assisted Medford Police Department by handling calls on the north end of Medford. We received a report about an assault on a bike cycle rider. After some investigating, it was determined this was not an assault. The DARE show and shine is officially cancelled. They are going to try a virtual vote on Social Media. He shared an email that he sent to all city employees regarding the one-year anniversary of the Alameda fire and presented a challenge coin to the Council. Parks and Public Works Director Matt Samitore reported that: He will be attending the RVACT meeting next week to receive a grant for stop light reflectors to help shield the sun issues on Pine Street, and receive a grant for the transportation funding for sidewalks and bike lanes on Hwy 99. We will still be holding the Made in Southern Oregon event unless the air quality is low that day. 6.A Packet Pg. 6 Minutes Acceptance: Minutes of Sep 9, 2021 7:00 PM (CONSENT AGENDA) City of Central Point City Council Minutes September 9, 2021 Page 5 They will be advertising the War Memorial and Dennis Richardson Memorial projects together for bids. At the next Council meeting we will present bid award for the Makers Space sidewalk project. Planning Director Stephanie Holtey updated the Council on projects and new businesses coming to Central Point. City Attorney Sydnee Dreyer stated that Council will adjourn into Executive Session under ORS 192.660 (2)(h) Legal Counsel. XIII. EXECUTIVE SESSION ORS 192-660 (2)(h) Legal Counsel Council Member Kelley Johnson moved to Adjourn to Executive Session under ORS 192.660(2)(h) Legal Council. All said aye and the Council adjourned to executive session at 8:07 pm. The Oregon Building Codes Division (BCD) has adopted updated codes for the residential, plumbing and electrical trades. This ordinance is to align the adopted codes of the City of Central Point to the adopted codes of Oregon BCD. FINANCIAL ANALYSIS: The financial impact to the City of Central Point is the purchase price of the new code books. Total cost of codebooks is approximately $1,200.00. LEGAL ANALYSIS: The adoption of the revised codes is required to comply with OAR 918 and ORS 455. COUNCIL GOALS/STRATEGIC PLAN ANALYSIS: STAFF RECOMMENDATION: Approve updated code references. Words lined through are to be deleted and words in bold are added. B. Pursuant to CPMC, Chapter 1.01.040, the City Council, may from time to time make revisions to its municipal code which shall become part of the overall document and citation. C. The Central Point Building Department initiated and recommended approval of a code amendment to CPMC Chapter 15.04.010 bringing the City’s municipal code into conformance with State Building Code Revisions and Updates. D. On September 9, 2021, the City of Central Point City Council held a properly advertised public hearing; reviewed the staff report; heard testimony and comments, and deliberated on approval of the amendments. THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS: Section 1. Section 15.04 of the Central Point Municipal Code is amended to read: Chapter 15.04 Building Code Sections: 15.04.010 Standards applicable to building. All construction, building, and related activities within the city shall comply with all ordinances of the city and with the following specialty codes, which by this reference are expressly adopted and incorporated into this code: A. The 2019 Oregon Structural Specialty Code based on the International Building Code, 2018 Edition, as published by the International Code Council and amended by the Building Codes Division; specifically adopting and including Section 112, Service Utilities; Section 116, Unsafe Structures and Equipment; Appendix G, Flood-Resistant Construction; Appendix H, Signs; and Appendix J, Grading. B. The 2019 Oregon Mechanical Specialty Code based on the 2018 International Mechanical Code and the 2018 International Fuel Gas Code, as 8.A.a Packet Pg. 9 Attachment: Ordinance Amendment 15.04 building codes (1456 : 2021 Building Code Adoption) Pg. 2 Ordinance No. ____________ (09/09/2021) published by the International Code Council, Inc., amended by the Oregon Building Codes Division, with fees as per the mechanical fee schedule adopted by the city of Central Point. Provisions of this Ordinance shall be incorporated in the City Code and the word Ordinance may be changed to “code”, “article”, “section”, “chapter”, or other word, and the sections of this Ordinance may be renumbered, or re-lettered, provided however that any Whereas clauses and boilerplate provisions need not be codified and the City Recorder is authorized to correct any cross references and any typographical errors. Section 4. Effective Date. The Central Point City Charter states that an ordinance enacted by the council shall take effect on the thirtieth day after its enactment. The effective date of this ordinance will be the thirtieth day after the second reading. Earthquakes are just one of many natural hazards that can occur in our region. Major earthquakes may happen anywhere we live, work, or travel. The ShakeOut is our chance to bring awareness to earthquake preparedness as well as to practice how to protect ourselves in the event of an earthquake. At 10:21 a.m. on October 21, 2021, thousands of Oregonians will “Drop, Cover, and Hold On” in The Great Oregon ShakeOut, the state’s largest earthquake drill ever! All local governments and their agencies are encouraged to participate in the drill (or plan a more extensive exercise). Major earthquakes may happen anywhere you live, work, or travel. The ShakeOut is our chance to practice how to protect ourselves, and for everyone to become prepared. The goal is to prevent a major earthquake from becoming a catastrophe for you, your organization, and your community. Why is a “Drop, Cover, and Hold On” drill important? To respond quickly you must practice often. You may only have seconds to protect yourself in an earthquake before strong shaking knocks you down, or something falls on you. The final engineering has been completed for the new intersection at Hamrick and Pine; however, the current construction numbers are significantly higher than anticipated. Additionally, there are some potential grant funds available thru the Covid relief package from December 2020. Engineering of the Hamrick and Beebe intersections is currently under design review. Staff recommends delaying the project one calendar year to explore other funding sources and watch the market for the best time to bid on the project. Lastly, this project would align with construction for Urban Renewal 22-23 FY. FINANCIAL ANALYSIS: The project is currently projected to be $350,000 over budget. The City is exploring grant funds in the realm of $200,000 - $500,000 to help augment the project. LEGAL ANALYSIS: COUNCIL GOALS/STRATEGIC PLAN ANALYSIS: Goal 5 – Plan, design, and construct modern and efficient infrastructure in all areas and systems.
