PLEDGE OF ALLEGIANCE III. ROLL CALL: Mayor: Hank Williams Council Members: Allen Broderick, Bruce Dingler, Carol Fischer, Kelly Geiger, and Matthew Stephenson were present. EI1ie George was sworn in at the end of the meeting. Kay Harrison was absent. City Manager Phil Messina; City Attorney Paul Noite; Police Chief Jon Zeliff; Community Development Director Tom Humphrey; Parks and Public Works Director Matt Samitore; Assistant City Manager Chris Clayton; Human Resource Manager Barb Robson; Finance Director Bev Adams; and City Recorder Deanna Casey were also present. IV. PUBLIC APPEARANCES Gary Miller from ACCESS presented their annual report to Council. Mr. Miller explained the services that are provided to Central Point citizens. • 830 homes in Central Point received energy assistance • 33 homes in Central Point received counseling for home buying or rental assistance • There are two food pantry's located in Central Paint • 213 homes in Central Point used the medical equipment loan program V. Second Reading, Ordinance No. 1950, An Ordinance Declaring that Blighted Areas Exist within the City of Central Point, Recognizing the Need for an Urban Renewal Agency to Function in the City and Adding Chapter 2.62 to the Central Point Municipal Code Assistant City Manager Chris Clayton stated that this was the second reading of an ordinance declaring a need for an Urban Renewal Agency and adding Chapter 2.62 to the Central Point Municipal. There were no recommended changes at the first reading on April 14, 2011. Mayor Williams opened the public hearing. No one came forward. The public hearing was closed. Matt Stephenson made a motion to approve Ordinance No. 1950, An Ordinance Declaring that Blighted Areas Exist within the City of Central Point, Recognizing the Need for an Urban Renewal Agency to Function in the City and Adding Chapter 2.62 to the Central Point Municipal Code. First Reading, An Ordinance Amending Central Point Municipal Code Chapter 2.20 Implementing Provisions for Conducting City Elections by Clarifying Elections Procedures and Adding Procedures to Conform to State Law and New City Charter City Attorney Paul Notle stated that the 2010 Charter requires an ordinance clarifying nomination procedures for mayor or city council. The proposed ordinance states that state law will apply unless specified in the CPMC or Charter. There is clarification that a candidate must have lived in city limits for 12 months prior to the election; nominations are by petition; the filing period allows more time than the old charter; and filing farms will be submitted to the City Recorder. There was discussion that 2.20.060(8) could indicate that an elector could only sign a petition to nominate one person during an election period. The intent is that they are not allowed to nominate two people for the same position. City of Central Point City Council Minutes April 28, 2011 Page 3 VIII. BUSINESS A. Appointment of Committee Members Mayor Williams stated that there is one vacancy on the Park and Recreation Commission. Staff recommends appointing Deven Howard to the Park and Recreation Cammission to complete the term ending December 31, 2012. There are currently two vacancies on the Arks Commission. Staff has received applica#ions from Steven Lang and Charles Brotherton. Mayor Williams recommends appointing both to the Arts Commission with terms expiring December 31, 2011. Bruce Dingier made a motion to appoint Deven Howard to the Park and Recreation Commission with a term expiring December 31, 2012. Matt Stephenson seconded. Arts Commission Proposal far Student Art Scholarship Parks and Public Works Director Matt Samitore stated that the Central Paint Arts Commission would like approval to provide three scholarships in the amount of $250 each to local students planning on attending college in the field of the arts. One scholarship would be awarded for visual arks; musical arts; and performing arts. These scholarships would be awarded yearly by the Arts Commission and Central Point Council. Crater High School teachers would nominate the students based on their involvement with the arts, and plan to attend college in the field of arts. Applications will be reviewed by the Arts Commission and brought before the Council for final approval. Kelly Geiger made a motion to approve three scholarships to be awarded for students at Crater High. Carol Fischer seconded. Arts Commission Proposal for Logo Design Contest Mr. Samitore stated that the Central Paint Arts Commissian would like approval to provide local students the opportunity to design the logo for the Arts Commission. The contest will be open to students in the Central Point School Cittj of Central Point Citf Council Minutes April 28, 2011 Page 4 District. The purpose of the logo is to provide a recognizable symbol that will bring attention to the work of the Arts Commission and generate interest throughout the community. He explained the rules for the contest and the submission date. The Arts Commission will review the submissions and bring a recommendation to the Council for approval. Matt Stephenson made a motion to approve the Logo contest for the Arts Commission as recommended. Carol Fischer seconded. MAYOR'S REPORT Mayor Williams reported that the City Attorney received a letter from the Medford City Attorney stating that unless Central Point signs the water agreement that was attached the MWC would shut off the city of Central Point water within six months. Mayor Williams would like to know how the Council would like to respond. The agreement the letter refers to does not take into consideration the Water Model study that both cities worked on together. The Cities Coalition meets on Monday for discussion about the disconnect notice. At this point we do not know if the other cities received the same letter. The next MWC meeting is on Wednesday, May 4tn The Council would like the city to continue in the discussions regarding rates and water rights. They are ready to go public, but the general public will not understand all that the agreement entails. The public statement needs be clear that the surrounding cities are subsidizing the water for Medford residents. Mr. Messina stated that the City will inform the MWC how disappointed Central Point is with the threat to shut off the water to over 17,000 citizens in Central Point alone, not including citizens in surrounding communities. X. CITY MANAGER'S REPORT City Manager Phil Messina stated that: • He appreciated all the work done by Bev Adams and Debbie Dunlap who made the Budget meetings go smooth. • Ron Fox from SOREDI asked if he would like to be the new Central Point representative. Council agreed this would be a good replacement for Mr. Stephenson. • There will be a brief executive session regarding labor negotiations this evening. XI. COUNCIL REPORTS Council Member Allen Broderick reported that he attended the Budget Committee meetings and a Parks and Recreation Commission meeting. City of Central Point City Council Minutes April 28, 201 T Page 5 Council Member Caroi Fischer reported that she attended the Budget meetings, and helped clean up at the Central Point Cemetery. Council Member Matt Stephenson stated that he attended the Lithia Motors ground breaking ceremony in Medford. It was well attended. XII. DEPARTMENT REPORTS Assistant City Manager Chris Clayton met with Larry Reins on Water Commission issues. He explained the considerations that could impact Central Point Rates in the future. He feels they have had some positive movement regardless of the letter from the Medford City Attorney. Council would like to have clear discussion points prior to releasing a public comment. Mr. Clayton stated that he will provide the Council with facts after the Coalition meeting. Parks and Public Works Director Matt Samitore reported that they will be paving around 3~d and Victoria on Friday. Saturday is the Citywide Yard sale and an auction of the surplus items. Community Development Director Tom Humphrey reported that: • The downtown design project will begin May 17'" with a tour of the downtown area and discussions with local businesses. • He talked with LCDC regarding the RPS process and completion. LCDC recommends the city prepare documents for Urban Growth Boundary expansion in order to be ready when the process is approved by the County Board of Commissioners. • He attended the MPO Policy meeting and the city was awarded most of the requested grant money for the vehicle conversion project. X111. SPECIAL PRESENTATION AND SWEARING IN Mayor Williams presented Matthew Stephenson with a plaque and thanked him for his service on the Council for the last four years. He hopes he will continue in local government by running for office in Medford. Mayor Williams swore in new Ward III Council Member Ellie George. Mrs. George took her spot at the Council table. XIII. EXECUTIVE SESSION Ellie George made a motion to adorn to executive session at 8:15 p.m. Bruce Dingier seconded. All said "aye" and the meeting was adjourned to Executive Session under ORS 192.660(2)(d) Labor Negotiations. Council returned to regular session at 9:00 p.m. No action was taken. At that time the council discussed the recommended changes. It was decided that 2.20.060 (B) was confusing and should be clarified that electors can sign mare than one petition if the petition is for different positions. The ordinance has been changed to reflect the following language: B. Electors may sign one petition for each position to be placed on the ballot. The circulator must certify on each signature sheet that the circulator witnessed the signing of the signature sheet by each individual whose signature appears on the signature sheet and attest that each individual is believed to be qualified to sign as provided in ORS 249.061(4). Failure to comply with the legal requirements and guidelines as contained in OAR 165-014-0270 will result in the rejection of those signature sheets. Recommendation: Move to approve Ordinance No. An Ordinance Amending Central Point Municipal Code Chapter 2.20 Implementing Provisions for Conducting City Elections by Clarifying Election Procedures and Adding Procedures to Conform to State Law and New City Charter ORDINANCE No. AN ORDINANCE AMENDING CENTRAL POINT MUNICIPAL CODE CHAPTER 2.20 IMPLEMENTING PROVISIONS FOR CONDUCTING CITY ELECTIONS BY CLARIFYING ELECTION PROCEDURES AND ADDING PROCEDURES TO CONFORM TO STATE LAW AND NEW CITY CHARTER Recitals: A. Section 28 of the City of Cen#ral Point Charter of 2010 requires the council to adopt an ordinance prescribing the manner for a person to be nominated to run for mayor or a city councilor position. B. Additional sections have been added to clarify election procedures that are not covered by city charter or state elections laws. C. This ordinance is adopted to fulfill charter requirements, and city specific election laws. D. Words ' are to be deleted and words in bold are added. THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS: Section 1. The following section 2.20.005 is added to Chapter 2.20 of the Central Point Municipal Code: 2.20.005 State Law Applies. As provided by Chapter VII of the 2010 City Charter, City elections must conform to state law except as specified by charter or ordinances of the City of Central Point. All elections for city offices must be nonpartisan. Pg. 1 Ordinance No. (___I l~ ~~ ~r Section 3. Section 2.20.050 of the Cen#ral Point Municipal Code is amended to read: 2.20.050 Eligibility. A qualified elector as defined in the Oregon Constitution and who has resided in the city limits for the twelve-month period immediately preceding the election or appointment to office may be a candidate for an elective city position. Section 4. The following sections 2.20.060 through 2.20.100 are added to Chapter 2.20 of the Central Point Municipal Code: 2.20.060 Nomination by Petition A. Nomination for a city elective position shall be by a petition that specifies the office sought and shall be i:n a form prescribed by the Secretary of State and the City of Central Point. B. Electors may sign one petition for each position to be placed on the ballot. The circulator must certify on each signature sheet that the circulator witnessed the signing of the signature sheet by each individual whose signature appears on the signature sheet and attest that each individual is believed to be qualified to sign as provided in ORS 249.061(4). Failure to comply with the legal requirements and guidelines as contained in OAR 165-014-0270 will result in the rejection of those signature sheets. C. Signature sheets may not be circulated until the City Recorder has approved the prospective petition and provided a Letter of authorizing the gathering of signatures. 1. When the City Recorder receives notification that a minimum of twenty signatures have been approved by the Jackson County Elections Division, a letter of completion will be provided to the candidate fig. 2 Ordinance No. (_/ /~ ~~ 2.20A70 Filing Period A completed nomination petition for candidacy must be filed with the City Recorder no earlier than 120 days and no later than 70 days before the election. 2.20.080 Candidate Filing Forms The City Recorder shall provide the candidate with the applicable filing forms as prescribed by the City and Oregon Secretary of State for an elective city office. If at any time a petition is found to be deficient, the City Recorder shall notify the candidate within five business days after filing, certifying in writing the reason(s) the petition is insufficient. The petition may be amended and refiled within the required timeline. 2.20.090 Withdrawal of Candidacy To withdraw from candidacy or nomination, a candidate must #ile a withdrawal of candidacy or nomination form with the City Recorder no later than fi7 days before the election. The candidate must use the proper form provided by the City Recorder or Secretary of State, provide the reason for the withdrawal, and attest the information provided is accurate. 2.20.100 Certification of Candidates The City Recorder must file with the Jackson County Elections Division, in accordance with the time requirements of State law, a statement of the City offices to be filled and the names of the qualified candidates to be printed on the ballots. 2.20.110 Election Notice and Results Notice of elections submitted to City Electors on regular or special election dates must be given in accordance with State law. The City Recorder must certify the election results to the Council at the first Council meeting after the results are certified by the Jackson County Clerk. PQiNT O~egdn STAFF REPORT DATE: MAY 18, 2011 TO: HONORABLE MAYOR AND CITY COUNCIL FROM: MATT SAMITORE, DIRECTOR SUBJECT: Raise storm utility fee in concurrence with the municipal code to coincide with the Construction Cost Index. SUMMARY: In 2010 the City Council adopted a rate methodology for the Storm Utility Fee in which the fee may increase based upon inflation based upon actual construction prices using the Construction Cost Index {CCl) twenty city average comparison me#hod (http:llenr.construction.comleconomicsl). The Council also put in a clause that the fee could not increase by more than fifty cents (0.50) in any given year. The current rate for the storm utility fee is $6.50 per equivalent service unit, which is a standard Single Family Home, or 3,000 square feet of impervious surface for commercial and industrial properties. The CCI from March 2010 to March 2011 is 3.9%, equating to a twenty five cent {0.25} increase. The money raised from this utility fee is the only source for funding for our storm drainage system which includes storm sewers, manholes, curb inlets, culverts and bridges. The current Capital improvement List for improvements is one milNon for older and smaller pipes in the downtown core and 5 million for bridges and culvert replacement and upgrades. The additional monies raised would go towards additional capital construction projects. 140 S. In 2010 the City Council adopted ordinance language to evaluate the storm utility fee on an annual basis. B. The review adjusts the fee based upon inflation/deflation in construction activity in relation to the Construction Cost Index (CCI) 20-city average comparison. C, Construction Inflation increased by 3.9% since March of 2010, equating to a twenty five cent (0.25) increase in the storm drain equivalent service unit. D. The current equivalent service until is $6.50. The City of Central Point resolves as follows: Section 1. The storm utility fee is increased to $6.75 for each equivalent service unit. The property owner is notified of the hazard and given a 30 day period in which to maintain the property. Following the 30 day notice; if the owner has not resolved the issue, the City then arranges for the maintenance of the lot and pays for the work to be done. The attached resolutions are provided to place liens upon the properties so that the City may eventually be reimbursed for the costs incurred by the City to maintained the property when the owner is negligent in doing so. The total amount of liens to be placed upon the record are $4,532.00. Recommended Action: That the Council adopt the attached resolutions placing liens upon the properties to reimburse the City of costs associated with weed abatement of the property. RESOLUTION NO. Addresses: 4D0, 41D, 42D, 430, 440, and 4S0 Federal Way, Central Point, Oregon. On June 14, 2010 I inspected the area of Federal Way and Ice Cream Drive. During my inspection of the area I observed 3-4 feet weeds going on the above lots. On June 15, 2010 I sent two registered letters regarding the weeds to the property owner of record with the Jackson County Assessor's Office, ACG Properties LLC. The letters directed the owners to remove the weeds within 1S days ar they could be cited and the City would cause the removal and charge the costs in the form of a lien against the properties. On June 17, 2010, I received return receipts signed by Ch ristina~Prescott. During the period between June 17, 2010 and my final inspection on September 17, 2010 I checked several times to see if the weeds had been cut. Public Works Administrative Assistant Karen Roeber sent the invoices to the Billing Department on January 26th, 2011. The Code Enforcement Officer received return receipts signed by a representative of ACG Properties indicating that they had received the registered letters. Following an additional inspection on September 17 the Code Enforcement officer noted that the weeds on the subject property had still not been cut. The Public Works department was then notified that the weeds needed to be cut. The Department hired a contractor who cut the weeds and charged the City $647 dollars. The City subsequently placed a lien on the properties in that amount. I received a letter dated April 18, 2011 disputing the charges and requesting an appeal to the City Council. The City gives three notifications to property owners concerning their responsibility to keep their properties mowed. The first are general notices, one in the Mail Tribune and another in the pre-summer city newsletter. Offending property owners are then sent a registered letter giving them 15 days to comply. If after 1 S days the property owner fails to comply, the City then has the authority to cut the weeds and charge the costs to the property owner. ~~ Please note that the Code Enforcement Officer had approximately 200 weed abatements in process last year. i would also point out that given the number of properties that the Code Enforcement Officer deals with on an annual basis it is not possible to constantly remind property owners of their responsibility to keep their properties mowed. To my knowledge this is the only citation that has been appealed. Third Street Central Point, OR 97502 Dear Sir or Madam: Enclosed if a Notice of Assessment for unpaid cost for weed abatement we received on April $, 2011. We object to the costs assessed. We own lots on both sides of Federal Way. Ail of our lots in the area were mowed in late August 2010. After mowing, the land was riot irrigated ar sprinkled and there was very little to no rain. Therefore, the weeds should not have grown very much before the end of fire season. Currently, the weeds on all of our lots are about the same height and no more than 10 inches. Therefore, it is difficult to believe that the weeds were too high in September 2010. Furthermore, if the weeds are in excess of the maximum height during fire season, we receive a notice from the governing agency advising us of the fact so that we can address the problem. Flowever, we have no record of having received notice that mowing was necessary in September 2010.
