City of Central Point
December 12, 1974
The common Council met in regular session, Mayor Jim McBee presiding.
Roll call found the following Councilmembers present: Bowers, Hamer,
Mills, Snook, and Tally. Absent being Hudson. Staff attendance being
City Administrator Ron Young, City Recorder Zander, City Attorney DuBay,
Public Works Supt. V. Capps, Fire Chief Higinbotham, Community Develop-
ment Engineer Replogle, and Police Chief Sanders. Chairman Don Banks
of the Planning Commission was present and numerous other interested
citizens.

11J Mayor McBee presented the minutes of the November 27, 1974 Council
Meeting to the Council and called for any questions. Motion was made
G1-' by Hamer, seconded by Snook to approve the minutes as read. With all
A in favor, motion was carried.
Public Appearances
Mr. Robert Russell was recognized by the Chair and spoke of his brother's
property (Mr. Jack Russell)' 460 West Pine Street) that was annexed by
Resolution #168. Mr. Russell contended that certain violations are noted
in the annexation proceedings. He stressed that no notification, adver-
tisement, or personal information was given to any of the homeowners (3)
prior to the annexation. Discussion was held. Mr. Russell indicated
that the property-owners may consider a R-3 zone instead of the Automatic
R-1 at the time of annexation. Motion was made by Bowers, seconded by
Tally that the issue be referred to City Attorney DuBay for a complete
rendition of the proceedings of annexation and a letter to Mr. Jack
Russell would be forthcoming stating the City's poS+ition. With all in
favor, motion was carried.
Mrs. Susan Taylors correspondence was read and the letter requested
that the City place proper signs directing tourists to I-5 Freewaysfrom
the area of Old Highway 99 and Pine Street. Discussion held. Motion
was made by Hamer, seconded by Bowers to have Mr. Ron Young contact
State Highway Department personnel regarding the issue and attempt to
resolve the problem. With all in favor, motion carried.
Correspondence was read from Mr. Marion Hull, Hanley Road resident and
City property-owner, requesting to withdraw 9.32 acres from the West
City limits from the City of Central Point. Mr. Hull also spoke as being
land locked and unable to profit from the 9.32 acres now in the City and
joining West Pine Villa Subdivision. Mr. Hull mentioned that present
zoning of the property is restrictive to any farm use and if a R.F. Zone
were possible, he would consider the position on rezoning. (The present
tax being over $400.00 per year.)
It was suggested that the Administrative Committee study the issue and
that Mr. Hull be present during the discussion. Attorney DuBay mentioned
that the Comprehensive Land Use Plan should be studied and complied to.

Mayor McBee advised that Mr. Young would contact Mr. Hull when the
meeting would be held to discuss all avenues.
The public hearing was called as advertised on the annexation of South ial
First Street property between Cupp Drive and Beall Lane. The Mayor
called for any persons wishing to speak on the issue.' Mr. Richard
McGinity, First National Bank, trustee of the late John Cupp estate,
spoke of certain property in question within the considered area for
annexation. Mr. McGinity recommended that annexation proceedings of
his property and also mentioned that the six lots are tentatively sold
and hopefully to dispose of the property to the perspective buyers..
A letter was read, signed by James Hall, owner of Hydraulic Jack, and
owner of certain property in question. The letter mentioned a no vote
and does not favor the annexation. By no further questions from the floor
or discussion to be held, the Mayor ordered the public hearing closed.
Attorney DuBay referred to Annexation Rules and advised that the City is
well within the boundary of passing the Ordinance if the Council should
favor passing the annexation. Attorney DuBay read the proposed Ordinance,
and reading in part:
"An Ordinance Providing For The Annexation Of Contiguous Territory To
The City Of Central Point Adjacent To Pacific Highway Between Cupp
Drive and Beall Land Without An Election, Classifying Such Property As
Zone M—1, And Withdrawal Of Such Property From Central Point Rural
Fire Protection District And Bear Creek Valley Sanitary Authority."
Discussion held. Motion was made by Bowers, seconded by Snook to
adopt Ordinance #1187 as read. Roll call vote, all in favor, motion al
carried. Ordinance #1187 Declared Duly Adopted.
Attorney DuBay presented a proposed Ordinance, and reading in part:
"An Ordinance Amending Ordinance No. 1113 to Authorize Increased Interest
on Warrants for Payment of Construction."
Discussion helld. Motion made by Mills, seconded by Tally to adopt City
Ordinance #1188 as presented. Roll call vote, all in favor, motion
carried. Ordinance #1188 Declared Duly Adopted.
City Attorney John DuBay presented a proposed Ordinance, recommends
passage, and reading in part:
"An Ordinance For A Public Hearing On The Question Of The Withdrawal
Of Certain Recently Annexed Property From The Bear Creek Valley Sanitary
Authority And From The Central Point Rural Fire Protection District And
Directing The Publication And Posting Of Notice Thereof As Required By
ORS 222.524."
Upon a call for any questions, Mr. Bob Russell was recognized by the
Chair. Mr. Russell naked if properties described within the reading
of the proposed legislation included his brother's property, and why,
if so, is it being withdrawn from Bear Creek Valley Sanitary District
IL
and Central Point Rural Fire District. Mayor McBee explained that the
proposed public hearing ordinance would be to withdraw these properties
from any future bond indebtedness and would prevent the duplication of
tax towards fire protection and sanitary sewer service. Discussion
held. By no questions raised by members of the Council, motion was
made by Bowers, seconded by Tally to adopt Ordinance #1189 as proposed.
Roll call vote, all in favor, motion carried. Ordinance #1189 Declared
Duly Adopted.
Attorney DuBay presented a Resolution for the Mayor and Council, and
reading in part:
"WHEREAS, an agreement has been presented to the City of Central Point
ilk for cooperative development with the State of Oregon by and through its
Department of Transportation, Highway Division, for construction of two
public parks commonly known as "Mansanita Municipal Parks", Oregon
Project No. 848, funds for which are provided through Federal Grants on
a cost matching basis, and the City Council has reviewed such project
and the agreement with the Department of Transportation and deems it in
the public interest of Central Point to authorize making of such agree-
ment as in the best interests of the City of Central Point."
With no questions opposing, motion was made by Snook, seconded by Tally
to adopt Resolution #192. Roll call vote, all in favor, motion carried.
Resolution #192 Declared Duly Adopted.
/41 Mayor McBee personally thanked Mr. R. Young, City Administrator, for his
effort and hard work in securing for the first time money to assist in
formulating funds for a City Park.
Mr. Young presented the agreement with Rogue Valley Council on Aging;.
Central Point Senior Citizen drop-in Center. It was of Mayor and
Council's opinion to review the document and pass on the issue at the
next meeting.
New Business
Mayor McBee advised that a public hearing would be held on December 26, 1974
at 7:30 P.M. on the matter of a Supplemental Budget for the City of
Central Point and urged all concerned persons to attend. City Adminis-
trator Ron Young stated that a study session is being called with the
Council and Budget Committee for December 19, 1974 at 7:30 P.M.
Old Business
Councilmember Hamer gave the Street Committee Report on the two (2) hour
parking. Councilman Hamer stated that he had made a merchant survey and
found a 100 percent (1000 support of parking enforcement. It was the
opinion of the Street Committee that the recommendation made at a
November meeting still stands for the police to continue the enforcement.
/41 Bills for payment were presented, studied, and discussed. Motion was
made by Snook, seconded by Mills, to approve the payment on gills presented.
Roll call vote, all in favor, motion carried.
Mayor Jim McBee spoke of the Fire Department's Christmas Dinner that
he and Councilman Mills attended at which time City awards were given
to certain Volunteer Firemen for outstanding service towards thisiwl
City during the past years.
The Mayor read the awards given to the following members of the Fire
Department and their related achievement:
1. Volunteer Fire Captain Everett Bessey had a perfect drill attendance
and only missed one drill in the last five years.
2. David Harlacher, Captain of Regular Fire (paid) missed one drill
in 1974.
3. Stan Bushnell, Volunteer Engineer, missed one drill in 1974.
4. Al Ziemann, Volunteer Captain, missed two drills in 1974.
5. Bill Kalista, Volunteer, missed two drills in 1974.
The Mayor extended his thanks for the City of Central Point to these
people of the highest caliber. The Mayor also mentioned other outstanding
departments, Police Department, Public Works Department, and all
persona of the City SSaff as the most capable employees he has ever
worked with.
The Mayor especially commented on the North 3rd Street Improvement
Project that was done by our City Public Works crew. "Many thanks to
all the City employees."
City Administrator Ron Young advised the Council and read a letter from
Nr. Bob Lee, Manager of the Medford pity Water Commission, stating that
a possible water rate increase by the billing date of March, 1975. The
letter stated that the Commission would meet on January 6, 1975 as a
scheduled hearing and for Central Point to be present. Discussion held.
Mayor McBee advised that he would attend the meeting and urged all
Councilmembers to be present for the hearing.
Administrator Young read a letter from Crater High School Jazz Band
Director C. Scott Phillips requesting a business license exemption for
his class to sell Christmas trees. Discussion held. Motion was made
by Tally, seconded by Hamer to allow the no fee for business license
inasmuch as the nonprofit project of selling Christmas trees of the
Crater Band is a school project. With all in favor, motion carried.
Discussion was held relating to outgoing City Planning Commissionmembers
by the first of the new year. Mayor McBee mentioned that Mr. Donald
Turner, former Volunteer Fire Chief, has indicated his interest of
serving on the Commission when needed.
