Council Chambers 250 Fast Pine Street June 13, 1974 The Common Council met in regular session with Mayor Jim McBee presiding at 7:30 P.M. Roll call found the following Councilmembers present: Hamer, Malot, Mills, Snook, and pally. Absent member was Jim Hudson. Also present were Paul beery, Budget Committee, City Administrator Ron Young, Recorder Zander, City Attorney DuBay, Public Works Superintendent Vern Capps, Fire Chief A. Higinbotham, several members of the City Planning Commission, and .•4 numerous interested citizens. 1f� Mayor McBee announced at this moment of the meeting there is a scheduled public hearing as advertised for the 1974-75 fiscal year budget of the City of Central Point. The Mayor also advised that Mr. Paul Emery, a Budget Committee member was present and thanked him for his attendance and effort he had given towards the City to present a very close and conserva- tive operative budget. City Administrator Ron Young gave the budget message (refer to budget report). At this time, Mayor McBee called for any public comment. No public opinion was voiced so the Council discussion followed. Because of no further questions being raised, Mayor McBee announced that the public hearing be closed. Since there were no questions from the Council, a motion was made by Mills, and seconded by Snook to adopt the 1974-75 City of Central Point Budget as presented. Roll call vote, all in favor, motion carried. Mayor McBee advised that the budget document would be published in the Medford Mail Tribune for public inspection as proceeded by Oregon Revised Statutes. Also, the inspection of the budget may be made at the City Hall, anytime during business hours. The next public hearing on the budget will be set and advertised for June 27th. The Mayor thanked members of the Budget Committee and the citizens of Central Point for their contribution in finalizing this budget. He also thanked Ron Young for his fine work in securing the information and putting the document together. Mayor McBee called for the hearing of a fence variance report from the committee, on Mrs. Emma Smith residing at 101 Windsor Way. Discussion was held. Councilman Hamer advised that the Committee make the field study and recommended the shrubs be removed to prevent motorists of obstruction. Also, a 21 setback from the 3rd Street side was suggested. If these conditions could be met, the Committee would recommend the 51 chain link fence. Discussion was held. No further questions were raised and Mrs. Smith agreed to the conditions recommended. Motion was made by 111 Snook, seconded by Hamer to allow the conditioned variance of a 51 chain link fence, two setbacks from present line, and the removal of the shrubs at the corner portion of the lot. Roll call vote. Majority in favor, motion was carried. Mayor McBee introduced Mr. Mike Burroughs of Central Dispatchers, with the 911 Emergency Telephone System as point of discussion. Mr. Burroughs advised that it is hoped the entire Valley and County would reorganize the 911 Emergency Diepatchery System in the near future. He also noted that the City of Medford has passed a resolution indicating concern and need for the expanded service. Mr. Burroughs presented a proposed resolution for the City's study and support of the project. Council discussion was held and recommended that the Police and Fire Committee make a work study of the proposed and present their findings to the Mayor and Council. The Mayor pointed out several truck owners in the audience and recognized them as to Ordinance 1153 — pertaining to overweight vehicles. Mr. Ken Parr, Scenic Avenue, spoke of his logging truck being over the 15,000 load limit. He then stated that a truck and trailer would not cause any street damage, although he did realize that loaded trucks would be a problem to the pavement. Mr. Vern Dalkenberg, of North 3rd Street, advised that he had in the past parked his loaded log truck on North 3rd Street, but only when a late hour haul was anticipated. Mr. Dalkenberg did agree to the loaded trucks causing street damage when parked. Mr. Wayne White, agreed to prohibition load trips of using the streets but felt that loggers were being discriminated against when other large trucks are allowed and excused in excess of 15,000 load. Mr. Wilbert Lull, of Military Road, recommended a truck route with the posting of streets or roads for the overwei*ht vehicles. A lengthy discussion followed and it was the general consensus of the Mayor and Council that a study session be set and further discuss the problems' of the trucking industry. Motion was made by Tally, seconded Mills to meet with truck owners and drivers on June 21, 1974 at 7:30 P.M. to further review the opposition of the truck maximum weight ordinance. With all in favor, motion was carried. City Administrator Ron Young 'read correspondence from the Oregon State Highway Dept. requesting a City resolution of "Save and Hold Harmless" agreement. The issue relates to any state projects performed within the City. Discussion was held and the study was referred to the City Attorney for his review. Mayor McBee called upon City Attorney DuBay for any proposed Ordinances prepared for passage. The City Attorney presented proposed Ordinances, and reading in part: "An Ordinance Amending Ordinance No. 723 by Requiring all Subdivisions to Include Land Dedicated for Public Purposes or for Payment of a Fee by the Subdivider in Lieu of Dedication." Discussion held. By no questions raised, motion was made by Hamer, seconded by Tally to adopt Ordinance #1156 as read. Roll call vote, all in favor, motion carried. Ordinance #1156 Declared Duly Adopted. Mayor McBee referred to the Sanitary Sewer assessment of Dobrot Way and answered the scheduled public hearing on the issue. Mr. Norman Bruce was recognized by the Chairman and spoke of a neighbor, "Mr. Delmar Smith", having seen sewer assessments on both Scenic Avenue and Dobrot Way. He mentioned that Mr. Smith was not aware of the Dobrot Way assessment inasmuch that he felt that Scenic Avenue would be his service line. Mayor McBee referred to the public hearing when both Scenic Avenue and Dobrot Way sewer projects were heard. By_no further questions or comments from the floor, the public hearing was ordered closed. Ordinance #1157 Declared Duly Adopted. Ga Attorney DuBay presented proposed Ordinance, and reading in part: "An Ordinance Amending Ordinance No. 761 Revising Fees For Business Licenses." Discussion held. No questions or comments from the floor. Motion was made by Mills, seconded by Snook to adopt Ordinance #1158 as read. Roll call vote, all in favor, motion carried. Ordinance #11.58 Declared Duly Adopted. The next proposed Ordinance, and reading in part: "An Ordinance Amending Ordinance No. 322 Revising Annual Fees For Solicitors, Canvassers, And Peddlers." Discussion held. No questions raised. Motion made by Snook, seconded by Tally to adopt Ordinance #1159. Roll call vote, all in favor, motion carried. Ordinance #1159 Declared Duly Adopted. Attorney John DuBay, recommended the passage of a proposed Ordinance, and reading in part: "An Ordinance Amending Ordinance No. 865 Regarding Public Dances." Discussion held. No questions raised. Motion was made by Snook, seconded by Hamer to adopt Ordinance #1160 as read. Roll call vote. All in favor, motion carried. Ordinance #1160 Declared Duly Adopted. Attorney DuBay proposed passage of an Ordinance, and reading in part: "An Ordinance Amending Ordinance No. 1144 by Adding the Definition of Nudity, Obscenity, Sado-Masochistic Abuse, Sexual Conduct and Sexual Excitement as Defined in the Oregon Revised Statutes." Discussion held. No questions were brought forth. Motion made by Tally, seconded by Mills to adopt Ordinance #1161 as presented. Roll call vote. All in favor, motion carried. Ordinance #1161 Declared Duly Adopted. Attorney DuBay presented proposed Ordinance, and reading in part: "An Ordinance Amending Ordinance No. 744 Regarding Obscene Phone Calls." t.. Discussion held. No questions raised, motion was made by Hamer, seconded by Tally to adopt Ordinance #1162 as presented. Roll call vote, all in favor, motion carried. Ordinance #1162 Declared Duly Adopted. Attorney DuBay presented proposed Ordinance, and reading in part: "An Ordinance Repealing Portions Of Ordinance No. 306 And Establishing New Provisions Defining And Punishing Offenses Against The Public Peace, Safety, And General Welfare Of The City." Discussion held. No questions raised. Motion made by Mills, seconded by Malot to adopt Ordinance #1163 as presented. Roll call vote, all in favor, motion carried. Ordinance #1163 Declared Duly Adopted. Attorney DuBay presented proposed Ordinance, and reading in part: "An Ordinance Repealing Portion Of Ordinance No. 893 Regarding Fences." Discussion held. No questions raised. Motion was made by Malot, seconded by Snook to adopt Ordinance #1164 as read. Roll call vote. All in favor, motion carried. Ordinance #1164 Declared Duly Adopted. Mayor McBee thanked Attorney John DuBay for his effort in preparing the many needed Ordinances to update the codification of Ordinance Codes as requested by the publishing company. Mayor McBee reported that the Rogue Valley Council of Governments at the last meeting were advised that the City of Central Point as well as other communities have one member to the, "Man Power Planning Board." Discussion was held as to any possible candidate for the appointment. Mr. Paul Emery was nominated by the Mayor to represent Central Point. Mr. Emery's comment was that he would like to discuss the assignment and its activity. Motion was made by Tally, seconded by Snook to allow Mayor McBee to make the appointment to his discretion or choice to selection. With all in favor, motion carried. City Administrator Ron Young read correspondence from the City of Jacksonville requesting membership for possible future Bear Creek Valley Sanitary Authority service. Discussion hold. Motion was made by Malot, seconded by Mills to have Mr. Young meet with the City of Jackson- ville and B.C.V.S.A. on the issue and report the recommendations to the Council. A discussion was held relating to establishing a Parks Commission. The following persons have been nominated to fill the appointments: Ray George, Paul Emery, Bill Russell, Greg Dippel, Orville Hamer, Corrine Harris, Bruce Bateman, Warren Holbrook, and Mrs. Kottke. Y- It was agreed by the Council to have the Mayor and the City Admin- istrator contact the candidates for interviews. Mayor McBee reported on the joint social meeting with the City of Medford's Mayor and Council and Central Point's Mayor and Council. He emphasized that a better, closer, and more educational relation had been established. The Mayor announced that the budget, if passed, will be published for the public and citizens of Central Point. A public hearing will also be held June 27th at 7:30 P.M. The Mobile Home Study report was presented to the Mayor and Council. rl Mayor McBee advised that the Mayor and Council should study the report before any decision is made. 1.14Bills presented for payment were received. By close study of the bills it was the Council's directive to hold the Marquess & Marquess Engineering statement for further study. Motion was made by Hamer, seconded by Snook to pay the bills as approved and to review the Engineering bill before payment. With all in favor, motion carried. Mayor McBee referred to Federal Legislation as having a bill before the House regarding, "Land Use Planning" that would or could effect the City. The Mayor stressed "If this Council feels that we don't heed the Federal Government's help for local zoning and land use, we should speak up." It was the suggestion of the Council to direct a letter to our Senators and Representatives and not favor this bill as proposed. With no further business to be brought before the Mayor and Council, a motion was made by Snook, seconded by Tally to adjourn until the next regular meeting or to the call of the Mayor.
