Council Chambers

May 23, 1974
The common council met in regular session with Mayor Jim McBee presiding
at 7:30 P.M.
Roll call found the following counci].members present: Hamer, Hudson,
Malot, Mills,, and Snook. Absent member Tally. Also present were City
Administrator Young, City Attorney DuBay, Recorder Zander, Engineer
Westwood, Public Works Supt. Capps, Building Inspector Chastain, Police
Chief Sanders, members of the Fire Dept., and also several Planning
COMmissionmember0.
Mayor McBee referred to Item three of the Agenda as correspondence. Mr.
Young read a letter from Beta Zeta Epsilon Sorority Chapter of Central
Point asking permission for placing a "Band Stand Shell" at the City
Park. The letter mentioned that the Chapter is out for a fund raising
project towards this improvement. Mayor McBee called for anyone
speaking or representing the organization to further explain. No repre-
sentative was noted to be present and it was determined the issue to
be referred to the Park Committee and to meet with the local Chapter.
City Planning Commission report was read by Mr. Young outlining the
highlights of the May 21st meeting (Refer to Plan. Commission Report).
Within the item of interest was the zone change request of property
owned by the City and Public Works occupied. Discussion followed.
Attorney John DuBay advised that the next step would be to call for a
resolution by the Council as per Zoning Ordinance calling for a public
hearing. Motion made by Hamer, seconded by Malot to set a public hearing
for June 13th as to amend the Zoning Ordinance allowing the use as
intended. Roll call vote, all in favor, motion carried.
Mrs. EMma Smith, 101 Windsor Way, was called upon by the Mayor to further
discuss the fence variance as applied for. The Street Committee study
report indicated that shrubs at that location are obstructing certain
view of motorists, and should be removed. The discussion that followed
referred to North Third Street Improvement Project proposed, and with
this, another field study by the Committee was asked for and for Mrs.
Smith to be present. The date chosen for the inspection was scheduled
for May 24th at 5:30 P.M.
The progress report of Northwest Printed Circuits construction site was
read by Mr. Young. The letter indicated that a possible override of
completion date could be expected due to some difficulty in obtaining
equipment and material. The Mayor advised all that he has found North-
west Printed Circuits management very diligent in keeping the City
informed of the progress and if any difficulty should arise, the City
shall be so informed, and, hopefully this Council would make a thorough
study.

Mr. Keith Damon, 109 Donna Way, was heard concerning a variance request
/41 for an ornamental fence "split-rail" type. Mr. Chastain advised that
Mr. Damon had encroached onto the City right-of-way, with a fence
structure without a fence permit. Discussion held. The fence is a free-
standing, non-permanent decorative type. Various photos were shown of
existing fence violations as per the fence ordinance. Mr. Young advised
that 8 notices of the noted violations had been given to property-owners.
A lengthyOdiscussion followed. All members of the Council gave their
views and a motion was made by member Hudson, seconded by Mills to hold
off the enforcement of the fence ordinance of all the noted violators
for a further study of each on an individual complaint basis and study
the entire ordinance. With all in favor, the motion carried.
The Chair called for the appeal as,-,requested from J.D. Dutton, Inc. as
to the denial of a conditional use permit from the Planning Commission.
Mr. Young read the letter of appeal. Discussion was held. ':Attorney
DuBay advised that no public hearing of the appeal *houid be considered
Ca as the issue is far beyond a Conditional Use. Instead, it would require
a Zone Change as to the requested use. Discussion was held. Attorney
DuBay so advised that only professional office would be permitted at the
premises according to the Zoning Ordinance. Mr. Bruce Cabal acknowledged
the order as given by the Mayor and Council to the apparent violations of
its present use. Motion was made by Snook, seconded by Mills to deny
the Conditional Use Permit (is so instructed by the City Attorney) as
requested. Roll call vote, all in favor, motion carried.
Mayor McBee referred to Old Business, and called upon Attorney DnBay
for any proposed ordinances. Attorney DuBay presented an ordinance and
reading in part:
"An Ordinance to Provide a Program for Utility Discounts for Senior
Citizens."
Discussion held. By no questions from the floor, motion was made by
Hudson, seconded by Malot to adopt Ordinance #1152 as read. Roll call
vote. All in favor, motion carried. Ordinance #1152 Declared Duly
Adopted. (Senior Citizens Discount (based on income) on Water Service
Program)
Attorney DuBay next presented a Resolution proposed, and reading in
part:
"Resolution Setting Senior Citizens Utility Discount."
Discussion held. By no questions raised, motion was made by Hamer,
seconded by Hudson to pass on the Resolution as read. Roll call vote.
All in favor, motion carried. Resolution #183 Declared Duly Adopted.
(Discount of qualified Senior Citizens of $1.50 on Water Service Monthly

Attorney DuBay presented a proposed Ordinance and reading in part:
"An Ordinance Prohibiting the Driving of Certain Tracks and Vehicles
over Streets within the City of Central Point and Providing a Penalty
for the Violation Thereof."
Discussion held. Councilmember Hamer felt that more discussion should
be conducted. Mayor McBee advised that the situation is very serious
and should be considered as an emergency due to the damage on residential
streets not solely constructed for this overweight type equipment. By
no further questions or discussion, motion was made by Mills, seconded
by Snook to adopt Ordinance #1153 as presented and read. Roll call
vote. Hamer-no, Hudson yes, Malot-yes, Mills yes, Snook-yes. By
majority being in the affirmative, motion was carried. Ordinance #1152
Declared Duly Adopted. (Limitation of Trucks exceeding 15,000 pounds
gross weight from certain streets)
Attorney DuBay next presented a proposed ordinance relating to land
acquisition and dedication for public use as parks and recreation usage,
or cash payment in lieu of land. Discussion held. Mayor McBee advised
that the area of concern still appears to be unanswered and recommended
more study by this body before any decision is made. Motion was made by
Hudson, seconded by Mills to table the issue awaiting further study
reports and legal advise. With all in favor, motion carried.
Attorney DuBay presented a proposed ordinance and reading in part:
'An Ordinance Making Provisions for Sanitary Sewer Connection Charges
as Part of the Plumbing Code and Repealing Ordinance No. 1136.2'
Discussion held. By no questions raised, motion was made by Hamer,
seconded by Mills to adopt Ordinance #1154 as presented.. By roll call
vote, all in favor, motion carried. Ordinance #1154 Declared Duly
Adopted. (Sanitary Sewer Connection Charges)
The City Attorney presented a. proposed ordinance relating to Dobrot
Way Sanitary Sewer assessments of a sewer project and advised that
additional time is needed to prepare a public hearing on the issue and
recommends a continuance. Mr. Jack McCoy was recognized by the Chair
and stated that he had not attended any of the publicAlearings on the
proposed assessments and wanted to know if a final decision had been
made, how the charges would be spread on each property. The Mayor
advised him that a public hearing had been held as to a share-alike-
per-residence benefitting by the sanitary sewer. Attorney DuBay presented
a proposed ordinance recommending its- passage and reading in part:
"An Ordinance Amending Ordinance No. 971 and Fixing Sewer Service Rates
for Certain Recently Annexed Property Subject to the Bear Creek Valley
Sanitary Authority Bonds."
Discussion held. No questions raised and motion made by Mills, seconded
by Hudson to adopt Ordinance #1155 as read. Roll call vote. All in
favor, motion carried. Ordinance #1155 Declared Duly Adopted.

(Establishing $4.25 Sewer Rate for Scenic Avenue/Dobrot Way Single
Family Residences)
Mayor Jim McBee presented certain bills for council study and recommends
payment for those approved. No questions of the bills presented for
payment was forthcoming. Motion was made by Hamer, seconded by Mills
to pay the bills as presented. With all in favor, motion carried.
Unscheduled matters for council consideration Councilmember Malot
advised that the City should consider advance study of the sidewalk
ordinance as to prevent the continuous disagreement of '+who should
and who does note have to construct sidewalks upon developemnt. Mrs.
Malot stated that if a final ordinance could be constructed spelling
out in a more detailed definition, it could eliminate the present
problem. Councilman Hamer sanctioned the idea and stated that the
Street Committee would review the present ordinance and secure any
information or recommendations to the Council.
Discussion was held regarding the apparent violation of the Subdivision
Ordinance (Mazama Village) by D. Fax Builder of property at 605 North
Fifth Street. Mayor McBee advised that numerouscontacts were made with
Mr. Fox regarding the matter. However, he and Mr. Young will follow-
up the situation.
Mayor McBee announced that he and several hundred Central Point residents
had observed the Crater Baseball Team to another victory, and are now
in final place for the State Championship.
City Administrator Young read a letter from Mr. Melton Nelson, Jackson
County Transportation Director, announcing his intent to withdraw his
prior request of funds from the City to allow the Central Point bus
run. The letter indicated that the entire funding program has made it
impossible to continue the 6entral Point service.
The Mayor announced that next Tuesday is our Primary Election for
County, State elections and for everyone to vote for our choice of
candidates and measures.
City Administrator Young read a letter of distress from Mr. H. J. Kasper,
No. 10th Street resident regarding a private sanitary sewer line from
Mazama Village to his property. The letter indicated that upon excavation
of the sanitary sewer stub he was unable to establish a "Tee" connect.
Mr. Kasper advised that he had paid Western Consolidated Developers
$1,300.00 for the service and now is unable to use the sewer line.
Discussion was held. Mr. Westwood, City Engineer, stated that he had
little or no knowledge of the incident as Mr. Kasper was in direct
dealing with Mr. Ulfers and Mr. Hutton. It was determined that the
problem is of a private matter and that the City could not share any
obligation or responsibility. Mr. Young was asked to so advise Mr.
Kasper.
It was agreed to hold a Budget Committee meeting on May 30, 1974 at
7:30 P.M.

With no further business from the floor and nothing more to be brought
before this Council, motion was made by Hamer, seconded by Malot to
adjourn to the next regular meeting or to the call of the Mayor, With
all in favor, motion was carried.
