HomeMy WebLinkAboutCM050974 V tj Council Chambers 250 East Pine Street May 9, 1974 The common council met in regular session at 7:30 P.M. with Mayor Jim McBee presiding. Roll call found the following councilmembers present: Hamer, Mills, Snook, and Tally. Absent being Sandra Malot and one position vacant on Ward II. Also present were City Attorney DuBay, City Admin. Young, Recorder Zander, Public Works Supt. Capps, Fire Chief Higinbotham, and Police Chief Sanders. Minutes of April 11th and April 25th were read and discussed. No questions raised, motion was made by Tally, seconded by Mills to approve C the minutes as read. All in favor, motion carried. Mayor Jim McBee advised that the report presented to him by the Admin- a istrative Committee for a candidate for Councilman of Ward II is forth- coming. He emphasized that difficulty was experienced in locating interested and qualified people to take interest in City affairs and government. The Mayor, at this time, called for the recommended candidate, Mr. Jim Hudson. Mr. Hudson stated that he would accept the unexpired term of office of that Ward, and that his residence&-(owner) being 501 Cedar Street, Central Point. At 7:38 P.M. Councilmember Malot arrived. By no questions raised opposing the selected candidate, motion was wade by Tally, seconded by Mills to appoint Mr. Jim Hudson as a councilmember for Ward II. Roll call vote, all in favor, motion carried. Mayor McBee called for Mr. Hudson to step forward and the Orth of Office was administered. The extended welcome was made by the Mayor and Council to Councilman Hudson. The Chair recognized Mrs. Emma Smith, 101 Windsor Way as per Agenda appearance. Mrs. Smith spoke regarding a request for a variance of a wire fence (50 for her animals on North Third Street side of her property. Discussion held. It was suggested that the Street Committee make a field inspection of the request and submit a report for the Council at the next meeting. Letters of communication were read by City Administrator Young. Item 1 - Letter from Mr. Bill Cranford, B.C.A.T.S., asking for City in-kind service for updating their study and project. Item 2 - Letter from Bear Creek Valley Sanitary Authority Manager Joel Wesselman advising the City of a Federal Grant and the City's share being $26,602.36 (check was enclosed with the communication). Item 3 - Letter directed to all Mayors and Councilmembers of Jackson County advising and asking recognition of the Senior Citizens and declaring the month of May as Senior Citizen month. Special consider- ation is suggested towards our Seniors, signed Mr. Ed Sage of Rogue Valley Council on Aging. LVA Item 4 - Letter to Mayor and Council from the Fourth of July Family Festival Committee was read and requested the permission for a parade permit, use of the City Park, and also financial assistance. Discussion held. Motion was made by Hamer, seconded by Malot to acknowledge the request of the Committee, use of the park, a parade permit, and a $200.00 donation towards the activity. With all in favor, the motion was carried. Mayor McBee referred to Old Business on the following items. II. 1. Vacating alley between Ash and Cedar at Fifth Street. The general area is known as the City Public Works Dept. property. The Mayor opened the advertised public hearing. By no questions from the floor, the public hearing was ordered closed. Attorney DuBay read the proposed ordinance and reading in part: "An Ordinance Vacating an East West Alley Between South Fifth Street and South Sixth Street in Block 34 Original Town of Central Point, Oregon." By no questions from the Council, motion was made by Hamer, seconded by Hudson to adopt the ordinance as presented. Roll call vote. All in favor, motion was carried. Ordinance #1143 Declared Duly Adopted. (Alley vacation at City Shop Yards) 2. Attorney DuBay presented a proposed ordinance and reading in part: "An Ordinance Providing for Definitions Applicable Generally to Ordinances of the City of Central Point, Oregon, and Providing for Rules of Construction Therefor." By no questions raised from public attendance and no comments from the Council, motion was made by Hamer, seconded by Mills to adopt the Ordinance as read. Roll call vote. All in favor, motion carried. Ordinance #1144 Declared Duly Adopted. (General Definitions Applicable to Ordinance) - 3. Attorney DuBay presented a proposed ordinance and reading is follows: "An Ordinance Adopting a General Penalty." By no questions raised by public, and no further discussion by the Council, motion was made by Tally, seconded by Hamer to adopt the ordinance as read. By roll call vote, all in favor, motion carried. Ordinance #1145 Declared Duly Adopted. (Certain Ordinances amending Penalties and spelling out separate penalties for each conviction of violation) 4. Attorney DuBay presented a proposed ordinance and reading in part: iml "An Ordinance Granting a Right of Entry to Authorized City Officials for the Inspection of Buildings and Premises for the Enforcement of the Provisions of the City of Central Point, Oregon Ordinance." Discussion held. Motion was made by Mills, seconded by Snook to adopt Ordinance #1146 as presented. Roll call vote, all in favor, motion carried. Ordinance #1146 Declared Duly Adopted. (Right of Entry by City Officials for Building Inspection) 5. Attorney DuBay presented a proposed ordinance and reading in part: a "An Ordinance Repealing Ordinance No. 855 and Defining the Crime C.a .of Larceny." Discussion held. No questions from the floor. Motion made by Snook, seconded by Mills to adopt Ordinance #1147 as read. Roll call vote, all in favor, motion carried. Ordinance #1147 Declared Duly Adopted. (Defining the Crime of Larceny) 6. Attorney DuBay presented a proposed ordinance and recommending its passage and reading in part: t.An Ordinance Amending a Portion of Ordinance No. 905 Providing for Seizure of Illegal Amusement Devices." Discussion held. By no questions raised, motion was made by Hamer, seconded by Hudson to adopt Ordinance #1148 as presented and read. Roll call vote, all in favor, motion carried. Ordinance #1148 Declared Duly Adopted. (Seizure of Illegal Amusement Devices) 7. Attorney DuBay presented and recommends passage of proposed Ordinance and reading as follows: "An Ordinance Amending Ordinance No. 888 Regarding Violations for Unlawful Water Connections." Discussion held. No questions raised. Motion made by Mills, seconded by Tally to adopt Ordinance #1149 as read. Roll call vote. All in favor, motion was carried. Ordinance #1149 Declared Duly Adopted. (Unlawful Water Connections) 8. Mayor McBee called for the continued public hearing on the issue of the Sanitary Sewer Assessment Charges against property— owners of a point and location of Scenic Avenue beginning at Dobrot Way. The Mayor called for any questions by attending interested persons. With none noted, the public hearing portion was ordered closed. Discussion held. Attorney DuBay presented and recommends passage of proposed ordinance and reading as follows: "An Ordinance Declaring the Assessment of Property Benefitted for igi the Cost of Construction of a Sanitary Sewer Along Scenic Avenue frau Dobrot Way Southeasterly 730 feet in the City of Central Point, Oregon, and Directing the Recorder. to Eater a Statement Thereof in the Docket of City Liens and to Publish-a Notice Thereof." By no further questions, motion was made by Snook, seconded by Tally to adopt Ordinance #1150 as presented. Roll call vote, all in favor, motion carried. Ordinance #1150 Declared Duly AdoOted. (Scenic Ave. Assessment City Liens for cost of construction Sanitary Sewer to Property- owners.) Mayor McBee referred to the Dobrot Way Sanitary Sewer Project assessment and a discussion was held. The terms of charges were agreed to an equal sharing cost, by residents attending previous meetings. Discussion held. Motion was made by Mills, seconded by Tally to notify all property-owners by letter of the proposed assessment. Roll call .vote, all in favor,, motion carried. The Mayor reminded all that May 11th thru the 18th would be City Clean- up Week and that the City crews would be on "trash pickup service" on Saturday A.M. on the 11th and also Saturday May 18th. He stressed that for any person having debris should bag or box the trash and place it at curb line area. City Administrator Ron Young ("Wagon Master") advised that he would secure enough troops to carry out the operation. Fire Chief Al Higinbotham assured all that the Volunteer Fire Dept. members would assist in the cleanup project. Mayor McBee referred to a proposed ordinance setting new fees for City Business Licenses. This portion of the meeting was opened to the public for any comments. The Attorney read the schedule of rates. Mr. Jim Mayes spoke on behalf of the Central Point Chamber of Commerce and opposed the proposed increase as the percentage of increase was too high, and recommends the ordinance be tabled for further-public input. The Mayor welcomed Mr. Mayes' report, and asked for any other person to be heard. Mr. Keith Klisby, owner of Central Point Cleaners, opposed the proposed rate increase and felt that a 100% increase was too much; at this time. John Harvey of Harvey's Key Shop did not favor the new schedule. Mr. John Householder could not agree to a 100% increase in a business license. A lengthy discussion followed. Motion was made by Hudson, seconded by Tally to continue the proposed legislation to a study session for the May 20th Study meeting. With all in favor, motion carried. Mr. Young reported on Committee Reports: 11 1. Planning Commission met regarding the Van Wey planned construction. The issue was tabled for additional information as to off-street parking space and loading dock detail. 2. Five major arrests were made by the City Police Dept.; all of them involving marijuana. 3. The report from the Fire Dept. by Chief A. Higinbotham advised that his Volunteer Firemen are now at the maximum strength of 24. Mayor McBee referred to the written appeal request of Dutton Construction Co., Inc. requesting a public hearing on the Planning Commission decision 11; to deny variance and conditional use permit at the Franko Service Station property. Discussion held. It was the advice of Attorney DuBay that Q the appeal hearing be heard May 23, 1974 at 7:30-P.M. The bills were presented to the Council for approval. Discussion was held on the charges of C.P. Westwood regarding mileage relating to the North Fifth Street Storm Sewer. Motion was made by Snook, seconded by Tally to pay the bills as presented. With all in favor, motion was carried. Attorney DuBay presented a proposed ordinance relating to Sanitary Sewer Rates of multiple family/and mobile home parks. Discussion held. It was moved by Tally, seconded by Hamer to continue the passage of this ordinance for further study. With all in favor, motion carried. Mayor McBee called for the public hearing as advertised for the proposed ordinance and reading in part by Attorney DuBay: "An Ordinance Withdrawing Certain Property Recently Annexed to the City of Central Point from the Bear Creek Valley Sanitary Authority and from the Central Point Rural Fire Protection District." By no comment from the public, no questions by the Councilmembers, the Mayor ordered the public hearing closed. By no further discussion by the Council, motion was made by Mills, seconded by Tally to adopt Ordinance #1151 as presented. Roll call vote, all in favor, motion carried. Ordinance #1151 Declared Duly Adopted. (Withdrawing from B.C.V.S.A. & C.P.R.F.P.D. 3 parcels on South First Street) By no further business to be brought before the Mayor and Council, motion was made by Tally, seconded by Hamer to adjourn to the next regular meeting or to the call Of the Mayor.
