The common council met in regular session in a joint meeting with the Planning
Commission at 7:30 P.M.
Roll call found the following Council members present: Hamer, Malot, Mills,
and Snook. Absent were members Hadley and Tally (Hadley was working, and
Tally being ill). City Recorder Zander was on vacation. Also present were
City Engineer C. P. Westwood and City Treasurer Lorain Babe. Planning Com-
mission members attending were Banks, Bowers, Hull, Mayes and Zieser. Mayor
McBee reported on the tour of the Crater Rock Museum taken by some of the
Council members on Saturday, October 20th. Delmer Smith, owner, explained
about the various collections in the museum. The Mayor said the City Attorney
is preparing the proper instruments for the City to acquire the property from
the Smith's.
Discussion was held on the Freeman Road unitary Sewer Improvement. Engineer
Westwood had met with Mr. Gorden about signing an easement. Mr. Gorden had
given verbal agreement to sign the easement when he met with Westwood, Plan-
ning Commission Chairman C. 7. Bowers and Don Banks. But now, rr. Gorden will
not sign the easement unless City will connect him to the sewer line without
Gorden's annexing to the City. Yr. Westwood had advised Gorden this was not
possible under the present City policy. Mr. Westwood had contacted Harry
Elmore, Greenbriar Mobile Home Park. He would give permission for City to
install the sewer line through the Mobile Home Park, the alternate route.
Yr. Westwood toad the Council he would contact Mr. Gorden again, before he
proceeded with the alternate plan to see if he could negotiate for easement.
Councilman Hamer said the Nngineer should pursue getting easement from Mr.
Gorden. The Engineer estimated the additional costs for the alternate route
to be about ' 750.00. This was due to necessity of installing one additional
manhole and replacing the landscaping in the Mobile Home Park.
Mayor McBee questioned if money was available from Sewer Funds to pay the ad-
ditional Y750.0C if needed. Motion by Malot, seconded by Mills for City to
pay the additional. estimated. c750.00 to go the alternate route. Motion carried.
Y On the North Third Street Improvement project, the Engineer reported there
were 60 percent of property owners signed for curbs and gutters; with 55 per-
cent signed for sidewalks. He asked that the Council authorize signing of
agreement with Jackson County. County would pay for asphaltic paving, property-
owners for construction, curbs, gutters and sidewalks. Then the City accept
North Third Street as a City street and maintain it.
Motion by Hamer, seconded by Snook to authorize the Mayor to sign the Agreement,
on North Third Street Improvements, with County. Motion carried.
Discussion on those properties on North Third Street that, are still not annexed
to City, Orth Miller property, Jimmie White property and another property owner
not identified (TL '/500) followed. Council members Snook and Hamer will check
on these properties. Inclusion of these properties would complete i'Torth Third
Street from Mazama to intersection of North Tenth. Jimmie White had filed
;A, petition in July subject to being annexed as -zone to allow for a small store.

Planning Commission minutes were discussed:
1. Tentative plat Flanagan-Leonard review had been tabled until
future meeting to allow the developer to prepare more in-
_ formation. on Glenn Way extension. 2. Van Dyke, Attorney, had
requested special meeting, but since that time, asked to be
on the regular Planning Commission Agenda for the November
20th meeting.
Chairman Rowers told the Council that the Farnsworth tentative plat had been
approved by the Planning Commission but their decision eras overruled by the
City Council. Farnsworth was to appeal-but did not. Now it will be necessary
for Yr. Farnsworth to rile again.
Chairman lowers had set a Public Hearing for the proposed annexation of the
DeHaas property and properties on Highway 99 (Kitchen Masters and others), but
found it was not necessary. However, the Planning Commission thought the
CD Ll� people should be heard. He felt there was some discontent as to the rapid
rate of annexations. Two reasons given were: 1. Should we continue to annex
Q for the benefit of sewer and water service? and, 2. ;,cisting taxpayers must
A pay additional. taxes for these areas.
Mayor Melee said the DeHaas property should have been annexed with the Dobrot
lay and Scenic Avenue properties. Kitchen Masters and. others, will benefit the
City, as they are a developed commercial_ area.
Councilman Mills said new State Legislation will require us to annex areas that
have sewer or health problems.
The Council next reviewed the proposed ordinance amending Ordinance Nc . 723 by
setting aside certain open spaces for parks or in lieu of the land, pay into
a fund (to be established for the development of ;c..r'_'<s in the City). Member
Mills said some study had determined I lot for each 16 lots might be acceptable.
Hamer said a minimum requirement should be set due to some developments being
small- rills then asked if the funds should not go into a Park Fund, but not
limited to a specific area?
After further discussion, the Council decided to have the proposed ordinance
re-typed with the changes as suggested by the Committee, and present it again at
the November 8th meeting for more study.
Mayor Me gee reported he had several names to present t for the appointment to the
Planning Commission vacancy; Del Curry, Bill Morrison, Michael Redhead, Thomas
V. Thomas. The matter was tabled to November 8th meeting.
The Mayor brought to the attention of the Council a building e j_o iation - Dr.
Wisely and Dr. Lewis, upon moving into the building a • 25 North Fourth, re-
modeled without obtaining a building permit. Also, the Fui.lding Inspector
found the plumbing installed on the outside of building. Attorney had advised
that a letter be sent to the above stating they must stop work on building;
until building permit is obtained and work previously done be brought up to
Code. Council instructed Lorain "site to send letter.
Payor Mc lee read thank-you letter from Principal _risk, Central Point Ele-
mentary School, for the crosswalk on Freeman load.
Reservations were discussed for League of Oregon Cities Meeting November 11,
12, and 13th in Portland.
Ron Zieser requested two items be on the agenda for discussion:
1. Southern Pacific Railroad crossing in need of repair,. and
2. Grange Co-Op large trucks causing traffic hazard on Pine
Street next to railroad tracks due to parking out in Pine St.
Councilman Snook and City Ingineer were instructed to check with the Grange on
the problem to see if trucks could be moved into the docks, off-street.
Mayor McRee said in checking cn Irrors and Omissions insurance since last -
meeting, he found our :ire Insurance policies were insufficient to cover any
loss. The coverage was the same as 12 years ago. Any loss now could not be
replaced with what we had. Our present insurance company issued a binder,
which is now in effect. Letters have been sent to 8 companies to review our
insurance needs and submit bids. r-'i_ds to be received before Council meeting on
November 8, 1973.
Ron Zieser inquired about Flood _Insurance within city limits. Mayor McBee told
Mr. Zieser he tried to check on this insurance 'out with negative results.
Further effort to be Trade.
Mayor McI3ee told the audience that future luncheon meetings of the Council will
be held in Central Point if a place can be found. These luncheons are open
to the public.

Mayor Mciee said the Council had discussed the job being done by Lorain Tate
as temporary City Administrator in the absence of an administrator for the past
two months.
Motion by Snook, seconded by Malot to pay I orain Tate at the rate the former
Administrator was being paid. retroactive from October 1 until a new Administrator
is hired. Motion carried.
Motion by Mills, seconded by Snook to refer the proposed annexation of K.
DeHaas property to the City Attorney to prepare ordinance calling for Public
Hearing. Also, the Kitchen Master, and others, with the area to be zoned hi-I .
Motion by Malot, seconded by Mills, to adjourn. Motion carried. Meeting ad-
journed at 8:31 P.M.
