HomeMy WebLinkAboutCM042473 City Hall 250 East Pine Street April 24, 1973 The common council met in regular session with Mayor Jim McBee presiding. Roll call found the following Cquncilmembers present: Hadley, Hamer, Mills, Snook and Tally. Absent being Malot. Also present were City Atty. DuBay, City Engr. Westwood and City staff members Hutton, Tate and Zanders, Police Chief Sanders and numerous interested citizens. Mayor McBee announced that three separate public hearings are scheduled on Annexations and hereby declared the hearings as open to the public for dis- cussion: 1. Dobrot Way Annexation. Atty. DuBay was asked to read the proposed ordinance with its description. The document was read. With no questions raised from the floor, the Mayor called for any comment from Councilmembers. Council- man Tally asked "Is the City accepting the roadway as an umimproved street with lower standards as in the past? and "Who has ownership of the roadway at this time? Engineer Westwood advised that Mr. and Mrs. Dobrot had only given an easement to the residents of the area, however Dobrot Way is still under a tax lot of the Dobrot"s. Discussion held. Mr. Norman Bruce advised that approxi- mately 35' has been recorded as a road easement. After a lengthy discussion, it was suggested by the Mayor and Council that the issue of annexing the proper- ty be continued until a dedication of the roadway has been settled, and is removed from the one-party ownership. Atty. DuBay advised that the road at present is a private drive and should be made public before annexing the property. Mayor McBee instructed Hr. Hutton, Atty. DuBay and the Street Com- mittee attempt to clear up the deficiency at an early time. The issue was declared tabled for further study. 2. Church of Christ property Annexation. This property, adjacent to Dobrot Way, was continued inasmuch that it now becomes disqualified fr annexa- tion by not being contiguous, due to the Dobrot Way parcel not being accepted. This anticipated annexation was continued awaiting the outcome of Annexation #1. 3. Public Hearing #3 was called by the Mayor an annexation of a parcel known as Horn Creek and petitioner being Robert Russell. Atty. DuBay read the proposed ordinance for annexation and reading in part: "An Ordinance Providing for the Annexation of Contiguous Territory to the City of Central Point". Mayor McBee called for any questions from the floor or from the Council. With none raised, a motion was made by Hadley, seconded by Hamer to adopt the ordin- ance as read. By roll call vote, an all in favor, motion was carried. Ordinance No. 1087 Declared Duly Adopted. (Horn Creek) Mr. Ron Hexman, Freeman Road resident, was recognized by the Chair and informed the Council that he had filed a petition for annexation of 7 parcels of proper- ty with sufficient signers. Discussion held. Mr. Hutton advised that by all indications everything appears to be on a go-ahead basis. Mr. Hutton also advised that several other parcels of land in the vicinity of North Third and Scenic-Tenth Street are in the process of petitioning the City for annex- ation. Discussion held. A motion was made by Mills, seconded by Snook to refer all the proposed annexations to the Planning Commission for their report. With an all in favor, motion was carried. Q/41 I' Mayor McBee read correspondence from Mr. George Harris dba Central Point Auto Wreckers requesting auto license application renewal. The Mayor referred back to a prior meeting when the Council denied the application and setting forth the reason. Several comments were heard as to the appearance of the establish- ment. It was reported that some noted cleanup has been done, however, the un- sightly vehicles and the delapidated fence condition still exists. Councilmember Jack Snook advised that the cleanup appears to be sufficient and that only a certain amount of improvements can be expected from the operatorss of the zoned area. Discussion followed. Motion made by Hamer, seconded by Mills that Mr. Zander advise by letter Mr. Harris that additional improvements are needed and that the City is still holding to its original position. By majority voting yes, Councilman Snook voting "nay", the motion so carried. vat City Administrator Hutton advised that the proposed Pine Streetproject of construction should be considered as a priority study and application should be 4.4 ad made for Federal Funds. The discussion hold referred to street width, tree removal and City cost. It was mentioned that the project would exceed the $40000.00 estimate cost of construction. Mayor McBee instructed the Street Committee to work on a real difficult task along with Bob Hutton and attempt to formulate the application along with other problems of the Pine Street Improve- ment plan. Chairman Orville Hamer contemplated an April 26th evening meeting on the issue. Mr. Del Curry, 103 Corcoran Lane, was recognized by the Mayor. He spoke on the condition of Griffith Creek, stating that the natural stream could be classed /41 as an attractive asset. However, as it appears at the present time, its the filthiest condition he had ever seen. Photos were presented. Mr. Curry further stated that the Malot Construction Co. had caused a fill and had pushed the water stream onto his property and it could become a problem during the high water times. Discussion held. It was the Mayor and Council's opinion that the Administrative Committee, City Atty. , City Admin. Hutton and Public Works Supt. Capps implement a study towards disposing of the problem if at all possible. City Atty. DuBay opened the discussion on Performance Bonds to the City by sub- division developers. Requirements by ordinance were referred to and discussed. It was the opinion of some members of the Council that the Ordinance was not too specific and could be clarified to a better understanding. Both Councilman Tally and City. Atty. DuBay stated that the ordinance is very clear and to the point. Discussion held. Mayor McBee stated that the issue could be talked about for seveaalhours and ordered a study session by the Admin. Committee of the problem on Performance and Security bonds. Atty. DuBay advised that he would have to meet with the Planning Commission to complete the Consent Decree relating to Northwest Printed Circuits. City Engr. Westwood spoke on storm and sanitary sewer systems on the proposed annexation of the Dobrot and Church of Christ properties. Westwood advised of tentative thoughts of having the Dobrot Way sanitary sewer line flow into the Church of Christ development area and then towards the I-5 Freeway and then [41, northerly towards the direction of B.C.V.S.A. trunk line. Discussion held. Mr. Westwood advised the Mayor and Council that he was prepared at this time to present some preliminary engineering of the area of extension of North Tenth Street to Pine Street; mapping to the area was studied of both proposals. The cost of construction was estimated to be at approximately $41,000.00. Discussion held and referred to the Street Committee for their report. b `: Engineer Westwood advised that additional engineering plans are expected (April 25th) on development of Valley Estates Subdivision and in hopes that iil they would meet all the corrections requested. Mr. Westwood further stated that considerable progress has been made in the field of good engineering in the Valley Estates Subdivision. Mayor McBee announced that several ladies of the Central Point Garden Club had taken their time and effort in replacing the planter area of the City Hall building with many flowering plants. The Mayor has extended the City's appreciation with thanks to the ones responsible and wanted Mr. Hutton to directly correspond with them. One bill for payment was presented for approval to Council in the amount of $31,099.60 as a protested warrant of the Construction Fund. Motion was made by Hadley, seconded by Hamer to approve the payment as presented with all in favor, motion carried. Mr. Hutton advised that a Mr. Bob Stewart, Tru-Mix Corp. representative, is requesting permission to cross the City sewer line on a gravel haul with heavy equipment; the area being at or near the City's old sewer pumping plant (Bear Creek). Discussion held on liability and possible line breakage. It was advised that the Administrative Committee, Mr. Hutton and Atty. DuBay meet and study the request further before making any decision. . The Mayor reminded all that a planned meeting is scheduled of merchants and interested residents of Central Point at the Legion Hall on April 30th. The topic being "Downtown Enhancement". The Mayor invited all City government people to attend. iMi There being no further business to come before the Mayor and Council, a motion was made by Hadley, seconded by Mills to adjourn to the next regular meeting or to the call of the Mayor.
