HomeMy WebLinkAboutCM121272 City Hall Council Chambers fl 250 East Pine Street December 12, 1972 The Common Council met in regular session with Mayor Robert Manasco presiding, at 7:30 P.M. Roll call found the following councilmen present: Hamer, Russell, Rowe, Mills and Tally. Absent being Councilman Hadley. Also present were City Administrator Hutton, City Attorney Mansfield, Recorder Zander, Police Chief Sanders, City Engineer Westwood as well as Planning Commission Chairman C. V. Bowers and members McBee and Banks. y..{ The Mayor referred to the Minutes of November 7th; November 28th and December 4th Meetings- for any questions or corrections prior to acceptancy. C Councilman Russell referred to the November 7th Minutes as being in error. c-T-+ He referred to Paragraph 4, page 2 as "all voting in favor of placing the Christmas tree at its traditional location". Correction being "Russell voting no". With no further corrections or questions, motion was made by Russell, seconded by Tally to approve the minutes as corrected of the November 7th meeting, and November 28th and December 4th as received. With an all in favor, motion carried. Mayor Manasco referred to a proposed resolution presented by City Adminis- trator Hutton. Resolution reading in part: "A Resolution of the Common Council of the City of Central Point, Oregon Establishing a Federal Revenue II/ Sharing Trust Fund and Authorizing the Appropriate Bank Account to be Located in Branches of National Banks located in Central Point to Facilitate Required Administration of said Funds". It was agreed to place the Federal Revenue Sharing check of $44,137.00 into time deposit for the remainder of this Budget Year and to be available for the 1973-1974 City Budget. With no further question, motion made by Rowe, seconded by Mills to adopt the resolution as read. With all in favor, motion carried. Resolution # 170 Declared Duly Adopted. (Revenue Sharing Funds) Mayor Manasco referred to the second proposed Resolution and reading in part: "Resolution of the City of Central Point Appointing the Public Employees Retirement System of the State of Oregon (PERS)". The program for the City Employees Retirement Benefit to be effective January 1, 1973 and approving credit for prior service to the date of employment. After some discussion, motion made by Russell, seconded by Tally to adopt the proposed resolution as read. With an all in favor, motion was carried. Resolution #171 Declared Duly Adopted. (PERS Retirement) Mayor Manasco referred to Committee Reports and on the Germann appeal of the decision from the Planning Commission (sewer line use- offsite). Council- man Rowe' s report to the Council was of the Administrative Committee's findings; to refer it back to the Planning Commission for their reconsidera- tion. Councilman Rowe advised all that the prior decision of the Planning Commission should be overruled due to subsequent and additional information relating to the issue that is available at this time. Discussion held. Motion made by Mills, seconded by Hamer to accept Councilman Rowe's suggest- tion in over-ruling the Planning Commission decision and referring it back to the Planning Commission for their further study and consideration. With an all in favor, motion carried. The Mayor referred to oral and written communications and City Engineer C.P. Westwood was recognized by the chair. Mr. Westwood referred to the long-awaited Water Study Report that the Council ordered some time ago, and that this was now available. The Mayor and Council were pre- sented with reports, and following the presentation of these reports (refer to Water Study Report/City Engineer), Mr. Westwood advised that the most feasible source would be "well fields" located in the Gibbon Road area (approx. 400 acres). Discussion held. Mayor Manasco advised the Councilmen should study the report further; before any comments or suggestions are presented. Mayor Manasco inquired of Council for any further reports or communica- tion to be brought up at this time. With none noted he then asked of Council their feelings on the merits and value of a tape recording of all City Council meetings and Planning Commission meetings in the future. The individual opinion of all Councilmen favored the tape recorder usage used during all meetings, in addition to the Minutes being taken by hand by the Recorder. It was also stressed that the tape cassettes be filed as permanent records. The Mayor, at this time proposed that a resolution be prepared by Attorney Mansfield implementing tapes as official records of the City of Central Point. With no further questions, motion was made by Hamer, seconded by Mills that City Attorney Mansfield prepare the proper legislation for the use and retention of tape recordings. With an all in favor, motion carried. Chief Sanders reported that local Police Departments and Law Enforcement Agencies are implementing a joint Investigation Team with financial assist- ance from the State in funding of approximately $19,500.00 for this project. The "abandoned vehicle" problem was discussed next, as well as the last ordinance enacted, as not having any provisions for "penalties". Chief Sanders advised that the Court had dismissed several cases due to the un- enforceable ordinance that the complaints were written on. The Mayor and Council directed that Attorney Mansfield meet with City Administrator Hutton, Municipal Court Judge Chaney and the Police Department to study the problem as reported. Attorney Mansfield advised that the information will be ready at the next meeting. Mayor Manasco, referring to "Bills to be paid" next on the Agenda; Council- man Russell referred to the membership dues of the "American Water Works Association" for $75.00 and what benefits the City was gaining from this. Both Hutton and Westwood stated that no benefits 11111111.was gained other than,monthly publications to the City. Mr. Westwood advised that his firm is holding membership with the A.W.W.A. and sees little need for the City taking the membership also. With no further questions or discussion, a motionwas made by Russell, seconded by Tally to pay the bills as presented with the exception of the American Water Works Assn. ($75.00) statement. With an all in favor, motion carried. I$a Mayor Manasco referred to the next agenda item of closing City Hall and Public Works operations at 4:00 P.M. December 22, 1972 for the employees Christmas Party. Discussion and explanation held. Motion made by Russell, seconded by Hamer, granting permission to close the one hour early on December 22, 1972 for the requested reason. With an all in favor, motion carried. The next Council Meeting of December 26th was the business next before the Chair. After discussion, it was the feeling of all present that because of the holidays coming, the meeting would not be attended by a quorum membership. It was decided by all to cancel the December 26th Meeting. With no further business to be brought before the Mayor and Council, a lf;, motion was made by Tally, seconded by Mills to adjourn this meeting to the January 9, 1973 regular meeting date or to the call of the Mayor.
