HomeMy WebLinkAboutCM112872 City Hall Council Chambers 250 East Pine Street November 28, 1972 The common council met in regular session at 7:30 P.M. with Mayor Robert Manasco presiding. Roll call found the following councilmen present: Hamer, Mills, Russell, Rowe and Tally. Absent being Daniel Hadley. Also present were City Attorney Mansfield, City Administrator Hutton, Recorder Zander, Bldg. Inspector Chastain, Public Works Supt. Capps, Police Chief Sanders, several members of the City Planning Commission and many interested citizens were in attendance. • 1.0 Mayor Manasco referred to the scheduled public hearing on annexation of d approximately 15 acres in the general location of Hopkins and Bursell Roads owned by Dr. Paul and Mrs. Eleanora Rutter. At this time, Atty. Mansfield' advised that due to certain required changes within the first presented ordi- nance and also some correction within the legal description, he was not ready for the public hearing. Mansfield then presented the proposed ordinance and reading in part: "An Ordinance Granting the Consent of the City of Central Point to the Annexation as R-3 Residential Zone of Certain Real Property Des- cribed Therein, and Setting a Time and Place for a Public Hearing". By no questions, motion was made by Tally, seconded by Russell to adopt the Ordinance as read. With an all in favor, motion carried. Ordinance #1078 Declared Duly Adopted. (Ordinance #1078 replaces #1076 due to attorney error.)(Rutter Annexation) Mayor Manasco referred to the Agenda item #2, request from Western Consolidated Development Corporation that Mazama Village Subdivision be accepted. Mr. Hutton advised that his report (letter) to the Council details the information as to any and all corrections and that the General Contractor would be complete in the Subdivision by November 30th and recommends the acceptance at this time. City Engineer C.P. Westwood spoke of the minor items that needed the attention of the Contractor and the requirements would be completed within the next few days, and recommends the acceptance. The Mayor called upon Vern Capps, Public Works, as to any comments. Mr. Capps advised that the stubbed-in water lines are too high for meter connects and also, some in- dication of settling of earth over undergound lines under curbs and side- walks within the Subdivision. Both Mr. Hutton and Mr. Westnod had no information regarding Mr. Capps report but would check into the situation at the earliest time. Councilman Tally wanted to know if WCDC had completed their agreement on the North Third Street Improvement project as to curbs, gutters and paving. Mr. Westwood advised that they had according to the approved plans. It was mentioned that additional construction on North Third was agreed to by WCDC at a Planning Commission meeting by Mr. Don Milers and was never done. Mr. Hutton advised that the City, by' its agreement and plan approval of Mazama Village Subdivision, could ask for nothing other than what plans and specs. call for. A heated discussion followed. Mr. Westwood, City Engineer, assured the Council that the General Contractor would be respon- sible for any difficiencies for a period of one (1) year following the acceptance of the Subdivision. The Mayor called upon the Councilmen's opinion regarding the development and completion of the Subdivision. Councilman: Hamer, "believed that the Agreement was upheld"; Mills, stated that most of the dealings were held prior to his seat of office; Russell, "would go along with the Engineer's report"; Rowe, "Developer did not live up to his promise and agreement of the North Third Street construction as agreed at a previous Planning Commission Meeting; Tally, "agreed with Councilman Rowe". Mayor advised that his opinion follows Councilman Rowe's. , that at a Planning Commiss- ion Meeting WCDC had given the City assurance that additional work would be done on North Third Street to meet City requirements. Mayor Manasco advised that this is the City's last stand in dealing with the Subdivider and the Council must take a broad look at everything before making their decision. Further discussion held. Motion made by Councilman Tally to deny the acceptance of Mazama Village at this meeting and to continue so until a complete study of all past meeting Minutes of the Planning Commission be secured, that all corrections of inferior work is completed, that a work-session be held with the City Engineer, City Administrator, Public Works Director and City Attorney at some early date. The motion was seconded by Councilman Rowe. Roll call vote: Hamer, no; Mills, no; Russell, yes; Rowe, yes; and Tally, yes. By the affirmative- motion carried. The Mayor and Council agreed that the work session meeting be held December 4th at 7:30 P.M. at the City Hall Building. Correspondence was read by the Mayor from Atty. Frank Van Dyke of request for appeal on the Planning Commission decision on Malabar Estates Sub- division. It was agreed by the Mayor and Council that the request of the request of the 90-day continuation on this matter by granted. The Mayor called for any business from the floor and Rev. Paul Evans was recognized. Rev. Evans advised that he was speaking for the Campfire Girls group regarding the annual Christmas Tree placement. He further stated that approximately 500 signatures in form of a petition was in hand to reconsider the location of the tree from the proposed Second and Pine Streets and brought before this Council for their reconsideration. Rev. Evans presented aletter of consent from the management of the First National Bank (between 3rd and 4th Streets on Pine) that space would be granted on their parking lot for the tree. Discussion held. The Mayor called for the Council's decision after hearing the report of many inter- ested citizens. Motion made by Tally, seconded by Russell to relocate the tree to the parking lot of the First National Bank as recommended. With an all in favor, motion carried. Letter was read by the Mayor from Willie Germann, developer of Pine Crest Subdivision asking for a reconsideration of cost-sharing of sewer line use by other developers. Discussion held. It was agreed that the Administra- tive Committee meet with the Germann's December 4th at 6:00 P.M. as a further study period before making any decision. In discussion of mutual interest items, Mayor Manasco referred to his memorandum covering information from the meeting of Governor McCall's Fifth Annual Conservation Congress held in Portland. The Mayor stated H, 11 that his participation on the panel was very interesting and the information resulting from this meeting is available to any interested persons, and requested that copies be made available for the governmental bodies. City Council and Planning Commission members. Councilman Tally asked the City Engineer it if were possible for Central Point to adopt uniform street construction specifications. Mr. Westwood advised that he had just completed similar specs. for another town and that the cost was in the area of $100.00. Discussion held. It was the Council's suggestion that Mr. Westwood proceed with this request for Central Point street construction specifications. p.0 With no further business to be brought before the Council, a motion was lr made by Hamer, seconded by Mills to adjourn this meeting to December 4th C at 7:30 P.M.
