HomeMy WebLinkAboutOrdinance 887~ ~~ I __--~~~' ORDINANCE N0. ~~ ~~~ AN ORDINANCE, RELATING TO INITIATIVE AND REEL;RINDUM POWERS RESERVED TO THE VOTERS OF TIIE CITY OF CENTRAL POINT AND TO TI-IE POWER OF THE CITY COUNCIL TO REFER LEGISLATIVE ME1~-E~ SURES TO THE VOTERS OF' TIIE CITE' OF CENTP.AL POINT, AND ~ ~~ ~ _ _ _ AMENDING ORDINANCE NO. 597. -. THE PEOPLE OF TIIE CITY OF CENTRAL POINT DC ORDi'1IN AS FOLLOWS: SECTION L Section 8 of Ordinance No. 597 is amended to read as f ollows: "Section 8. An amendment to the Charter of the City of Central Point, a new charter, or a ]_egislative measure may be proposed and submitted to the legal voters triercof by resolution or ordinance of the council without an initiative petition. Said resolution or ordinance, as the case may be, shall be filed with the Recorder or submission not later than 15 days before tine election at which it is to be voted upon, and no charter amendment, charter, or legislative measure shall be effective until it is appro~~-ed b~,~ a majority of_ the +- , _ r votes cast tilcreon b1; the legal_ vo~e.r~ of_ said City. SECTION 2. Section 9 of Ordinance No. 597 i_s amended to read as follows: "Secti.oi~. 9. Where an amendment to the charter_ of the City of Central Point, or a new charter, o.r_ a legi_s]_ative measure may be proposed and submitted to the legal voters thereof_ by resolution or ordinance of the counci]_ without an initiative petition, the said r_cso]_ution or ordinance shall therein state the date of the regular_ municipal election o.r_ tl~c date of the special election at which said charter_ amendment, new charter, or leq_islative measure will be subn-~itted to be voted on and shall call and make provision for_ such electi_on." SECTION 3. Section 10 of Orc]i_nance No. 597 is amended to read as follows: "Section 10. When any measure for_ Initi.ati_vc or Referendum legislation :;hall_ be filed by the Pccorder_ af_tcr the number and genuineness ~f_ si_clnatures thereto, as provided b<<% Section 6 of this ordinance have been asce.r_tained, or when ,zny .r_csolution or_ ordinance of the Council shall be filed with the Recorder as pro- vided in Section 8 herein, the Recorder shall forthc•~i_th transmit to the attorney of said City a copy of such mcasur_e, who shal]_ within two days provide and return to the Reco.r_der a. Ballot title fo.r such measure. The Ballot title shall be ,~ri_nted with the number of_ the measure on the offi_cia]_ ba11_ot-. In making such Ballot title said attorney s11a]_1 to the best of 11is ~~bility give a true and impartial st~~temcnt_ of_ the r,u.r_r-~osc of the measure and in such ]_anguage that the I3a]_lot title, shal_]_ not be an argument for_, or liable to create prejudice against such measure. Any Ordinance No. _~~~__ - ] person who is dissatisfied with the Ballot title provided by the said attorney for any such measure may appeal to the Council asking a different title and giving the reasons there- for, and stating why the title prepared by the said. attorney is improper and the Council shall by resolution approve the Ballot title prepared by said attorney, or shall by resolution prescribe another Ballot title therefor, and the Ballot title so approved or so prescribed by the Council shall be the title placed upon the ballot. Such Ba.l__loL title sha]_]_ cons_i_st of a caption not exceeding six words i_n length by whi_rh the mea- sure is commonly referred to or spoken of, fo]_lowed by an abbreviated statement not exceeding 100 words in length of the chief purpose of the measure, and shall not resemble in- sofar as possible any other ballots title filed f_or any measure. ~he Recorder of the City of Central Point or the County Clerk, as the case may be, sha11 number such measure and Ballot title in the most convenient and consecutive manner. The first mea- sure shall be numbered 51 in numerals. The succeeding measures shall be numbered consecutively 52, 53, 54, etc., at each election. It shall be the duty of the Recorder, or County Clerk, as the case may be, to print said Ballot titles and numbers upon the official ballot. Measures referred to the voters by petition shall be designated Referendum ordered. by petition of the people". Measures proposed by the initiative petition shall be designated "Proposed by initiative petition". Char- ter amendments or a new charter submitted by the Council with- out initiative petition shall be designated "Charter amendments submitted to the voters by the Council". Ordinance measures submitted by the Council without initiative petition shall be designated "Submitted to the voters by the Council". PROVIDED, HOWEVER, that when charter amendments, a new charter or ordinance measures are to be submitted to the voters by resolution or ordinance of the Council as in this ordinance provided, the Council may in said resolution or ordinance, as the case may be, provide for a Ballot title f_or the measure so to be submitted, and in the event of such provision being made by the Council, the hereinabove provision of this section rela- tive to the filing of the measure with the City I~ttorney, the p.reparati_on by said attor_ncy of a ballot ti_t]_e therefor, and the appeal to the Council from the Ballot title so prepared shall not= apply. SECTION 4. Section 11 of Ordinance No. 597 is amended to read as follows: "Section ]_l. The common council of the City of Central Point may, by ordinance or resolution, cal_1 a special election to vote upon municipa_1 measures, amendments to the city charter or a new cha.rtcr. G~7hen such a special election is called, either on petition for proposed ordinances or charter amendments by the initiative, or for submitting ordinances by r_efercndum, or on charter amendments or a new charter or ordinance measure pro- posed by resolution or ordinance of the Council, the Council Ordinance No. ~'~ - 2 shall, not less than 10 days prior t.o such election, by resolution or o.rd.inance, order such special election and shall specify and set forth in such ordinance or resolution the elate of such special election, the time and place of holding such election, a full and correct copy of the title and text of each measure to be so submitted with the numbers and form on which the ballot title will be printed on the official ballot, and shall also appoint in such resolution or ordinance judges and clerks of election. Provided, how- ever, if any special election be called and held at the same time that any state or county ger_eral, special or primary nominating election i_s held in said City, then and in that event the common council may designate the same polling places f.or each precinct, and the same persons as election officers for each precinct as those selected foi: such state or county election.
