HomeMy WebLinkAboutOrdinance 1898ORDINANCE No. \ AN ORDINANCE AMENDING CENTRAL POINT MUNICIPAL CODE CHAPTER 12.12 PERTAINING TO EXCAVATION PERMITS IN CITY STREETS THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON, DO ORDAIN AS FOLLOWS: Section 1. Chapter 12.12 of Title 12 of the Central Point Municipal Code is hereby amended to read as follows: 12.12.010 Permit —Application No person, firm, or corporation shall open a street surface, dig within the feadway right of way (R. O. W.) of a street or otherwise substantially alter a public road or street surface without first obtaining a R. 0. W. permit from the City Administrator. Application and R. 0. W. permit forms shall be provided by the City Administrator in a feFM format designed to obtain and present the information deemed by the City Administrator to be reasonably necessary to carry out the purpose of this chapter. 12.12.020 Permit — Granting The City Administrator is authorized and directed to grant a R. 0. W. permit to do those things set out in Section 12.12.010 where it appears to the satisfaction of the City Administrator that reasonable requirements of public safety will be complied with and where it appears to the satisfaction of the City Administrator that, upon the completion of the construction by the applicant, the street surface and/or R. 0. W. strip located behind the curb will be replaced in substantially its original form. Notwithstanding the forgoing provisions, a R. 0. W. permit shall not be granted in cases in which toe a street surface sought to be exravated has been newly paved or overlaid within twe five years of the date of the application unless the City Administrator determines that an emergency, requiring such excavation, exists endangeFiAg the health, 12.12.030 Permit — Exemptions During the last three years of the five-year street cut moratorium described in Section 12.12.020, an applicant may be granted a R. 0. W. permit provided the applicant pays a street maintenance fee in the amount of $500 plus $25 per square foot of area excavated. A R. O. W. permit shall not be required for the following: • Regular lawn or landscape maintenance. • Any excavation outside the traveled way that does not require an excavation of more than twelve inches below the surface of the ground. • Any excavation on private property. The City Administrator may designate other managers within the City to act in his/her capacity in maters related to this ordinance.
