AN ORDINANCE PERTAINING TO ANIMAL CONTROL
THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON, DO ORDAIN
AS FOLLOWS:
Section 1. The existing Title 6 of the Central Point
Municipal Code is hereby repealed in its entirety.
Section 2. There is hereby added to the Central Point
Municipal Code a new Title 6, entitled "Animal Control", to read
as follows.

Chapter 6.01
DEFINITIONS
Sections:
6.01.010 Definitions.
6.01.010 Definitions. For purposes of this Title, the
following definitions apply:
"Animal" means any mammal, reptile, amphibian, insect or bird.
"Animal at large" means any animal, excluding cats, off the
premises of its owner and not under complete physical control of
its owner or other person.
"Wild or dangerous animal" means any animal which, because of its
size, vicious nature, poisonous bite or sting, or other
characteristics, would constitute a danger to human life or

property if not kept or maintained under the immediate control of
the owner, which behaves in such a manner that the owner knows or
should reasonably know that the animal has a predisposition to
attack or bite persons or other animals without provocation.
"Owner" means any person having a property right in the animal or
who harbors the animal or who has it in his or her care, custody,
or control or knowingly permits the animal to remain on or about
his or her premises.
Chapter 6.04
ANIMALS ALLOWED
Sections:
6.04.010 Animals Allowed. Animals are allowed within the
city limits, except those prohibited in section 6.06.010, only as
they can be cared for, provided with adequate food, water,
shelter, restraint, exercise, attention, veterinary care and
affection. Care shall include control of annoyances such as noise
and odors and insuring safety of the general public.

PROHIBITED ANIMALS
Sections:
6.06.010 Prohibited Animals.
6.06.030 Exemptions.
6.06.010 Prohibited Animals. No horse, mule, donkey, pony,
cow, pig, goat, sheep, llama, rooster, or animal raised for
commercial purposes shall be kept within the city limits.
6.06.030 Exemptions. A. Notwithstanding any restrictions
or prohibitions of this Chapter, animals of any kind and any
number may be kept by a school, museum or zoo for educational
purposes; or the exhibition of amusement purposes, temporarily,
by a circus, carnival, or other exhibition licensed in accordance
with the applicable city ordinance. All rules as to sanitation
and humane treatment contained in this Title shall govern the
keeping of the animals and maintenance of the premises or
buildings where such animals are kept.
B. Police service dogs, while in the exercise of their law

enforcement duties, are exempt from any restrictions or
prohibitions of this ordinance.
C. Any prohibited animal in the possession of an owner or
custodian at the time the owner or custodian's real property is
annexed into the city limits of Central Point may be kept as a
non -conforming use provided the owner or custodian registers the
animal(s) with the Code Enforcement Officer. The animal(s) may
be kept until such time as the owner chooses to remove them from
the property. No animal so described may then be replaced by
another.animal.

ANIMAL CONTROL

6.08.010 Animal Control.
6.08.030 Impoundment.
6.08.010 Animal Control. A. The owner or custodian of a
dog shall keep the dog on a leash and under the owner or
custodian's direct control when the dog is not on the private
property of the owner or custodian. Except in areas designated
as public property off -leash areas, no owner shall permit a dog
to be at large within the City.
B. All dogs kept within the City shall be licensed
according to the laws of the State of Oregon.
C. A police officer, code enforcement officer or animal
control officer may impound a dog found to be loose or running at
large.
D. The owner or custodian of any animal shall not:
1. Permit or allow an animal to run or be at large.
2. Permit an animal to trespass upon property of
another.
3. Keep a wild or dangerous animal.
4. Permit any animal to cause annoyance, alarm or noise
disturbance at any time of the day or night, by repeated barking,
whining, screeching, howling, braying, or other like sounds which
may be heard beyond the boundary of the owner's property.
5. Leave an animal unattended for more than 24
consecutive hours without adequate care.
6. Deprive an animal of proper facilities or care,
including but not limited to food, potable water, shade or
shelter.
7. Physically mistreat any animal either by deliberate
abuse or failure to furnish adequate care, including medical
attention.

8. Allow any stable or place where any animal is or may
be kept to become unclean or odiferous.
9. Confine an animal within or on a motor vehicle at
any location under such conditions as may endanger the health or
well-being of the animal.
10. Allow an animal to deposit its solid wastes on any
private property, or public area, including but not limited to
streets, sidewalks, parking strips, and parks, unless such wastes
are removed immediately. This section shall not apply to a
sightless person while walking his/her guide dog.
11. Allow the carcass of an animal to remain on public
property or exposed on private property for a period of time
longer than is reasonable and necessary to remove and properly
dispose of such carcass.
6.08.030 Impoundment. Any animal which is the subject of a
violation of this Chapter may be impounded by any City employee,
law enforcement officer, code enforcement officer, or county dog
control officer. The procedures established by the City Police
Department shall control the release or disposal of animals so
impounded.
Chapter 6.10
WILD OR DANGEROUS ANIMALS

6.10.010 Wild or Dangerous Animals Prohibited.
6.10.030 Exemptions.

A. Except as provided in this Chapter, no person shall keep
or maintain any wild or dangerous animal within the City.
B. The keeping or maintenance of any wild or dangerous
animal is declared to be a public nuisance and may be abated in
conformity with the provisions of this Title and the provisions
of Chapter 8.04 pertaining to nuisances.
6.10._030 Exemptions. A. The prohibition set forth above
shall not apply to the keeping of wild or dangerous animals in
the following cases:
1. The keeping of such animals in zoos, bona fide
educational or medical institutions, museums or any other place
where they are kept as .live specimens for the public to view or
for the purposes of instruction or study.
2. The keeping of such animals for exhibition to the

public of such animals by a circus, carnival or other exhibit or
show.
3. The keeping of such animals in a bona fide, licensed
veterinary hospital for treatment.
Chapter 6.12
PENALTIES

6.12.010 Nuisance.
6.12.030 Penalties.
6.12.010 Nuisance. All violations of this Title 6 are
hereby declared to be nuisances and may be abated pursuant to
Central Point Municipal Code Chapter 8.04 pertaining to
nuisances.
6.12.030 Penalties. In addition to treatment as a
nuisance,
punishment
continues
all violations of this Title 6 are subject to
under the general penalty, and each day a violation
shall constitute a separate violation.
Section 3. The provisions of this ordinance establishing a
new Title 6 are severable. In the event that any part of this
new Title 6 is deemed to be invalid, such invalidity shall not
effect the validity of the remaining provisions.
