Second Reading -Ordinance No. 1951, An Ordinance Amending Central Point Municipal Code Chapter 2.20 Implementing Provisions for Conducting City Elections by Certifying Election Procedures and Adding Procedures to Conform to State Law and New City Charter CAP060911 2 To Agenda City of Certtrnl Poirtt City Coun~~il Minutes May 26, 2011 Pnge 2 City Attorney Paul Nolte stated that on March 23, 2011, the moved to second reading an ordinance updating the Municipal Code regarding election procedures. At that time it was suggested that 2.20.060(8) should be clarified to allow electors to sign petitions for each position to be placed on the ballot. That language has been included in the ordinance for this reading. Carol Fischer made a motion to approve Ordinance No. 1951, An Ordinance Amending Central Point Municipal Code Chapter 2.20 Implementing Provisions for Conducting City Elections by Certifying Election Procedures and Adding Procedures to Conform to State Law and New City Charter. Kay Harrison seconded. Roll call: Allen Broderick, yes, Bruce Dingier, yes; Kelly Geiger, yes; Carol Fischer, yes; Kay Harrison, yes; and Ellie George, yes. Motion approved. B. Resolution No. _XXXXX_, A Resolution to Increase the Storm Utility Fee Parks and Public Works Director Matt Samitore stated that in 2010 the Council adopted a rate methodology for Storm Utility Fees. This methodology stated that the fee may increase based upon inflation and actual construction prices. The Council also put in a clause that the fee could not increase by more than fifty cents in any given year. The current storm utility fee is $6.50 per equivalent service unit, which is a standard Single Family Home. The recommended increase is twenty five cents as recommended by the Construction Cost Index for 2011. This is the only source of funding for this utility which includes storm sewers, manholes, curb inlets, culverts and bridges. The money from this increase would pay for improvements to the system along Hopkins Road and the area behind Rays Food Place that continues to back up during heavy storms. There was discussion that these were not emergency items and could wait until the next budget year if not funded. Council is in favor of waiting on increases if there are no emergency issues that need to be addressed. Item died due to lack of a motion. C. Resolutions Assessing Various Property Regarding Weed Abatements Finance Director Bev Adams stated that each year there are unmaintained properties identified as hazard to the community. The property owners are notified and given a 30 day period to comply. The resolutions below are provided to place liens upon the properties so that the City may be reimbursed in the future. 1. Resolution No. _XXX_, Assessing Costs for Weed Abatement on 372W12B TL 209 - 440 Federal Way, Central Point, Oregon City Manager Phil Messina stated that the recommended resolutions for Federal Way are contested by the property owner. On April 18, 2011, he received a letter disputing the charges and requesting an appeal to the City Council. CAP060911 5 To Agenda City of Certtrnl Poirtt City Coun~~il Minutes May 26, 2011 Pnge 5 Notices were sent and return receipts were signed by a representative of ACG Properties indicating they were aware of the violation. He explained the process the city takes to make sure the property is in violation and in most cases a contracted company is sent to remove the violation if the deadline is not met. The weeds were cut on September 17, 2010, by the City, after the Code Enforcement Officer determined the properties were still in violation. C. A. Galpin, Representative for ACG Properties LLC Mr. Galpin stated that he hired a contractor to cut the weeds on property along Federal Way. Due to the weather they could not cut the weeds until August. The City cut the weeds 30 days later. He does not feel that he should be responsible for this fine because he did comply with the abatement; the property is not irrigated so it should not have grown enough to be a fire hazard in September when the City cut it. There was discussion that photos were not taken at the time the City mowed the property and some concern that it could have been mowed prior to the September date. Parks and Public Works Director Matt Samitore suggested that the Council grant the appeal. We do not have photos of before and after and cannot at this time be sure the property was indeed in violation. Public Works can absorb the cost of the contractor in their budget. Staff is working on a new ordinance to improve the process for abatement issues. Kay Harrison made a motion to Grant the Appeal of ACG Properties LLC and waive the fees associated with the weed abatements for properties located at 37 2W 12B Tax Lot Tax Lots 200, 206, 207, 208, and 209. Dated: Mayor Hank Williams ATTEST: City Recorder CAP060911 8 To Agenda Ordinance: Amending CPMC 8.08 Regarding Weed Abatement Procedures CAP060911 9 To Agenda Parks & Public Work Department CENTRAL POINT STAFF REPORT DATE: JUNE 2, 2011 TO: HONORABLE MAYOR AND CITY COUNCIL FROM: MATT SAMITORE, DIRECTOR SUBJECT: WEED ABATMENT PROCESS Matt Samitore, Director SUMMARY:. Staff and legal counsel have been in the process of updating our weed abatement ordinance to simplify and streamline the process. At the May 26, 2011 City Council meeting the council heard several resolutions about putting liens on property for weed abatements and also heard an appeal of one in which there wasn't sufficient documentation to make a decision on the abatement. The hearing exemplified the process that is currently in place as it takes months to process, up to a year in some circumstances, clearly demonstrating the flaws in the current process. The revised ordinance puts in place a "fix it ticket" process. A resident would receive a letter informing them that if they do not abate their weeds within 15 days they may get a corresponding charge. They can either pay the fee or it will become a lien. If there are circumstances that don't allow for them to fix the abatement within the 15 days time then they can appeal for hardship to the City Manager who may grant an extension. Staff has also put together a set of internal procedures to handle the abatements. On day 16 a staff person will visit the site and see if the abatement has been completed and talk to the resident if they are there. If the abatement is complete then it will be reported and the fix it ticket will be waived. If it has not the staff person will work with either city crews or a private contractor to perform the work on the 17t" or 18t" day from the date of the original letter. Before any work is complete pictures of the site will be taken and then be taken again after the work is complete to be filed with the abatement paperwork. Once the work is complete the resident will receive a bill for the services rendered and they have 30 days to pay the bill or it will become a lien on the property. All appeals will be heard by the City Manager and the City Council will no longer be involved in the process. Staff is asking that this ordinance be put in place after one reading because we would like to use it for this current season. RECOMMENDATION: Approve ordinance revising the weed abatement process. 140 S. Third Street =„ Central Point, OR 97502 •541.664.3321 Fax 541.664.6384 CAP060911 10 To Agenda ORDINANCE NO. Public Works and Finance Staff would like to implement a separate fee resolution for the weed abatement process. In the past it has become an issue that the current fee schedule is not effective and a lot of property owners are choosing for the City to do the work or hire a contractor because the costs are relatively inexpensive. The proposed fee schedule would be 0.00 to 0.50 Acres = $500.00 0.51 to 1.00 Acres = $1, 000.00 1.01 to 2.00 Acres = $2,000.00 Above 2.01 Acres =Cost of contractor plus $2,000.00 RECOMMENDATION: Approve the resolution adopting the Weed Abatement Fee Schedule. 140 S. BACKGROUND: Matt Samitore, Director Jennifer Boardman, Manager. The Central Point Arts Commission met on May 31, 2011 and discussed the following topics: 1. S'rhokz~~ships Update -Scholarships were awarded to three students at Crater High School- 2. Wall Doffs Update -Arts Commissioner Charlie Brotherton visited with Charlie Slaughter at his studio about the upcoming Walldogs event. Charlie Slaughter stated. that due to the economy he has only been able to secure five artists. Charlie along with Debbie Saxbniy proposed aii alternative that would still provide the art, but would involve a modification of the current plan. The art work would be commissioned by Charlie Slaughter with local artists wishing to assist visiting his studio to do the work. The artwork world be done on panels that world be hung on the buildings, but could be removed and placed in alternate locations if necessary. An unveiling day would be done with celebration and downtown events. The suggested budget for altering this event and commissioning the artist would be right at $15,000. Concerns addressed by the Arts Commission: A. This was supposed to be a community event, brining people to Central Point. Having just an unveiling reduces the chances of having a large crowd. come to the event. B. The cost to hang these panels would be higher due to the need. to have structural assessments done. C. Would the art be the Cities once it the panels are finished. D. When would this event take place? It seems like it is getting too late to have an August event. 3.
