City Council Meeting Minutes
May 26, 2011
I. REGULAR MEETING CALLED TO ORDER
Council President Bruce Dingler called the meeting to order at 7:00 p.m.
II. PLEDGE OF ALLEGIANCE

Council Members: Allen Broderick, Bruce Dingler, Carol
Fischer, Kelly Geiger, Kay Harrison, and Ellie George were
present.
City Manager Phil Messina; City Attorney Paul Nolte;

Tom Humphrey; Parks and Public Works Director Matt
Samitore; Assistant City Manager Chris Clayton; Finance
Director Bev Adams; and City Recorder Deanna Casey
were also present.
IV. SPECIAL PRESENTATION
Police Chief Jon Zeliff presented Thomas Hall and Joshua Abbott to the Council.
These are two new officers for the City of Central Point. He proceeded to provide
background information and swore them into the Central Point Police
Department.

A. Approval of April 28, 2011, City Council Minutes
Kay Harrison made a motion to approve the Consent Agenda as presented.

A. Second Reading -Ordinance No. 1951, An Ordinance Amending
Central Point Municipal Code Chapter 2.20 Implementing Provisions
for Conducting City Elections by Certifying Election Procedures and
Adding Procedures to Conform to State Law and New City Charter

City Attorney Paul Nolte stated that on March 23, 2011, the moved to second
reading an ordinance updating the Municipal Code regarding election
procedures. At that time it was suggested that 2.20.060(8) should be clarified to
allow electors to sign petitions for each position to be placed on the ballot. That
language has been included in the ordinance for this reading.
Carol Fischer made a motion to approve Ordinance No. 1951, An Ordinance
Amending Central Point Municipal Code Chapter 2.20 Implementing
Provisions for Conducting City Elections by Certifying Election Procedures
and Adding Procedures to Conform to State Law and New City Charter. Kay
Harrison seconded. Roll call: Allen Broderick, yes, Bruce Dingier, yes; Kelly
Geiger, yes; Carol Fischer, yes; Kay Harrison, yes; and Ellie George, yes. Motion
approved.
B. Resolution No. _XXXXX_, A Resolution to Increase the Storm Utility
Fee
Parks and Public Works Director Matt Samitore stated that in 2010 the Council
adopted a rate methodology for Storm Utility Fees. This methodology stated that
the fee may increase based upon inflation and actual construction prices. The
Council also put in a clause that the fee could not increase by more than fifty
cents in any given year.
The current storm utility fee is $6.50 per equivalent service unit, which is a
standard Single Family Home. The recommended increase is twenty five cents
as recommended by the Construction Cost Index for 2011. This is the only
source of funding for this utility which includes storm sewers, manholes, curb
inlets, culverts and bridges. The money from this increase would pay for
improvements to the system along Hopkins Road and the area behind Rays
Food Place that continues to back up during heavy storms.
There was discussion that these were not emergency items and could wait until
the next budget year if not funded. Council is in favor of waiting on increases if
there are no emergency issues that need to be addressed.
Item died due to lack of a motion.
C. Resolutions Assessing Various Property Regarding Weed
Abatements
Finance Director Bev Adams stated that each year there are unmaintained
properties identified as hazard to the community. The property owners are
notified and given a 30 day period to comply. The resolutions below are provided
to place liens upon the properties so that the City may be reimbursed in the
future.

Kay Harrison made a motion to approve Resolutions 1285 through 1302
regarding the uncontested resolutions to place liens on specific properties

City Manager Phil Messina stated that the recommended resolutions for Federal
Way are contested by the property owner. On April 18, 2011, he received a letter
disputing the charges and requesting an appeal to the City Council.

Notices were sent and return receipts were signed by a representative of ACG
Properties indicating they were aware of the violation. He explained the process
the city takes to make sure the property is in violation and in most cases a
contracted company is sent to remove the violation if the deadline is not met. The
weeds were cut on September 17, 2010, by the City, after the Code Enforcement
Officer determined the properties were stilt in violation.
C. A. Galpin, Representative for ACG Properties LLC
Mr. Galpin stated that he hired a contractor to cut the weeds on property along
Federal Way. Due to the weather they could not cut the weeds until August. The
City cut the weeds 30 days later. He does not feel that he should be responsible
for this fine because he did comply with the abatement; the property is not
irrigated so it should not have grown enough to be a fire hazard in September
when the City cut it.
There was discussion that photos were not taken at the time the City mowed the
property and some concern that it could have been mowed prior to the
September date.
Parks and Public Works Director Matt Samitore suggested that the Council grant
the appeal. We do not have photos of before and after and cannot at this time be
sure the property was indeed in violation. Public Works can absorb the cost of
the contractor in their budget. Staff is working on a new ordinance to improve the
process for abatement issues.
Kay Harrison made a motion to Grant the Appeal of ACG Properties LLC
and waive the fees associated with the weed abatements for properties
located at 37 2W 12B Tax Lot Tax Lots 200, 206, 207, 208, and 209. Kelly
Geiger seconded. Roll call: Allen Broderick, yes, Bruce Dingler, yes; Kelly
Geiger, yes; Carol Fischer, yes; Kay Harrison, yes; and Ellie George, yes. Motion
approved.
VIII. BUSINESS

IX. MAYOR'S REPORT
Council President Bruce Dingler stated that the Mayor is out of town and does
not have a report at this time.
X. CITY MANAGER'S REPORT
City Manager Phil Messina reported that:
• He attended the graduation at the Police Academy last week.
• He has attended Medford Water Commission meetings.

• On June 10th there will be a celebration at Premier West Bank where
Southern Oregon Historical Society will reveal their first display case
representing items from Central Point's history.
• There will be a Study Session June 20th to discuss amendments to the
Medford Water Commission Agreement.
XI. COUNCIL REPORTS
Council Member Allen Broderick stated that he:
• attended the Parks and Recreation Commission meeting
• he provided a new Welcome message for the video we host on our
website.
• He attended the Study Session regarding the Medford Water
Commission.
Council Member Kelly Geiger reported that:
• He attended the School Board and Budget Committee meetings.
• He attended the Study Session.
• He participated in the East Pine Street improvement meetings.
Council Member Kay Harrison attended the Fair Board, RVACT, RVTD, and
RVSS meetings.
Council Member Bruce Dingier attended the Study Session, the Pine Street
improvement meeting, and the D.A.R.E. Graduation.
Council Member Carol Fischer attended the Medford Water Commission
meetings and the city wide cleanup at the Expo.
Council Member Ellie George attended the Fire District 3 Meeting and the Study
Session.
XII. DEPARTMENT REPORTS
Community Development Director Tom Humphrey reported that:
• he has been working with a group to video Central Point highlights for the
website.
• The Downtown Pine Street kick off meetings were well attended.
• The Jackson County Planning Commission is deliberating the Central
Point RPS area this week.
Finance Director Bev Adams reported that:
• The council will be asked to approve several budget resolutions at the last
meeting in June. We will need a full quorum.
• They have been discussing the battle of the bones event with the updated
finance responsibility.

City Manager Phil Messina introduced Fire Chief Dan Peterson. Chief Peterson
explained some of the future plans for an increase to the Central Point station.
He plans to provide quarterly reports to Council.
Police Chief Jon Zeliff reported that:
• The department has a project book the council is welcome to review. This
book explains the different projects the Police Department is working on
throughout the community.
• With the two new officers department is at full strength.
• The department is busy with preparations for the Bike Rodeo and the
Fourth of July events.
Parks and Public Works Director Matt Samitore reported that staff is currently
working on the Memorial Day event at Don Jones Park and Rodeo activities.
Assistant City Manager Chris Clayton reported that he:
• Attended the MPO meeting where they approved the CMAQ project for
vehicle conversions.
• Will be giving three more Medford Water Commission Presentations over
the next few weeks.

XIV. ADJOURNMENT
Kay Harrison moved to adjourn, Allen Broderick seconded, all said "aye" and the
meeting was adjourned at 8:11 p.m.
