A RESOLUTION CONDITIONALLY APPROVING A CONDITIONAL USE
PERMIT, SITE PLAN APPLICATION AND VARIANCE
FOR AN ASSISTED LIVING FACILITY ON ALDER STREET
{Applicant: Regency Care Centers)
{37 2W 10AA Tax Lots 3400, 3800, 3900, 4000}
Recitals
1. This matter came before the Planning Commission for
hearing on May 3, 1994 an applicant's site plan. conditional use
permit and variance applications for a 60-unit Assisted Living
Facility on Alder Street, between First and Second Streets, in a
C-2 and R-3 district of the City. The Planning Commission
reviewed the applications and the City staff report, and received
comments from all persons wishing to be heard in favor of and
opposed to the applications.
Now, therefore;
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF
CENTRAL POINT, OREGON, A5 FOLLOWS:
Section 1. Criteria A livable to Decision. The following
chapters of the Central Point Municipal Code apply to this
application:
A. Chapter 17.28, R-3, Residential Multiple-Family District
B. Chapter 17.35, C-2, Commercial~Professional District
C. Chapter 17.60, General Regulations
D. Chapter 17.64, Off-Street Parking and Loading
E. Chapter 17.72, Site Plan, Landscaping and Construction
Plan Approval
F. Chapter 17.76, Conditional Use Permits
Section 2. Findin s and Conclusions. The Planning
Commission hereby adopts by reference all findings of fact set
Earth in the City staff report and concludes that, except as
otherwise noted herein, the applications and proposals comply
with the requirements of the following chapters of the Central
Point Municipal Code:
A, Chapter 17.28 relating to uses, lot size, lot coverage,
setback, building height and screening in the R-3 district.
B. Chapter 17.60 relating to paving and landscaping
requirements.
C. Chapter 17.54 relating to off-street parking and loading
facilities.

D. Chapter 1.7.72 relating to site plan requirements.
E. Chapter 1.7.75 relating to the size and shape of the
subject property, accesses to public streets, sack of adverse
effects on abutting properties, and compliazzce with all
applicable health and safety regulations.
The Planning Commission further finds and concludes as
foilows:
F. Applicant is granted a variance to the applicable
parking standards, so that the project is approved with l.8
parking spaces instead of the required 30. In granting this
variance, the Planning Commission adopts the findings submitted
with the variance application.
G. Minor administrative variances are granted for {1.) the
18-inch encroachment into the 20-foot side yard setbacks along
First and Secozxd Streets; and {2) the 4-foot encroachment by the
corbeled turrets on the southeast and southwest corners of the
buiidings izzto the 2t3-foot setback area.
Section 3. Conditional A roval. The within applications
are hereby conditionally approved, 50 long as the following
conditions are met:
Conditions
1.. Aii conditions recommended in the City`s Public Works
Staff Report, a copy of which is attached hereto as Exhibit "A",
and by this reference incorporated herein.
2. The parking area currently positioned on the easterly
property line of the project Must be moved back five feet sa as
to comply with the C--2 zoning standards setback.
3. A loading berth at least 10 by 30 feet in size shall be
added to the site pian, sn as to comply with CPMC
1.7.54.02Q{a){2).
4. The site pian shall be modified so as to provide for a
66--foot wide full parking section in the main parking lot.
5. Applicant shall record an agreement with Sentry Market
giving applicant the right to utilize l.S feet of Sentry's
property so as to meet the 26-foot parking maneuvering area
requirement north of the courtyard.

Factor
TF 3 { T } The developer shall provide for street lights on Alder Street at the distances and
sizes required in the Public Works Standards. The developer shall install all pads
and conduits far street lights as a part of the construction of the development.
The developer shall assume all casts associated with this condition.
TF 3 {2} The developer shall provide the design for placement of traffic control and
delineation improvements based onthe location ofaccesses {loading/unloading}
required as a condition of this development. The developer shall assume all
costs for installation of traffic cantro! and delineation devices as a result of the
traffic control plan far this project.
TF 3 {3} Curb and gutters removed as a result of the construction of this project shall be
replaced. All casts associated with this condition shall be the developer's cost.
TF ~ {4} The developer shaii construct a new sidewalk along all City streets adjacent to
this development according to the Public Works Standards The developer shall
assume a!I costs associated with this condition.
TF 6 (5} The developer shall provide the City with the number and size of water meters
for this development. The City will provide and install the water meters. The
developer shall assume all costs associated with this condition.
TF 6 {6} The developer shall provide a set of drawings for the sanitary sewer system for
review and approval by the City prior to issuance of a building permit.
TF 6 {7} The developer shall provide the City with a complete set of drainage
calculations and construction drawings for the off-site drainage improvements
required to drain tl~e structure and parking areas (storm drain from Oak Street
& 2nd Street intersection to project). Runoff ealeulatians shall be based on the
rainfall intensitylduration curve availablE from the Public «.rorks Department.
TF 6 {8} The developer shall provide the City with a complete set of construction
drawings for the on-site storm drainage system to serve this property. All roof
drains, area drains, crawl spaces, and parking lot drains Shall have positive
drainage away from the structures, and shall connect to a storm drainage
system approved by the Public Warks Department.
TF 3 (g} The developer shaft provide driveway access for this development at locations
and spacing according to requirements set forth in the Public Works Standards.
