Plan PLANNING COMMISSION RESOLUTIDN NO. `31`7 A RESOLU'T'ION GRANTING TENTATIVE PLAN APPROVAL FOR A LAND PARTITION (Applicant: James Newcomb) (37 2W 11DB Tax Lot 1700) ftecita~.s 1. Applicant has submitted an application for tentative plan approval for a land partition on a 1.00-acre parcel, located an Bursell Road, near Pittview, in the City of Central Point, Oregon. 2. On April 4, 1995, the Central Point Planning Commission conducted a duly-noticed public hearing on the application, at which time it reviewed the City staff reports and heard testimony and comments on the application. Now, therefore; BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Approval Criteria. The requirements for approval of land partitions and tentative plans are set forth in CPMC Title 16 and Title 17, relating to informational requirements, zoning, lot dimension, access, and similar requirements. Section 2. Findin s and Conclusions. The Planning Commission finds and determines as follows: A. Tentative Plan Re uirements. The application and tentative plan are in the correct form and contain all of the information required by CPMC Chapter 16.10. B. Area and width of Lot. This partitioning in an R-1-8 zone would create the following parcels: Parcel 1: Approximately 21,500 square feet; Parcel 2: Approximately 21,500 square feet. Parcel 1 meets the minimum area {8,000 square feet) and width (60 feet) requirements for lots contained in CPMC 17.20.050, and such parcel meets the general requirements for lots contained in CPMC 16.24.050. Parcel 2 meets the minimum area (1s,o00 square feet less access) and width requirements for flag lots contained in CPMC 16.36.040. 1 - PLANNING COMMISSION RESOLUTION N0. 3[~ (041095) C. Access to Flag Lat. CPMC 16.36.040 requires an access of at least 20 feet in width, paved with cement oz asphaltic surface, for all flag lets created by partition. The tentative plan submitted herein provides for a 20-foot wide access, to be paved with concrete, which satisfies the City code requirement. Section 3. Conditional A royal. The application for tentative plan for land partition herein is hereby approved, subject to the conditions set forth an Exhibit "A", attached hereto and by reference incorporated herein, imposed under authority of CPMC Chapter 16.36. Planning Commission Chairman 2 _ PLANNING COMMISSION RESOLUTION NO. 31~ (041095) EXHIBIT "A"PUBLIC WORKS CONSTRUCTION CONDITIONS NEWCOMB LAND PARTITION eneraf: o ORS Chapter 468.7A~0 requires that ail developments which will disturb 5 ACRES OR MORE of land adjacent to a stream which discharges to surface waters of the State of Oregon shall as a part of the construction permitting process submit an "Erosion Control Plan." The "Erosion Control Pfan" shall require a PERMIT from DEQ. No construction on any Tentative Plan storm drainage system can occur until authorization to do so has been granted by DEQ. a Developer shad provide ladder rungs approved by the Central Point Pubiic Works Department far each sanitary sewer manhole with a depth greater than 3.0 feet to the flow fine of the manhole. Developer shall pay the cast for the City to install the sadder rungs. o Developer's engineer shall design the water system to provide a minimum flow of 1000 gpm at each fire hydrant. o Developer shall construct al! utilities, streets, and other structures discussed herein, within Rights-of-way awned, or to be owned by the City of Central Point, in accordance with al[ rules, regulations, ordinances, resolutions and other applicable requirements of the City of Central Point for the construction of this development. o This review far the Tentative Plan submitted by the applicant was done so in accordance with all the rules, regulations and ordinances in effect as of the date of this review. Any modifications by Developer of this project after City Planning Commission approval, could require re-submittal of an application, and approval by the City Planning Commission based on the recommendation of staff responsible far this review. o All costs associated with this Development and the conditions placed on this Development shall be the sole responsibility of the applicantlowner. o No construction will begin on this project or any building, until such time as plans and specifications have been reviewed and approved by the Pubiic Works Department and other required divisions of the City and a Construction Permit has been issued for each portion of the project requiring a permit. o The 1=final Pfat of this project shall not be approved by the Planning Commission until all conditions as herein stipulated and approved for this project have been met. o The City shall approve street stationing prior to Developer's engineer designing the improvements for this Tentative Plan. EXH[131T "A" NEWCOMB LAND PARTITION PUBLIC WORKS DEPARTMENT TENTATIVE PLAN CONDITIONS Specific: 1 {a1 The construction of this development shall include the street subgrade, base rock, paving, lighting, traffic control and delineation improvements, storm drain improvements, curb/gutter, safety improvements, ingress/egress improvements, sidewalks, and utility crossings to that portion of Bursell Road adjacent to the partition project. Developer can secure the above future improvements by signing an irrevocable letter of consent to inclusion in a Local improvement District to construct the above street improvement. ~ {b) Developer steal[ be required to construct an additional 9' of road width, curb, gutter and sidewalk from the end of existing sidewalk at the south west property corner of Parcel #1, Lot 1700 to the northwest property corner of parcel #2, in accordance with City Standards and Specifications. 2. Developer shall construct an access to Parcel 1 in accordance with the Public Works Standards and Design Guidelines for flag lot access. Fire access to parcel 1 and required turn grounds shall be located as stipulated by the Public Safety Department. Developer shall be required to grant the City a 5' easement on the Final Plat on either side of any fire hydrants, mains or water meters, located on the property. 3. Developer shall connect the service laterals to the existing water line along Burrell Raad with valuing and backfiow prevention as determined by the Public Works Department. The sizing of the service lateral far Parcels i and 2 shall be determined based on the requirement for the fire protection as is stipulated by the Public Safety Department. 4. The sanitary sewer serving all parcels shall be connected to the existing 42" BCVSA sanitary sewer located in Burrell Road. The service lateral shall be sized in accordance with the Oregon Plumbing Code and Public Works Standards. b. {a) Developer shall construct an adequately sized storm drainage system to provide for runoff onto the subject property and from each lot. As a part of the construction of the improvements far this Tentative Plan, Developer's engineer shall provide a complete set of drainage calculations far sizing the storm drainage system for this development. Developer shall submit this information to the Public Works Department at the time construction drawings for the project are submitted to the Public Works Department for permits for construction of the storm drainage improvements. The engineer shall use the rainfall/intensity curve obtain from the Public Works Department for hydrology calculations. (b) Developer shall be required to construct additiana! ~ $" diameter storm sewer from the end of the existing storm sewer at the southwest property corner of Parcel #1, Lot '! 700 to the northwest property corner of Parcel #2. An inlet with an approved cleanaut grate shall be installed at the exposed end of storm drain. 6. A!I structures shall have roof drains, area drains, and crawl spaces with positive drainage away from the structure and drain lines connected to a curb drain, or an approved storm sewer. Developer shall provide the necessary storm drainage improvements and lot grading to assure that all streets, lots, and all properties will drain properly. Developer shall submit a grading plan with the construction drawings and perform such grading and drainage improvements which satisfies this drainage condition leaving only minor grading required for each lot during house construction. 7. Developer shall install a 22,000 Lumen HPS light an the PP&L power pole located at the North West property corner. Developer shall coordinate the installation with Pacific Power and Light Ca.
