E- f PLANNING COMMISSION RESOLUTION NO. 3~(p A RESOLUTION GRANTING TENTATIVE PLAN APPROVAL FOR A LAND PARTITION (Applicant: Ann McKibben) (37 2W 11AC Tax Lot 11203) Recitals 1. Applicant has submitted an application for tentative plan approval for a land partition on a .37-acre parcel, located in an R-1-8 zone in the City of Central Point, Oregon. 2. On December 19, 1995, the Central Point Planning Commission conducted a duly-noticed public hearing on the application, at which time it reviewed the City staff reports and heard testimony and comments or. the application. Now, therefore; BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. A raval Criteria. The requirements for approval of land partitions and tentative plans are set forth in CPMC Title 16 and Title 17, relating to informational requirements, zoning, lot dimension, access, and similar requirements. Section 2. Findin s and Conclusions. The Planning Commission finds and determines as follows: A. Tentative Plan Re uirements. The application and tentative plan are in the correct form and contain all of the information required by CPMC Chapter 16.10. B. Area and Width of Lot. This partitioning in an R-1--8 zone would create the following parcels: Parcel 1: Approximately 8016 square feet; Parcel 2: Approximately 8016 square feet. Both parcels meet the minimum area (8000 square feet for interior lots and 8000 square feet for corner lots) and width {60 feet for interior lots and 70 feet for corner lots) requirements for lots in the R-1-8 zone as set forth in CPMC 17.20.050, and such parcels meet the general requirements for lots contained in CPMC 16.24.050. ~. _ PLANNING COMMISSION RESOLUTION NO. ~~~ {121895} EXHIBIT "A" PUBLIC WORKS DEPARTMENT TENTATIVE PLAN CONDITIONS McKibben Land Partition A. This review for the Tentative Plan submitted by the applicant was done so in accordance with all the rules, regulations and ordinances in effect as of the date of this review. Any modifications by Developer of this project after City Planning Commission approval, could require resubmittal of an application, and approval by the City Planning Commission based on the recommendation of staff responsible for this review. B. All costs associated with this Development and the conditions placed on this Development shall be the sole responsibility of the applicant/owner. C. No construction will begin on this project ar any building until such time as plans and sped#ications have been reviewed and approved by the Public Works Department and other required divisions of the City and a Construction Permit has been issued far each portion of the project requiring a permit. D. The Final Plat of this Subdivision shall not be approved by the Planning Commission until all conditions as herein stipulated and approved for this project have been met by construction and acceptance thereof ar bonding for construction. E. The developer shall submit an AutoCAD compatible digital drawing of the Final Plat at the time of Final Plat Approval. EXHIBIT "B" Public Works Department Tentative Plan Conditions McKibben Land Partition 1. All structures shall have roof drains, area drains, and crawl spaces with positive drainage away from the structure and drain lines connected to a curb drain, or an approved storm sewer. The developer shall provide the necessary storm drainage improvements and lot grading to assure that all streets, lots, and all properties will drain properly. 2. Parcels 1 and 2 shall include a 10' P.U.E. along the frontage with the exception of the footprint of the existing house. 3. Developer shall coordinate with utility company to relocate existing power service to existing house, so as not to cross adjacent parcel outside of P.U.E. 4. The garage on Parcel 2 shall be removed or relocated prior to signature on the final plat to prevent conflicts with city setback requirements.
