'~ ~1~ A RESOLUTION GRANTING TENTATIVE PLAN APPROVAL FOR A LAND PARTITION (Applicants: Brian and Lori Lowe) (37 2W 10 DC Tam Lot 7.00} Recitals 1. Applicants have submitted an application for tentative plan approval far a land partition on a 1.77-acre parcel, located on the corner of Snowy Butte Lane and Beall Lane in the City of Central Point, Oregon. 2. On April 2, 1996, the Central Point Planning Commission conducted a duly-noticed public hearing on the application, at which time it reviewed the City staff reports and heard testimoxay and comments nn the application. Now, therefore; BE 7:T RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. A roval Criteria. The requirements for approval of land partitions and tentative plans are set forth in CPMC Title 16 and Title 17, relating to informational requirements, zoning, lot dimension, access, and similar requirements. Section 2. Findings,,anc~ Conclusions. The Planning Commission finds and determines as follows: A. Tentative Plan Requirements. The application and tentative plan are in the correct form and contain all of the information required by CPMC Chapter 16.10. B. Area and Width of Lot. This partitioning in an R-1-6 zone would create the following parcels: Parcel 1: Approximately 50,644 square feet; Parcel 2: Approximately 30,495 square feet. Both parcels meet the minimum area (6,000 square feet far interior lots and 7,000 square feet for corner lots) and width (60 feet for interior lots and 70 feet for corner lots) requirements for lots in the R-1--6 zone as set forth in CPMC 17.20.050, and such parcels meet the general requirements for lots contained in CPMC 16.24.050. 1 - PLANNING COMMISSION RESOLUTION NO. 3 Y N (040996} ~x1~1BIT °A" PUBLIC WORKS DI=PARTMENT TENTATIVE FLAN CONDITIONS for LOWS LAND PARTITION GENERAL Note: Same general conditions may not apply to this subdivision a ORS Chapter 468.740 requires that all developments which will disturb 5 ACRES OR MORE of land adjacent to a stream which discharges to surface waters of the State of Oregon shall as a part of the construction permitting process submit an HErosian Control Plan." The "Erosion Control Plan" shall require a PIwRM(T from D1=Q. No construction on any Tentative Plan storm drainage system can occur until authorization to do so has been granted by DEQ. o Developer shall provide and install ladder rungs approved by the Central Point Public Works Department for each sanitary sewer manhole with a depth greater than 3.0 feet to the flow line of the manhole. o Developer`s engineer shall design the water system to provide a minimum flow of 1000 g.p.m. at each fire hydrant. o Developer shalt construct all utilities, streets, and other structures discussed herein, within rights- of-way owned, ar to be owned by the City of Central Point. in accordance with all rules, regulations, ordinances, resolutions and other applicable requirements of the City of Central Point for the construction of this development. o This review for the Tentative Plan submitted by the applicant was done so in accordance with all the rules, regulations and ordinances in effect as of the date of this review. Any modifications by Developer of this project after City Planning Commission approval, could require resubmittal of an application, and approval by the City Planning Commission based on the recommendation of staff responsible for this review. o Alf costs associated with this Development and the conditions placed on this Development shall be the sale responsibility of the applicantlawner. o No construction will begin on this project or any building until such time as plans and specifications have been reviewed and approved by the Public Works Department and other required divisions of the City and a Construction Permit has been issued for each portion of the project requiring a permit. o The Final Plat of this Subdivision shall not be approved by the Planning Commission until ail conditions as herein stipulated and approved for this project have been met by construction and acceptance thereof or bonding far construction. a The City shall approve street stationing prior to Developer`s engineer designing the improvements for this Tentative Pian. SPI=CIFIC ` PUBLIC WORf~S DEPARTI11iENT TENTAT#V~ PLAN CONDITIONS LOWI~ LAND PARTITION 1(a} The construction of this development shall include the street subgrade, base rock, paving, lighting, traffc control and delineation improvements, storm drain improvements, curblgutter, safety improvements, ingress/egress improvements, sidewalks, and utility crossings to that portion of Snowy Butte Road adjacent to T37S 1~2W, 90DC, Tax Lot 900, Parcels 1 and 2 of the partition project. (fal The developer can secure the above future improvements 6y signing an irrevocable letter of consent to inclusion in a Local Improvement District to construct the above street improvement. The Planning Department has the option to require this security for Beall Lane and Snawy Butte Road improvements. 2. Applicant shall construct driveway access to Seafl Lane Parcel 2 in accordance with the Public Works Standards and Design Guidelines and Jackson County Road Department. Fire access to both parcels and required turn arounds may be required and shall be located as stipulated by the Public Safety Department. 3. Applicant shall connect water service laterals to the existing water fine along Beall Lane with valuing and backflow prevention as determined by the Public Works Department. The sizing and spacing of fire hydrants and of service lateral for Parce! 2 shall be determined based on the Oregon Plumbing Cade. Show easement on Final Plat far any water laterals crossing adjacent property parcels. 4. The sanitary sewer serving all parcels shall be connected to the City sanitary sewer located in Snawy Butte 13oad. The service lateral shalt be sized in accordance with the Oregon Plumbing Code. Show easement on f=loaf Plat for any sewer laterals crossing adjacent property parcels. 5. Applicant shall construct an adequately sized storm drainage system to provide for runoff onto the subject property and from each lat. As a part of the construction of the improvements for this Tentative Plan, Applicant`s engineer shall provide a complete set of drainage calculations for sizing the storm drainage system for this development. Applicant shall submit this information to the Public Works Department at the time construction drawings for the project are submitted to the Public Safety Department far permits for construction. The engineer steal! use the rainfall/intensity curve obtained from the Public Works Department for hydrology calculations. fi. A[I structures shall have roof drains, area drains, and crawl spaces with positive drainage away from the structure and drain fines connected to a curb drain, or an approved storm sewer System. Applicant shat! provide the necessary storm drainage improvements and lot grading to assure that off streets, lots, and all properties will drain properly. Applicant shalt submit a grading plan with the construction drawings and perform such grading and drainage 7. Applicant shaft instal! a 22,000 Lumen HPS Light on the existing tallest PP & L Power Pole located near the Southwest property comer of Parce! #2. Applicant shall coordinate the installation with Pacific Power and Light Company. Applicant shall pay any additional costs associated with the installation. The property located at '[ 771 Beall Lane, owned by Paul and Roseann Wagner and further described as T37S f~2W, Section 1ODC, Tax lot 100 is found to be ]ocated adjacent to a wetland identified as PSSC on the Division of State lands (DSLy Wetland Inventory Map. A Wetland Use Notification Porm has been filed with the Division of State Lands. Applicant shall be required to obtain any permits required by DSL prior to beginning of construction or issuance of a building permit.
