This matter came before the Planning Commission far hearing on April 16, 1996, on applicants site plan application for a fast food restaurant and truck fueling facility in a C-4 district of the City. The Planning Commission reviewed the application and the City staff reports, and received comments from all persons wishing to be heard in favor of and opposed to the application. Now, therefore; BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Criteria Applicable tq Dpcis_ion. The following chapters of the Central Point Municipal Code apply to this application: A. Chapter 17.44, C-4 Tourist and Office-Professional District; B. Chapter 17.60, General Regulations; C. Chapter 17.64, Off-Street Parking and Loading; D. Chapter 17.72, Site Plan, Landscaping and Construction Plan Approval. Section 2. Findings and Conclusions. The Planning Commission hereby adopts by reference all findings of fact set forth in the City staff reports, and concludes that, except where addressed in the conditions to approval, the application and proposal compllT with the requirements of the fallowing chapters of the Central Point Municipal Cade: A. Chapter 17.44 relating to uses, lot size, lot coverage, setback, building height and screening in the C-4 district; B. Chapter 17.60 relating to paving and landscaping requirements; C. Planning Commission Chairman 2 - PLANNING COMMISSION RESOLUTION NO. ~~ (042496) EXHIBIT "A" PUBLiC WORKS DEPARTMENT TENTATIVE PLAN CONDITIONS FOR SITE PLAN AND CONDITIONAL USE PERMIT PILOT TRAVEL CENTER GENERAL 1. Construction of this development shall include street, traffic control and delineation, Lighting, water, sanitary sewer, storm drainage, utility, sidewalk, bikeway and ingress and egress improvements. 2. Applicant shall construct a[I utilities, streets, and other facilities within rights-of-ways awned, or to be owned by the City of Central Paint, in accordance with al[ rules, regulations, ordinances, resolutions, standards and other applicable requirements of the City for construction of this development. ;~ 3. The City shall inspect and test all improvements proposed for dedication to the City. The City's inspection shall include all existing and future public infrastructure. 4. Applicant shall bear all costs associated with this development and the conditions placed upon this development. 5. Na construction shall begin on this project until the Public Works Department and other pertinent departments of the City have reviewed and approved the project plans and specifications and have issued appropriate permits. 6. At the cost of the applicant, the City Engineer shat! evaluate the strength of native soils and determine the appropriate street structural section design. 7. Applicant shall submit to Public Works Department, far review and approval, a complete set of construction drawings for all street, sidewalk, driveway, curb and gutter improvements. Vision and sight distance requirements steal[ be detailed on the construction drawings. This shat! be prepared and stamped by a licensed Professional 1ngineer in the State of Oregon. $. Construction drawings for this project snail include a street lighting and traffic control and delineation plan, to be reviewed and approved by the Public Works Department. This shall be prepared and stamped by a licensed Professional Engineer in the State of Oregon. 9. Applicant shah install street lights as required in City of Central Paint Standard Specifications and Uniform Standard Details far Public Works Construction. The maximum spacing of street lights shalt be 200'. Applicant shall install all pads and conduits for street lights as part of the construction of this development, and coordinate with Pacific Power and Light Company, 10. Applicant shall provide to the Public Works Department, for review and approval, sizing, looping and meter requirements, as well as flaw calculations, far water service to this development. This shalt be prepared grad stamped by a licensed Professional Engineer in the State of Oregon. The City shalt install the water meters on site. Pilot Travel Center Conditions -Continued 11. Applicant shai! instal( an Oregon State Health Division approved testable backflow prevention device behind City water meters for any system which connects to the applicant`s irrigation system or any other water system which may be a potential cross connection. Locations, types and sizes of backflow prevention devices shai) be shown on construction drawings. 12. Applicant shall provide to the Public Works and Eire Departments, for review and approval, sizing requirements and flow calculations far fire systems including any mains and hydrants. This shall be prepared and stamped by a licensed Professional Engineer in the State of Oregon. 13. Applicant shall provide a complete set of construction drawings for the sanitary sewer system to the service provider and Oregon Department of Environmental Quality {01=C~} for review and approval prior to issuance of permits. The system shalt be designed to serve this devebpment as we{[ as ail future development which will be tributary to this development. 14. Applicant shall provide to the Public Works Department, for review and approval, a complete set of construction drawings for the storm drainage system to serve this property, including connections to the City system. A[l roof drains, area drains, crawl spaces and parking lot drains shall have positive drainage away from structures and shall connect to the City system. Construction drawings shall be accompanied by calculations supporting the storm drainage design and shall be prepared and stamped by a licensed Professional Engineer in the State of Oregon. The engineer shall Use the intensity-doratior~ curves obtained from the Public Works Department far determining runoff #or this project. 15. Applicant shat[ provide to the City, for review and approval, a grading and drainage plan for the entire project. The plan shall indicate topography and show elevations sufficient for evaluation. This shalt be prepared and stamped by a licensed Professional Engineer in the State of Oregon. ~ 6. ORS 468.70 requires that alt developments which will disturb 5 acres or more of land adjacent to a stream which discharges to surface waters of the State shai[, as part of the construction permitting process, submit an "Erosion Control Plan." The `Erasion Control Plan" shalt require a permit from DEQ. No construction far this project shall occur unfit authorization to proceed has been granted by DEQ. $PECIFI.~ 1. The site plan informational requirements described in the Findings section of this report shalt be included on future submittals. 2. The Peninger Way extension, which will provide the primary ingresslegress for the Pilot site, shall be boated directly across from Peninger Way. 3. The right turn movements from Pine Street warrant right turn tapers at both the Peninger Way extension and the auto access to the east on Pine Street. Therefore, right turn tapers along Pine Street shall be required. 4. Ali taming radii at Pine Street and the Peninger Way extension shalE be designed to accommodate WB-50 vehicles. ADDENDUM TO PILOT TRAVEL CENTER The Planning Commission recommended approval subject to Planning Department and Public Works conditions of approval with the fallowing modifications: 1. Modify Public Works specific conditions number 5 & 6 requiring a six foot bike lane on each side of the Peninger Road extension to allow applicant to present alternative methods for providing bike access to the project site, subject to Public Works approval. 2. Direct staff to investigate creation of a reimbursernent mechanism that requires future developers to pay apro-rata share of the cost of public roadway improvements constructed by the applicant. 3. Modify site plan to allow a 35' driveway width on Peninger Road to accommodate fast-food restaurant traffic subject to Public Works approval. Pilot Travel Center Conditions - Continued 5. The minimum street Lane configuration on the Peninger Way extension sha{I be: • 1 - 12` southbound lane with 1 - 6' bike Pane f 18' width from face of curb to centerline} • ~ - 12' northbound left turn lane f 100' minimum length} ~ 1 - 12` northbound leftlthrough lane • 1 - 12' northbound right turn lane {100' minimum length} with 1 - 6` bike lane (I8` width from face of curb to centerline}. The Peninger Way extension shall be a City street. fi. A 12' two way left turn lane and 6` bike lanes shaft be required on the Peninger Way extension south of Pine Street to the southern most Pilot truck and auto access. 7. Jackson County, OOOT and the City of Central Point recommend that the distance from the stop bar at Pine Street to the centerline of the northern Pilot auto access an the Peninger Way extension be a minimum of 240' to provide a safe distance between conflicting Left turn movements. The site plan submitted by the Pilot Corporation places the auto access less than 200` from the Pine Street intersection. In lieu of the 200` minimum spacing requirement, the applicant shaft: • Pnsure that in no case the Pilot auto access is closer than 150' from the stop bar at Pine Street • Provide an exclusive southbound left turn lane at the auto access • fwxtend the 2 - 12` northbound felt turn lanes south to the point of access • Submit to Jackson County and the Central Point Public Works Department, for review and approval, a site plan for the property to the west which shows a safe access point to the Peninger Way extension. 8. AIf pavement widening and narrowing along the Peninger Way extension shall be constructed at a taper rate of no less than 15;1. 9. Al! costs to modify the existing signal at Pine Street and the proposed Peninger Way extension shall be borne by the applicant, including costs to modify the north leg of Peninger Way if needed. 10. The auto access on Pine Street located east of the Peninger Way extension shalt have 3b' approach radii. The 254.06` distance shown on the site plan from the centerline of the Pine Street auto access to the east edge of the Peninger Way extension is adequate. Left and right movements at the Pine Street auto access are allowed at this time. Jackson County reserves the right to restrict this access to right inlright out movement if accident reports warrant elimination of left turn movements. This condition will be included in the Road Approach Permit which is required by Jackson County. 71. The applicant shall obtain Road Approach Permits from Jackson County for both the Peninger Way extension and the Pine Street auto access. Pilot Travel Center Conditions -Continued 12. As traffic volumes increase on Pine Street, a right turn Lane will be needed to maintain capacity. A 10' right-of-way dedication to Jackson County shall be required along Pine Street frontage for future construction of this right turn fane. 13. The proposed Pilot truck access to the diese{ fuel islands and the parking area has a width of approximately 220'. A maximum 3D' commercial driveway approach width onto a local public street is allowed by City of Central Point Standard Specifications and Uniform Standard Details for Public Works Construction. Provisions of this document and CPMC give the Public Works Director discretion, in any particular case, to require a higher or different standard of design, when in her judgement, it is in the best interest of the public health, safety and welfare, considering all circumstances of the specific project. It is the professiana{ judgement of the Public Works Director that the commercial driveway approach width, as proposed, is indeed in the best interest of the.pubGc health, safety and welfare, pro~rided tfiaf the fallowing coaditians are incorporated: • The driveway approach shall be constructed with a rolled (low rounded} curb. This will perpetuate surface drainage and allow the trucks sufficient space to maneuver and enter the diesel islands without driving over and damaging the standard squared tapers. The rolled curb wilt also reduce the entry time for trucks, thus improving safety on the local public street. • The truck entrance shall be delineated with incoming directional arrows and Igo Exit signs shop be pasted to prohibit egress. • A landscaped island, which meets City sight distance and vision clearance requirements, shall be constructed south of the incoming truck driveway approach to separate truck ingress and egress movements. The exiting lane to the south of the island shall be delineated with outgoing directional arrows. • A truck and auto entrance fane to the large parking area shall be delineated to the south of the truck exit Lane. • Ail details for this approach shall be reviewed and approved by the Public Works Director prior to issuance of permits. Staff Report to General Point 4 GTTY QF GEI~TRAL PRINT PLANNING DEPARTMENT GONDI'fI(}NS OF APPROVAL CONDITIONS FOR THE SITE PLAN 1. Landscaping will be planted as shaven on the planting plan submitted and planting will. be complete at the time of occupancy. 2. A plan for the irrigation systeu~ for the landscaping shall be submitted with the building permit application for City approval prior to issuance of building permits. 3. Access shall be provided as shown on the site plan. Applicant shall obtain an approach road permit {or equivalent permission) from Jackson County prior to occupancy for the direct access an Pine Street. Changes to the traffic signal and impz-avetnent of the new street, including all striping, shall be completed for the pra,~ect frontage prior to occupancy. G. Off-street parking and loading shall be provided as shaven on the site plan, as amended. 5. A drawing{s) for the signage shall be submitted with the building permit application far City approval prior to issuance of building permits. 6. Far compatibility of architecture and design with the surrounding area construct the building as spawn on the site plan and consistent with the building elevations submitted with the applications. It is expected by the City that minor design variations such as a change in the height or placement of a wall of two feet or sa may result in final design, CONDl:TIONS FOR THE OUP IN ADAITION TO THE SITE PiAH 1. Point CITY OF CENTRAL POINT PLANNING DEPARTMENT CONDITION Off' APPROVAL ~~ Access to the subject property shall be provided by the creation of a new street aligned with the existing traffic signal at Pine and Peninger. Development of this new street may be phased, but street improvements on the new frontage to be developed, changes to the traffic signal and a3.1 striping to accommodate specific developments must be completed prior to occupancy of developments on the subject property. The new street {including extensions, driveways and intersecting easements needs to provide access for all properties south of Pine Street, east of I-5, and west Bear Creek so traffic can gain access to Pine Street via the signalized intersection at Peninger Raad. ~-
