This matter came before the Planning Commission for hearing on April 15, 1996, on applicant's conditional use permit application for a fast food restaurant and truck fueling facility in a C-4 district of the City. The Planning Commission reviewed the application and the City staff reports, and received comments from all persons wishing to be heard in favor of and opposed to the application. Now, therefore; BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Criteria A licable to Decision. The following chapters of the Central Point Municipal Cade apply to this application: A. Chapter 17.44, C-4, Tourist and Office-Professional District; B. Chapter 17.60, General Regulations; C. Chapter 17.64, Off-Street Parking and Loading; D. Chapter 17.75, Conditional Use Permits. Section__2. Findings and ,Conclusions. The Planning Commission hereby adopts by reference all findings of fact set forth in the City staff reports, and concludes that, except where addressed in the conditions to approval, the application and proposal comply with the requirements of the following chapters of the Central Point Municipal Code: A. Chapter 17.44 relating coverage, setback, bui in the C-4 district; B. Chapter 17.60 relating C. Chapter 17.64 relating loading facilities; D. Construction of this development shall include street, Traffic control and delineation, lighting, water, sanitary sewer, storm drainage, utility, sidewalk, Bikeway and ingress and egress improvements. 2. Applicant shall construct all utilities, streets, and other facilities within rights-of-ways owned, or to Be awned by the City of Central Point, in accordance with all rules, regulations, ordinances, resolutions, standards and other applicable requirements of the City for construction of this development. .- ~~ 3. The City shall inspect and test all improvements proposed far dedication to the City. The City`s inspection shall include all existing and future public infrastructure. 4. Applicant sha{i bear all costs associated with this development and the conditions placed upon this development. 5. No construction shall begin on this protect until the Public Works Department and other pertinent departments of the City have reviewed and approved the project plans and specifications and have issued appropriate permits. 6. At the cost of the applicant, the City 1=ngineer shall evaluate the strength of native soils and determine the appropriate street structural section design. 7. Applicant shall submit to Public Works Department, far review and approval, a complete set of construction drawings for aiI street, sidewalk, driveway, curb and gutter improvements. Vision and sight distance requirements sha[i Be detailed on the construction drawings. This shall be prepared and stamped by a licensed Professional Engineer in the State ofi Oregon. 8. Construction drawings for this project sha[I include a street fighting and traffic contra! and delineation plan, to be reviewed and approved by the Public Works Department. This shall be prepared and stamped by a licensed Professional Engineer in the State of Oregon. 9. Applicant shall instafi street Tights as required in City of Central Point Standard Specifications and Uniform Standard Details for Public Works Construction. The maximum spacing of street lights shat[ be 200'. Applicant shall instal( an Oregon State Health Division approved testable backffow prevention device behind City water meters for any system which connects to the applicant`s irrigation system or any other water system which may be a potential cross connection. Locations, types and sizes of backflow prevention devices shat( be Shawn on construction drawings. i 2. Applicant shall provide to the Public Works and 1=ire Departments, for review and approval, sizing requirements and flow calculations for fire systems including any mains and hydrants. This shall be prepared and stamped by a licensed Professional Engineer in the State of Oregon. 7 3, Applicant shall provide a complete set of construction drawings for the sanitary sewer system to the service provider and Oregon Department of Environmental Quality (Dl;C~} for review and approval prior to issuance of permits. The system shall be designed to serve this deve{opment as well as all #uture development which wit{ be tributary to this development. 74. Applicant shall provide to the Public Works ^epartment, for review and approval, a complete set of construction drawings #or the storm drainage system to serve this property, including connections to the City system. All roof drains, area drains, crawl spaces and parking lot drains shall have positive drainage away from structures and shall connect to the City system. Construction drawings shall be accompanied by calculations supporting the storm drainage design and shalt be prepared and stamped by a licensed Professional Engineer in the State of Oregon. The engineer shall use the intensity-duration curves obtained from the Public Works Department for determining runoff for this project. '15. Applicant shall provide to the City, far review and approval, a grading and drainage plan for the entire project. The plan shaft indicate topography and show elevations sufficient for evaluation. This shalt be prepared and stamped by a licensed Professional Engineer in the State of Oregon. '{ 6. ORS 46$.70 requires that all developments which wiq disturb 5 acres or more of farad adjacent to a stream which discharges to surface waters of the State sha[l, as part of the construction permitting process, submit an "Erosion Control Plan." The °Erosion Control Plan" shall require a permit from DEQ. No construction for this project shall occur until authorization to proceed has been granted by DEQ. 1. The site plan informational requirements described in the Findings section ofi this report shall be included on future submittals. 2. The Peninger Way extension; which wit! provide the primary ingress/egress for the Pilot site, shall be located directly across from Peninger Way. 3. The right turn movements from Pine Street warrant right turn tapers at both the Peninger Way extension and the auto access to the east on Pine Street. Therefore, right turn tapers along Pine Street sha[l be required. 4. All turning radii at Pine Street and the Peninger Way extension shall be designed to accommodate WB-50 vehicles. Pilot Travel Center Conditions -Continued 5. The minimum street lane configuration an the Peninger Way extension shall be: • 1 - 12' southbound lane with 1 - 6' bike lane (18` width from face of curb to centerline} • 1 - 12' northbound left turn lane {900` minimum length} • 1 - 12' northbound left/through Lane + 1 - 12' northbound right turn (one ('100' minimum length} with 1 - 6' bike lane (18' width from face of curb to centerline}. The Peninger Way extension shall be a City street. _t 6. A 12' two way left turn lane and 6' bike lanes shall be required on the Peninger Way extension south of Pine Street to the southern most Pilot truck and auto access. 7. Jackson County, 0©0T and the City of Central Point recommend that the distance from the stop bar at Pine Street to the centerline of the northern Pilot auto access on the Peninger Way extension be a minimum of 200' to provide a safe distance between conflicting left turn movements. The site plan submitted by the Picot Corporation places the auto access less than 200' from the Pine Street intersection. In Lieu of the 200' minimum spacing requirement, the applicant shall: • Ensure that in no case the Pilot auto access is closer than 150' from the stop bar at Pine Street + Provide an exclusive southbound left turn lane at the auto access + Extend the 2 - 12' northbound left turn lanes south to the point of access + Submit to Jackson County and the Central Point Public Works Department, far review and approval, a site plan for the property to the west which shows a safe access point to the Peninger Way extension. 8. AEI pavement widening and narrowing along the Peninger Way extension shall be constructed at a taper rate of na less than 15:9. 9. AI[ costs to modify the existing signal at Pine Street and the proposed Peninger Way extension shop be borne by the applicant, including casts to modify the north leg ofi Peninger Way ifi needed. 10. The auto access on Pine Street located east of the Peninger Way extension shall have 35' approach radii. The 254.06` distance shown on the site plan from the centerline of the Pine Street auto access to the east edge of the Peninger Way extension is adequate. Left and right movements at the Pine Street auto access are allowed at this time. Jackson County reserves the right to restrict this access to right inlright out movement if accident reports warrant e[iminatian of left turn movements. This condition will be included in the Road Approach Permit which is required by Jackson County. 11. The applicant shall obtain Road Approach Permits from Jackson County for both the Peninger Way extension and the Pine Street auto access. Pilot Travel Center Conditions -Continued 12. As traffic volumes increase on Pine Street, a right turn tans will be needed to maintain capacity. A 10' right-of-way dedication to .lackson County shall be required along Pine Street frontage for future construction of this right turn lane. 13. The proposed Pilot truck access to the diesel fuel islands and the parking area has a width of approximately 220'. A maximum 30` commercial driveway approach width onto a local public street is allowed by City of Central Point Standard Specifications and Uniform Standard Details for Public Works Construction. Provisions of this document and CPMC give the Fub{ic Works Director discretion, in any particu{ar case, to require a higher or different standard of design, when in her judgement, it is in the Best interest of the public health, safety and welfare, considering all circumstances of the specific project. It is the professional judgement of the Pub{ic Works Director that the commercial driveway approach width, as proposed, is indeed in the best interest of the public health, safety ar<d welfare, provided that the fallowing conditiarrs are inaorparated; • The driveway approach shall be constructed with a ro[ted (low rounded) curb. This will perpetuate surface drainage and allow the trucks sufficient space to maneuver and enter the these! islands without driving aver and damaging the standard squared tapers. The ro[ted curb will also reduce the entry time far trucks, thus improving safety on the local public street. • The truck entrance shelf be delineated with incoming directional arrows and No Exit signs shall be posted to prohibit egress. + A landscaped island, which meets City sight distance and vision clearance requirements, shall be constructed south of the incoming truck driveway approach to separate truck ingress and egress movements. The exiting lane to the south of the island shaft be delineated with outgoing directional arrows. • A truck and auto entrance lane to the large parking area shall be delineated to the south of the truck exit lane. • A{l details for this approach shat! be reviewed and approved by the Public Works Director prior to issuance of permits. For compatibility of architecture and design With the surrounding area construct the building as shown on the site plan and consistent with the building elevations submitted with the applications. I.t is expected by the City that minor design variations such as a change in the height or placement of a wall of two feet or so may result in final design. Development of this new street may be phased, bt~.t street improvements on the new frontage to be developed, changes to the traffic signal anal all striping to accommodate specific developments must be completed prior to occupancy of developments on the subject property. The new street {including extensions, driveways and intersecting easements needs to provide access for~all properties south of Pane Street, east of I-5, and west Bear Creek so traffic can gain access to Pine Street via the signalized intersection at Peninger Road. ~-
