A RESOLUTION APPROVING A SITE PLAN
AND CONDITIONAL USE PERMIT
(Applicant: LTM, Inc.)

Recitals
1. This matter came before the Planning Commission for
hearing on July 2, 1996, on applicant's site plan and conditional
use permit applications for installation of two 15,000-gallon
above-ground fuel tanks in connection with applicant's aggregate
resource operation in a B.C.G., Bear Creek Greenway district of
the City. The Planning Commission reviewed the application and
the City staff reports, and received comments from all persons
wishing to be heard in favor of and apposed to the application.
Now, therefore;
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF
CENTRAL POINT, OREGON, AS FOLLOWS:
Section 1. Criteria Applicable to Decision. The following
chapters of the Central Point Municipal Code apply to this
application:
A. Chapter 17.54, B.C.G., Bear Creek Greenway;
B. Chapter 17.60, General Regulations;
C. Chapter 17,64, Off-Street Parking and Loading;
D. Chapter 17.72, Site Plan Approval;
E. Chapter 17.76, Conditional Use Permits.
Section 2. Findings and Conclusions. The Planning
Commission hereby adopts by reference all findings of fact set
forth in the City staff reports, and concludes that, except where
addressed in the conditions to approval, the application and
proposal comply with the requirements of the following chapters
of the Central Point Municipal Code:
A. Chapter 17.58 relating to uses, lot size, lit
coverag e, setback, building height and screening
in the B.C.G. district;
B. Chapter 17.60 relating to general regulations;
C. Chapter 17.64 relating to off-street parking and
loading facili ties;
D. Chapter 17.72, Site plan approval;
E. Chapter 17.76 relating to conditional use permit
requirements.

Section 3. Conditional A naval. The within applications
for site plan and conditional use permit are hereby conditionally
approved, subject to the following conditions.
1.. The fuel tanks shall be installed in accordance with the
approved site plan and the applicable provisions of the Uniform
Building Code and State of Oregon Uniform Fire Code.
2. The installation of the fuel tanks will require the
issuance of a building permit by the City of Central Point.
3. The applicant shall provide the City with copies of any
other permit approvals required by local., state or federal
agencies far the installation of the fuel tanks.
4. The applicant shall provide the City with plans showing
the location, size and composition of roads that will be used to
provide fire department access to the fuel tanks and water lanes
and hydrants that will provide the required fire flow for fire
department apparatus. Any deficiencies in meeting fire
department requirements shall be remedied by the applicant prior
to the dispensing of any fuels.
5. The conditional use permit is valid for a period of
twelve months. The proposed use, must commence within this period
or a new conditional use permit must be applied for.
