A RESOLUTION CONDITIONALLY APPROVING A SITE PLAN,
CONDITIONAL USE PERMIT AND SIGN VARIANCE
(Applicant: McDonald's Corp.)
(37 2W O2CD Tax Lots 2900, 3000 and 3100)
Recitals
1. This matter came before the Planning Commission for
hearing on August 6, 1996, an applicant's site plan, conditional
use permit and sign variance applications for a McDonald's
restaurant on the south side of Pine Street between Freeman Road
and Ninth Street in a C-4 district of the City. The Planning
Commission reviewed the application and the City staff reports,
and received comments from all persons wishing to be heard in
favor of and opposed to the application.
Now, therefore;
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF
CENTRAL POINT, OREGON, AS FOLLOWS:
Section 1. Criteria A licable to Decision. The following
chapters of the Central Point Municipal Code apply to this
application:
A. Chapter 17.44,
District;
B. Chapter 17.60,
C. Chapter 17.64,
D. Chapter 17.72,
Plan Approval;
E. Chapter 17.76,

Section 2. Findings and Conclusions. The Planning
Commission hereby adopts by reference all findings of fact set
forth in the City staff reports, and concludes that, except where
addressed in the conditions to approval, the application and
proposal comply with the requirements of the following chapters
of the Central Point Municipal Code:
A. Chapter 17.44 relating to uses, lot size, lot
coverage, setback, building height and screening
in the C-4 district;
B. Chapter 17.60 relating to paving and landscaping
requirements;

I . The project shall be developed in substantial compliance with the approved site plan.
2. Landscaping shall be installed in accordance with the apl}raved Iandscal~ing plan prior to
final occupancy. Landscaping shall be continuously maintained in a healthy growing
condition. An automatic irrigation system shall be installed for all landscaping subject to the
approval of the Building Department.
3. Off-street parking shall be provided for the project in accordance with the approved site
plan and CPMC 17.64. This shall include required off"street parking and loading,
handicapped parking, parking stall design and aisle width. Any revisions to the parking layout
shall be approved by the Planning Department prior to the issuance of building permits.
4. Access to the project site sha11 be permitted from Ninth Street and Freeman Road. No
access shall be permitted from E. Pine Street. Access from Freeman Road shall be limited to
right turn in, right turn out and interim left turn in movements only. Left turn out movements
shall not be pernitted from the project site onto Freeman Road. Left turn in movements shall
be eliminated through the construction and extension of a raised median on Freeman Road
from the project site-access driveway to the E. Pine Street signalized intersection at such time
as any one of the following criteria are met:
a. Northbound through or left-turn movement vehicular queues at the signalized
intersection extend to or past the site-access driveway (125 feet or 5 vehicles) for five
or mare percent of the time during a given hour (three minutes ar greater}; or
b. Two or mare accidents occur within atwelve-month period which are associated
with interim left-turn in movements or prohibited left-turn out movements; or
c. Excessive numbers of vehicles making prohibited left-turn out movements from the
site-access driveway to northbound Freeman Road as determined by the City of
Central Point and/or Jackson County.
The property owner of 37S 2W 02CD Tax Lots 2900, 3000 and 3100 will be responsible for
either constructing or providing sufficiern funds to Jackson County to construct the median
within three months of any of the above criteria being met.
5. Changes to or improvement of the public streets adjoining the project site, including all
channelization, striping and signage, shah be completed prior to final occupancy.

7. An oil/water separator shall be required for the drainage system of tlac }parking area

proposed use must commence within this period or a new Conditional Use Permit must be

100 feet above ground level and shall nat contain more than three hundred sc}uare feet of
advertising surface.

This is a Site PIan Review covering the Fire Protection aspects of a proposed 2539 sq. ft. project.
The requirements outlined herein are based on the 1991 Edition of the Uniform Fire Code with
1992 State of Oregon Amendments. This review assesses the Fire Protection needs related to
Water Supply, Fire Departrr~ent Access, Required Fire Flow, General precautions against f re
during construction, and Timing of Installation of Fire Protection Features.
This review does not cover the structural nor fire & life safety requirements relating to the
proposed structures}. Those requirements will be addressed in detail at the time of submittal of
detailed plans for issuance of building permits.

development. That structure has been determined to have an approximate f re area of
2539 sq. Ft. Using Table A-III-A-1 afthe Uniform Fire Code. Assuming that the proposed
largest structure will be constructed oftype ~-N construction (fully sprinklered), the
required fire flow shall be established at 1500 g.p.rri. Existing fire hydrants will meet the
required fire f~ow. No on-site hydrants are required.

General:
The applicant shall subunit to the City's Public Works Department plans and specifications for all
improvements proposed for construction or modification within the City's rights-of ways or
easements. ,All construction shall conform to the City's Standard Specifications and Uniform
Standard Details for Public Works Construction and such other special specifications herein. No
construction shall commence until the Public Works Department has reviewed, approved, and
issued a permit for the proposed improvements.

Provide construction drawings for the curbs, aprons, medians, sidewalks, striping, and on-site

SUBJECT: CONCLUSIONS AND RECOMMENDATIONS: TRANSPORTATION IMPACT
ANALYSIS - McDONALD'S EAST PINE STREET/FREEMAN ROAD
BACKGROUND
The City of Central Point requires that proposed developments be evaluated with respect to traffic
operations and traffic safety. These analyses must be performed by a registered engineer and
documented in a report known as a traffic impact study. The purpose of the analyses and the reports
are to ensure that developments in the City of Central Point are designed with traffic safety in mind
and that the public's investments in streets, traffic signals, and other components of the transportation
system are protected.
The details of the City of Central Point's requirements for traffic impact analyses are specified in the
City's Public Work.r Standards Design Guidelines. The relevant guidelines are Section J., "Traffic
Studies. "
The most important issues which the City requires to be addressed are:
• trip generation of the proposed development;
• the impact on traffic operations of nearby intersections for both the year in which the
development is constructed and the planning horizon year approximately 20 years in the
future; and
• the adequacy of the proposed access (driveways}.
SUBMITTAL OF TRAFFIC IMPACT ANALYSIS
On behalf of the McDonald's Restaurant, the traffic engineering firm of Kittelson & Associates, Inc.
prepared and submitted a traffic impact analysis designed to address traffic issues surrounding
development of the restaurant at the corner of E. Pine Street and Freeman Road in Central Point.

Materials submitted by Kittelson & Associates, loc. consisted of:
• the original Transportation Impact Analysis McDonald's East Pine Street/Freeman Road
{dated November 1995);
• a letter to Ms. Susan Wilson Broadus fram Marc A. Butorac and Mark A. Vandehey, PE
(dated Februazy 9, 1996}; and
• a letter to Mr. James Barnett froze Marc A_ Butorac and Mark A. Vandehey, PE (dated June
3, 1996)_
Between them, these materials address the requirements of the City of Central Point for traffic
impact analyses as specified in the City of Central Point's Public Works Standards Design
Guidelines, Section J., "Traffic Studies."
One of the key issues raised by both staff of Jackson County and the City of Central Point concerned
the proposed location of the driveway on Freeman Road just south of E. Pine Street. Concerns were
raised about possible interference with traffic operations at the signalized intersection of E. Pine
Street with Freeman Road and the sight distance for motorists on Freeman Road approaching the
proposed driveway from the south (near Bigham Street).
Traffic engineers representing the developers (Kittelson & Associates on behalf of McDonald's),
Jackson County, and the City of Central Point (John Replinger, PE. of David Evans and Associates,
Inc. acting as the City's traffic engineer) agreed that left turns from the McDonald's to Freeman
Road should not be permitted. All of the engineers also agreed that right turns should be permitted
into and out of the driveway on Freeman Road. However, there was a professional disagreement
among the engineers about whether or not an inbound left turn from northbound Freeman Road into
the McDonald's should be permitted. The principal issue concerned a motorist's ability to see a car
because of the turn and the hill on Freeman Road between Bigham Street and E. Pine Street. A
compromise solution was offered by McDonald's traffic engineer providing far interim approval of
left turns from Freeman Road to the McDonald's.
Minor revisions to the proposal were suggested by the City's traffic engineer and were verbally
accepted by representatives of McDonald's. The proposal permits the McDonald's to establish the
driveway as a right-in and aright-out driveway, and as an interim condition as a left-in driveway.
There are three criteria which allow the Ieft-in movement to be discontinued. This compromise
allow McDonald's to have left-turn-in access from Freeman Road as long as traffic does not interfere
with the signalized intersection at E. Pine and Freeman and as long as the driveway continues to
operates safely.

RECOMMENDATION
Acting as the City of Central Point's traffic engineer, 1 recommend that the following condition be
attached to approvals granted by the City for development of the McDonald's restaurant at the corner
of E. Pine Street and Freeman Road:
Establishment of a Freeman Road Site-Access Driveway Monitoring Program
June 11, I996.
The Freeman Road site-access driveway located at Station XX+XXX {approximately
175 feet south of East Pine Street, centerline-to-centerline} will be restricted to right-
in/right-out/left-in movements through the use of raised channelization on the site-
access driveway and Freeman Road per the approved site-access design plans. Due to
the proximity of the signalized Freeman Road-North 10th StreetlEast Pine Street
intersection, the left-in access rights are granted on an interim basis because of
potential future operation and safety issues and will be monitored by the City of
Central Point and Jackson County. The left-in access will be eliminated at the point in
time when any one of the following restriction criterion is met:
1) Northbound through or left-turn movement vehicular queues at the signalized
intersection extend to or past the site-access driveway (125 feet or 5 vehicles)
for five or mare percent of the time during a given hour (three minutes or
greater); or
2) Two or more accidents occur with a twelve month period which are associated
with the interim left-turn ingress movement or prohibited left-turn egress
movement; or
3) Excessive numbers of vehicles making the prohibited left-turn egress movement
from the site-access driveway to northbound Freeman Road. {The definition of
"Excessive numbers" shall be determined solely by Central Point or Jackson
County officials).
At the time at which one of the above restriction criteria is met, the left-turn ingress
movement will be eliminated through the construction and extension of the raised
median on Freeman Road to the signalized intersection. The owner of Tax Lots 2900
and 3000 will be responsible for either constructing or providing sufficient funds to
Jackson County to construct the median within three months of the restriction criterion
being met.
