This matter came before the Planning Commission for hearing on September 17, 1996, on applicant's site plan, conditional use permit and setback and parking requirements variance applications for an addition to the existing Rainbow's End Daycare Center at 511 South 4th Street in an R-1-6 district of the City. The Planning Commission reviewed the application and the City staff reports, and received comments from all persons wishing to be heard in favor of and opposed to the application. Naw, therefore; BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Sec,t,on 1. Criteria Applicable to Decision. The following chapters o~ the Central Point Municipal Cade apply to this application: A. Chapter 17.36, R-].-6 Residential Single-Family District; B. Chapter 17.60, General Regulations; C. Chapter 17.64, Off-Street Parking and Loading; D. Chapter 3.7,72, Site Plan, Landscaping and Construction Plan Approval; E. Chapter 17.76, Conditional Use Permits; and F. Chapter 17.80, Variances. Section 2. Findings and Conclusions. The Planning Commission hereby adopts by reference all findings of fact set forth in the City staff reports, and concludes that, except where addressed in the conditions to approval, the application and proposal comply with the requirements of the fallowing chapters of the Central Point Municipal Code: A. Chapter 17.20 relating to uses, lot size, lot coverage, setback, building height and screening in the R-1-6 district; B. Chapter 17.60 relating to paving and landscaping requirements; 1 _ PLANNING COMMISSION RESOLUTION NO. ~/~ {092096) C. Chapter 17.64 relating loading facilities; D. Chapter 17.72 relating E. Chapter 17.76 relating to aff-street parking and to site plan requirements. to conditional use permits. Section 3. Variance Granted. Applicant is granted approval for three parking spaces, instead of the required eight spaces. A variance is also granted for the setback to the addition. Instead of the required 20-float setback, permission is granted for a 1-foot setback, so that the addition will be extended along the same setback line as the existing building. Applicant has met the variance criteria of CPMC Chapter 17.80. Section ~. Conditional Approval. The within application for site plan approval is hereby canditianally approved, subject to the conditions set forth on Exhibit "A", which is attached hereto and by this reference incorporated herein. The day caxe facility shall comply with all applicable rules, regulations and required facility inspections as administered by the State of Oregon, 3ackson County and the City of Central Point. 3. The day care facility steal! operate-within the hours of 6:30 AM to 6:OOPM Monday through Friday. 4. Site plan shall include the entire project to be constructed on the applicant's property, not within the City right-of--way, and that the parking spaces be delineated on the site plan with a minimum of 3 parking spaces.
