A RESOLUTION CONDITIONALLY APPROVING A SITE PLAN
AND CONDITIONAL USE PERMIT
(Applicant: Pine Street L.L.C.)
(37 2W 02D Tax Lot 2400)
Recitals
1. This matter came before the Planning Commission for
hearing on November 5, 1996, on applicant's site plan and
conditional use permit applications for a 2,822 square foot
Burger King fast fond drive-in restaurant on South Penninger Road
in a C-4 district of the City. The Planning Commission reviewed
the application and the City staff reports, and received comments
from all persons wishing to be heard in favor of and opposed to
the application.
Now, therefore;
BE IT RESOLVED BY THE PLANNING CDMMISSION OF THE CITY OF
CENTRAL POINT, OREGON, AS FOLLOWS:
Section _1. Criteria Applicable to Decision. The following
chapters of the Central Point Municipal Code apply to this
application:
A. Chapter 17.44,
Distract;
B. Chapter 17.60,
C. Chapter 17.54,
D. Chapter 17.72,
Plan Approval;
E. Chapter 17.76,
C-4, Tourist and Office-Professional
General Regulations;
Off-Street Parking and Loading;
Site Plan, Landscaping and Construction
and
Conditional Use Permits.
Section 2. Findin s and Conclusions. The Planning
Commission hereby adopts by reference all findings of fact set
forth in the City staff reports, and concludes that, except where
addressed in the conditions to approval, the application and
proposal comply with the requirements of the following chapters
of the Central Point Municipal Code:
A. Chapter 17.44 relating to uses, lot laze, lot
coverage, setback, building height and screening
in the C-4 district;
B. Chapter 17.60 relating to paving and landscaping
requirements;
C. Chapter 17.64 relating to off-street parking and
loading facilities;

D. Chapter 17.72 relating to site plan requirements;
and
E. Chapter 17.76 relating to conditional use permits.
Section 3. Condit~nna_1.„_Approval. The within application
for site plan approval is hereby conditionally approved, subject
to the conditions set forth on Exhibit "A", which is attached
hereto and by this reference incorporated herein.

CONDITIONS OI? API'ROVAt~
1. The project shall be developed in substantial compliance with the approved site plan.
2. Landscaping shall be installed in accordance with the approved landscaping plan prior to
final occupancy. Landscaping shat! be continuously rnair~tained iri a healthy growing
condition. An automatic irrigation system shall be installed far alI landscaping subject to the
approval of the Building Department.
3. Off=street parking shall be provided for the project in accordance with the approved site
plan and CPMC 17.64. This shall include required off street parking and loading,
handicapped parking, parking stall design and aisle width. Any revisions to the parking layout
shall be approved by the Planning Department prior to the issuance of building permits.
4. Access to the project site shalk enter from S. Peninger Rd. and exit from La Rue Dr.
5. Changes to or improvement of the public streets adjoining the project site, including all
channelization, striping and signage, shall be constructed in accordance with city, Jackson
County and ODOT standards, as applicable.
6. Hach sign proposed for the project shall require a sign permit application to be submitted
with the building permit application for the project.
7. An oil/water separator shall be required for the drainage system of the parking area.
8. Hours of operation for the fast-food restaurant shall be between 6:00 a.m. and 12:00 a.m.
daily.
9. The approval of the Conditional Use Permit is valid for a period of twelve months. The
proposed use must commence within this period or a new Conditional Use Permit must be
applied for.
10. The freeway-oriented pole sign proposed for the project shaki be a maximum height of
80 feet above ground kevel and shall not contain more than three hundred square feet of
advertising surface.
