HomeMy WebLinkAboutResolution 373 - Moore Partition - Taylor Road`~T ~> f) ~( ~7 PLANNING COMMISSION RESOLUTION NO. 373 A RESOLUTION GRANTING TENTATIVE PLAN APPROVAL FOR A LAND PARTITION (Applicant: Noel Moore) (37 2W 03C Tax Lot 4400) Recitals 1. Applicant has submitted an application for tentative plan approval far a land partition on an 18.87-acre parcel, located at 2030 Taylor Raad in the City of Central Paint, Oregon. 2. On December 17, 1996, the Central Paint Planning Commission conducted a duly-noticed public hearing an the application, at which time it reviewed the City staff reports and heard testimony and comments on the application. Now, therefore; SE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Sect~.on 1. Approval Criteria. The requirements far approval of land partitions and tentative plans are sat forth in CPMC Title 16 and Title 17, relating to informational requirements, zoning, tot dimension, access, and similar requirements. Section 2. Findin s and Conclusions. The Planning Commission finds and determines as follows: A. Tentative Plan Re uirements. The application and tentative plan are in the correct form and contain all of the information required by CPMC Chapter 16.10. B. Area and Width of Lot. This partitioning in an R-2 zone would create the following parcels: Parcel 1: Approximately 1.15 acres; Parcel 2: Approximately 17.72 acres, Bath parcels meet the minimum area (6,000 square feet for interior lots and 7,000 square feet for corner lots) and width (60 feet fox- interior lots and 70 feet for corner lots) requirements for lots in the R-2 zone as set forth in CPMC 17.24.050, and such parcels meet the general requirements far lots contained in CPMC 16.24.050. 1 - PLANNING COMMISSION RESOLUTION NO. 373 (122096) Section 3. Conditional Apt~roval. The application for tentative plan for land partition herein is hereby approved, subject to the conditions set forth on Ez~hibit "A", attached hereto and by reference incorporated herein, imposed under authority of CPMC Chapter 16.36. The applicant shall submit to the City's Public Works Department plans and specifications for all improvements proposed for construction or modification within the City's rights-of--ways ar easements. All construction shall conform to the City's Standard Specifications and Uniform Standard Details for Public Works Corrstruc~ion and such other special specifications herein. No construction shall commence until the Public Works Department has reviewed, approved, and issued a permit for.the proposed improvements. The developer shall pay for all costs associa#ed wlth the design and installation ofthe improvements specifed on these plans. 2. Prior to final approval of the project, the developer's engineer or surveyor shall provide the Public Wor~CS Department with a digital drawing of the Fuial Plat property boundaries in an AutoCadd campatrble format. 3. Additional public improvements, which are not recommended as a part of this staff report, will be requested at the tune an applrc~tion for further development ofparcei 2 is considered. StreetslTraffic: 1. The aty has identified Taylor Road as a secondary arterial. The owner of record is requested to dedicate IO feet of additional feet right-of way along the Taylor Road frontage to the public for acceptance by the county. Jackson County has junsdidion aver Taylor Road along the frontage of the proposed parcels 1 & 2. 2. The owner of record shall 'enter into a deferred improvement agreement with the cityfcounty for the design and construc~ivn of the proposed street widening, curb and gutter, sidewalk, lighting, and storm drainage improvements along the frontage with Taylor Road. Sanitary Sewer: 1. Any existing sanitary sewer Bxtures not already connected to the public sewer systcn~ shat! be connected. Water System: 1. The construction shall comply with Oregon Health Division requirements for Baclcflow prevention. Rights-of ways/Easements: 1. See note 1 under streets/traffic for right-of--way dedication. 2.
