PLANNING COMMISSION RESOLUTION NO. 374
A RESOLUTION GRANTING TENTATIVE PLAN APPROVAL
FOR A LAND PARTITION
(Applicant: Noel Moore)
(37 2W 11D Tax Lots 3000, 3100 and 3200)
Recitals
1. Applicant has submitted an application for tentative
plan approval for a land partition on a 6.01-acre parcel, located
at 606 Beall Lane in the City of Central Paint, Oregon.
2. On December 17, 199b, the Central Point Planning
Commission conducted a duly-noticed public hearing on the
application, at which time it reviewed the City staff reports and
heard testimony and comments on the appli.catian.
Now, therefore;
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF
CENTRAL POINT, OREGON, AS FOLLOWS:
Section 1. A~praval Criteria. The requirements far
approval of land partitions and tentative plans are set forth in
CPMC Title 16 and Title 17, relating to informational
requirements, zoning, lot dimension, access, and similar
requirements.
Section 2. Findings and Conclusions. The Planning
Commission finds and determines as follows:
A. Tentative Plan Requirements. The application and
tentative plan are in the correct farm and contain all of the
information required by CPMC Chapter 16.10.
B. Area and Width of Lot. This partitioning in an R-2 zone
would create the fallowing parcels:
Parcel. ~.: Approximately 5.2 acres;
Parcel 2: Approximately .81 acres.
Both parcels meet the minimum area (6,000 square feet for
interior lots and 7,000 square feet for corner lots) and width
(60 feet for interior lots and 70 feet for corner lots)
requirements far lots in the R-2 zone as set forth in CPMC
17.24.050, and such parcels meet the general requirements for
lots contained in CPMC 16.24.050.

Section 3. Conditional. Approval. The application far
tentative plan for land partition herein is hereby approved,
subject to the conditions set forth on Exhibit "A", attached
hereto and by reference incorporated herein, imposed under
authority of CPMC Chapter 16.36.

General:
1. The applicant shall submit to the City's Public Works Department plans and specifications for
all improvements proposed for construction or modification within the City's rights-of--ways
or easements. All construction shall conform to the City's Standard Specifications and
Uniform Standard Details for Public Works Construction and such other special specifications
herein. No construction shall commence until the Public Works Department has reviewed,
approved, and issued a permit for the proposed improvements. The developer shall pay for all
costs associated with the design and installa#ion ofthe improvements specified on these plans.
2. Prior to final approval of the project, the developer's engineer or surveyor shall provide the Public
Works Department with a digital drawing of the Final Plat property boundaries in an AutoCadd
compatible format.
3. Additional public improvements, which are not recommended as a part of this staff report, will be
requested at the time an application for further development of parcel 1 is considered.
Streets/Traffic:
1. The city has identified Beall Lane as a secondary arterial. The owner of record of tag lot 3000 is
requested to dedicate 10 feet of additional feet right-of--way along the Beall Lane frontage to the
public for acceptance by the county. Jackson County has jurisdiction over Beall Lane along the
frontage of said tax lot. The owners of record of tax lots 31.00 & 3200 are asked to voluntarily
dedicate 10 feet of additional feet right-of way along the Beall Lane frontage to the public
for acceptance by the county.
2. The owner of record of tax lot 300 shall enter into a deferred improvement agreement with the
city/county for the design and construction of the proposed street widening, curb and gutter,
sidewalk, lighting, and storm drainage improvements along the frontage with Beall Lane. The
owners of record of tag fats 3100 & 3200 afire asked to voluntarily enter into a deferred
improvement agreement with the city/county for the design and construction of the
proposed street widening, curb and gutter, sidewalk, lighting, and storm drainage
improvements along the frontage with Beall Lane.

Sanitary Seaver:
1. The applicant shall refer to the report from BCVSA regarding additional conditions for this
development.
Water System:
;v. Any existing water supply fixtures for parcel 2 not already connected to the public water
system shall be connected, The construction shall comply with Oregon Health Division
requirements for Backilow prevention.
Rights-af ways/Easements:
1. See note 1 under streets/traffic for right-of--way dedication.
2. The construction drawings and Final Flat shall show all right-of--way and easement boundaries
associated with the project.
