A RESOLUTION GRANTING TENTATIVE PLAN APPROVAL
FOR A LAND PARTITION
(Applicants: Dean and Meridee Fancher)

1. Applicants have submitted an application for tentative
plan approval for a sand partition on a .55-acre parcel, located
off Snowy Butte Lane in the City of Central Point, Oregon.
2. On December 2, 1997, the Central Point Planning
Commission conducted a duly-noticed public hearing on the
application, at which time it reviewed the City staff reports and
heard testimony and comments on the application.
Now, therefore;
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF
CENTRAL POINT, OREGON, AS FOLLOWS:
Section 1. Approval Criteria. The requirements for
approval of land partitions and tentative plans are set forth in
CPMC Title 16 and Title 17, relating to informational
requirements, zoning, lot dimension, access, and similar
requirements.
Section 2. Findings and Conclusions. The Planning
Commission finds and determines as follows:
A. Tentative Plan Requirements. The application and
tentat_i.ve plan are in the correct form and contain all of the
information required by CPMC Chapter 16.10.
B. Area and Width of Lot. This partitioning in an R--1-6
zone would create the following parcels:
Parcel 1: Approximately 12,031.5 square feet;
Parcel 2: Approximately 12,031.5 square feet.
Both parcels meet the minimum area (6,000 square feet for
interior lots and 7,000 square feet for corner lots) and width
(50 feet fnr interior lots and 70 feet for corner lots)
requirements for lots in the R-1-6 zone as set forth in CPMC
17,20.050, and such parcels meet the general requirements for
lots contained in CPMC 3.6.24.050. Both parcels also meet the
area requirements for flag lots contained in CPMC 16.36.040,
which in this case requires a minimum of 12,000 square feet.

C. Access to Flag Lot. GPMC 1b,36.040 requires an access
of at least 20 feet in width, paved with cement or asphaltic
surface, fur all flag lnts created by partition. The tentative
plan submitted herein provides for a 20-foot wide access, to be
paved with concrete, which satisfies the City code requirement.
Section 3. Conditional Approval, The application for
tentative plan far land partition herein is hereby approved,
subject to the conditions set forth on Exhibit "A", attached
hereto and by reference incorporated herein, imposed under
authority of CPMC Chapter 16.36.

Purpose
Provide information to the Planning Commission and Applicant (hereinafter referred to as
"Developer"} regarding Public Works standards and additional standards and requirements to be
included in the design. Gather information from the Developer/Engineer regarding proposed
development.
Requirements
1. ~~l~/icl~grESS-Egress_on Private Access Wav: Anon-vehicular access way between the
east side of Flanagan Park and Snowy Butte Lane has been requested by several of the
residents living in the area of the proposed land partition. The City Public Works
Department (PWD) would suggest requiring the applicant to place a deed restriction on
the noted parcels of land to allow for public non-vehicular ingress-egress along the 20-
foot private access way far access to the east side of Flanagan Park. The access way
should also be illustrated an the final plat. It is suggested that the final plat far this land
partition not be issued until the recorded deed restriction is received by the City.

the Fanchers, water service will not be provided to any of the lots in either this tenative partition

4. 100-year Flood Zone: If the proposed partition places additional structures ar other
improvements within the 1 QQ-year floodzone, the Developer's engineer will be required to
explain and provide detail as to what affects will the placement of these structures have on the
floodzone; what affect will it have on the floodplain elevation and floodzone boundary; and
what affects will the modifcation of the floodplain elevation and floodzone boundary have an
the existing and proposed facilities, and properties surrounding the proposed development. As
applicable, the Developer's engineer steal! determine the existing Base Flaod Elevation
contours and illustrate the existing boundaries of the Flaodplain and floodway fora 100-year
storm event (commonly referred to as the "Base Flood Event"} associated with Griffin Creek,
