PLANNING COMMISSION RESOLUTION NO.~ A RESOLUTION CONDITIONALLY APPROVING A SITE PLAN AND CONDITIONAL USE PERMIT {Applicant: Les Gutches) (37 2W 11CD Tax Lot 1300) Recitais 1. This matter came before the Planning Commission for hearing on December 2, 1997, on applicant's site plan and conditional use permit applications for construction of a 7,200- square foot commercial building for tractor and farm equipment sales and repair for New Holland Equipment. The Planning Commission reviewed the application and the City staff reports, and received comments from all persons wishing to be heard in favor of and opposed to the application. Now, therefore; BE IT RESOLVED BY THE PLANNING CDMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Criteria A licable to Decision. The following chapters of the Central Point Municipal Cnde apply to this application: A. Chapter 17.46, C-5, Thoroughfare Commercial District; B. Chapter x7.60, General Regulations; C. Chapter 17.64, Off-Street Parking and Loading; D. Chapter 17.72, Site Plan, Landscaping and Construction Plan Approval; and E. Chapter 17.76, Conditional Use Permits. Section 2. Findin s and Conclusions. The Planning Commission hereby adapts by reference all findings of fact set forth in the City staff reports, and concludes that, except where addressed in the conditions to approval, the application and proposal comply with the requirements of the following chapters of the Central Point Municipal Code: A. Chapter 17.46 relating to uses, lot size, lot coverage, setback, building height and screening in the C-5 district; B. Chapter 17.60 relating to paving and landscaping requirements; C. Chapter 17.64 relating to off-street parking and loading facilities; 1 - PLANNING COMMISSION RESOLUTION NO. ~~ {120597) D. Chapter 17.72 relating to site plan requirements; and E. Chapter 17.76 relating to conditional use permits. Section 3. Conditional A roval. The within applications for sate plan, and conditional use permit approval are hereby conditionally approved, subject to the conditions set forth on Exhibit "A", which is attached hereto and by this reference incorporated herein. Bennett, AICP City Administrator SUBJECT: Site Plan Review and Public Hearing to Consider a Conditional Use Permit Application for New Holland Equipment Applicant/ Les Gutches Agents 4099 Tami Lane Central Paint, OR 97502 Pro rE~ Dwight Buss Owner: 625 Foots Creep Raad Gold Hill, OR 97525 Pro e Dese~ 37 2W I 1 CD TL 1300 -1.82 acres Zoning: C-5, Thoroughfaze Commercial Summary The applicant, Les Gutches, has applied to the City of Central Point for approval of a Site Plan Review and a Conditional Use Permit to allow the construction of a 7,200 sq. ft. commercial building to be used for tractor and farm equipment sales and repair by New Holland Equipment (Exhibit A). The project site is located on the east side of Front St. just north of Beall Lane in a C-5, Thoroughfare Commercial District. Authari CPMC 1.24.020 invests the Planning Commission with the authority to render a decision on any Site Plan or Conditional Use Permit application. A public hearing is required for consideration of any Conditional Use Permit application. Native of the public hearing was effected in accordance with CPMC 1.24.060 (Exhibit B). A livable Code Sections CPMC Chapter 17.45.OI0 et seq. - C-S, Thoroughfare Commercial District CPMC Chapter 17.72.010 et seq. -Site Plan, Landscaping anal Construction Plan Approval CPMC Chap#er 17.75.010 et seq. -Conditional Use Permits Discussion The proposed use falls within the category of heavy equipment sales and service. `T'his type of use is permitted in the C-5 district subject to the approval of a Site Plan and a Conditional Use Permit application by the Planning Commission. The use must also comply with the height, area, width, Yazd, signs and lighting, off street pazking and general requirements of the C-S district. Site Plan Standards CPMC 17.72.040 sets out the standards that the Planning Commission must consider in basing its decision on a Site Plan application: A. Landscaping and fencing must be consistent with the neighborhood and used to screen activities and uses that may impact existing neighboring uses. A 5' buffer and Iandscape area is proposed along Front St. A planter is also proposed at the northwest corner of the building. The site plan does not indicate if any fencing is proposed. B. Ingress and egress points must be designed and located to maintain and improve txaffxc flows on public streets. Access for the project will be via Front Street. one driveway entrance is proposed. C. Off-street parking and interior circulation must be adequate to-serve the site and maintain good pedestrian and vehicle traffic flows. The project will provide ten off-street parking spaces including one handicapped parking space. Nine off-street parkdng spaces are required for the building plus one space for each employee, In addition, one off-street truck loading space is required. It appears there is adequate area to provide the additional off street parking required for employees and the truck ioadiag space. D. Signs for the project must be designed and located to be compatible with the use and not interfere with traffic control devices or traffic flows. The applicant will be required to submit a sign permit application for all signage proposed for the project. E. The site must be designed to be accessible to fim apparatus and have adequate f re fighting facilities. Fire apparatus will have access to the site from Front St. Fire hydrants will be installed in accordance with City and Fire District #3 standards as necessary. F. The project must comply with all applicable city ordinances and regulations and must be aesthetically acceptable in relation to the neighborhood and the City of Central Point. The project is in compliance with all city ordinances and regulations. The use of the property for heavy equipment sales and service is aesthetically compatible with the surrounding commercial neighborhood. Re uxred Fin in s_ or Conditional Use Pe q _ - - ~ rmit CPMC 17.76.040 requires that the Planning Commission make the following findings in granting a conditional use permit: A. That the site for the proposed use is adequate in size and shape to accommodate the use and to meet all other development and lot requirements of the subject zoning district and all other provisions of this code. B. That the site has adequate access to a public street or highway and that the street or highway is adequate in size and condition to effectively accommodate the traffic that is expected to be generated by the proposed use. C. That the proposed use will have no significant adverse effect on abutting property or the permitted use thereof: In making this determination, the commission shall consider the proposed location of improvements on the site; vehicular ingress, egress and internal circulation; setbacks; height of buildings; walls and Fences; landscaping; outdoor lighting; and signs. D. That the establishment, maintenance or operation of the use applied far will comply with local, state and federal health and safety regulations and therefore will not be detrimental to the health, safety or general welfare of persons residing or working in the surrounding neighborhoods and will not be detrimental or injurious to the property and improvements in the neighborhood or to the general welfare of the community based on the review of those factors listed in subsection C of this section. E. That any conditions required for approval of the permit are deemed necessary to protect the public health, safety and general welfare. If the Commission finds in favor of the proposed applications, staff recommends that the conditions of approval as set forth in Exhibits C and D be incorporated into any such approval. Recommendation Staff recommends that the Planning Commission take one of the following actions: 1. Approve the Site PIan and adapt Resolution No. ~, approving the Conditional Use Permit, based on the findings of fact contained in the record and subject to the recorn~mended conditions of approval; or 2. Deny the proposed Site Plan and Conditional Use Permit applications; or 3. Continue the review of the Stte Plan application and the public hearing for the Conditional Use Permit application at the discretion of the Commission. Exhibits A.
