A RESOLUTION GRAN'T'ING TENTA`1~IVE PLAN APPROVAL FOR
A MINOR LAND PARTITION

Recitals
Applicants have submitted an application for tcntative plan approval for a land partition on
a 23 acre parcel located near the intersection of West Vilas and Hamrick Roads iza the City
of Central Point, Oregon.
2. On March 3, 199$, the Central Point Planning Coznmissionconducted aduly-noticed public
hearing on the application, at which time it reviewed the City staff reports and heard
testimony and comments on the application.
Now, therefore;
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT,
OREGON, AS FOLLOWS:
Section 1. ,Approval„ Criteria. The requirements for approval of land partitions and tentative
plans are set forth in CPMC Title 16 and Title 17, relating to informational requirements, zoning,
Tot dimension, access, and similar requirements.
Sectzsn ~. Finding and Conclusions. The Planning Commission finds and determines as
follows:
A. Tentative Plan Requirezxzents. The application and tentative plan are in the correct
form and contain all of the information required by CPMC Chapter 16.10.
B. Area and Width of Lot. This partitioning in an R-1-6 zone would create the
following parcels:
Parcel 1: Approximately 3.32 acres;
Parcel 2: Approximately 19.59 acres.
The project area consist of a single parcel comprised of two tax lots by the .Iackson County
Assessor. The applicants have agreed to develop the 3.32 acre parcel as a "turn-key" park.
Each lot meets the Subdivision Ordinance and Zoning Ordinance requirements far residential
lots as well as the specific requirements for the R-1-6 and R-1-8 zones. The tentative plan
includes all information required by CPMC 16.10.010 et seq.

The applicants, Rex Roberts and Charles F. Larson are proposing the minor partition of a 23
acre parcel into two parcels of 3.32 acres and 19.59 acres (Exhibit A}. The property is located
near the intersection of West Vilas and Hamrick Roads in the R-1-6, Residential Single-
Family (6,000 sq. ft.} and R-1-$, Residential Single-Family ($,000 sq. ft.) zoning districts.

CPMC 1.24A20 vests the Planning Commission with the authority to hold a public hearing
and render a decision on any application for a tentative plan far a land partition. Notice of
the,public hearing was effected in accordance with CPMC 1.24.060. (Exhibit B).

Discussion
The project area consists of a single parcel comprised of two tax lots by the Jackson County
Assessor. This application for partition would create a new 3.32 acre parcel adjacent to the
east boundary of the cemetery and north of the Central Point East Development.
If the partition is approved, the applicants have verbally agreed to develop the 3.32 acre
parcel as a "turn-key" park.
The Planning Department has reviewed the tentative plan for the proposed minor land
partition and have concluded that it is in compliance with alI City requirements if all
conditions of approval are met.
The Public Works Department will require the applicant to provide all necessary
documentation, studies and fees if applicable, when the area develops at a future date.
Findings_of Fact & Conclusions of Law
Staff suggests the following findings of fact and conclusions of law as applicable to the
project and necessary for its approval:
1. The project area is located in the R-1-6, Residential Single-Family (6,000 s.£} and
R-1-8, Residential Single-Family {5,000 s.f.) Zoning districts
The proposal is permitted within the R-I-6 and R-1-8 Residential Districts. This
zoning classification is consistent with the Comprehensive Plan Map which designates
the project site as Low Density Residential.
2. The project consists of a tentative plan application for the minor partition of
approximately 23 acres into two parcels.
Each lot meets the Subdivision Ordinance and Zoning Ordinance requirements
for residential lots as well as the specific requirements for the R-1-6 and R-1-$ zones.
The tentative plan includes alI information required by CPMC 16.1.0.01.0 et seq.
3. The Planning Department has reviewed the tentative plan for the minor partition, the
Endings of fact, and the conclusions of law and determined that the project meets all City
standards and requirements subject to the recommended conditions of the Planning
Department (Exhibit C).
The partition meets the requirements of the Central Point Municipal Cade and offers
the potential development of another park facility.
Recommendation
Staff recommends that the PIanning Commission take one of the following actions:
1. Adapt Resolution No. ,approving the Tentative Plan application for Rex Roberts and
Charles F. Larson, based on the findings of fact contained in the record and subject to the
recommended conditions of approval (Exhibit ); or
2. Deny the proposed Tentative Plan application; or
3. Continue the review of the Tentative Plan application at the discretion of the Commission.
