This matter came before the Planning Commission for hearing on May 19, 1998, on applicant's site plan application for an Espresso Drive `l1~ru Caz-t located near the intersection of West Tine and North First Streets, in a C-3 zoning district of the City. The Planning Commission reviewed the application and the City staffreports, and received comments from all persons wishing to be hoard in favor of and opposed to the application. Now, therefore; I3E IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Criteria A~plicai~te to Decision. The following chapters of the Central Point Municipal Code apply to this application: A. Chapter 17.40, C-3, Downtown Business District B. Chapter 17.60, General Regulations; C. Chapter 17.64, Off Street Parking and Loading; D. Chapter 17.72, Site Plan, Landscaping and Construction Plan Approval; E. Comprehensive Plan Historic Policy #2, Page VI-74. Section 2. Findings,,and„Conclusions. The Planning Commission hereby adopts by reference all hnding of fact set forth in the City staff reports, and concludes that, except where addressed in the conditions of approval, the application and proposal comply with the requirements ofthe following chapters of the Central Point Municipal Code: A. Chapter 17.40, relating to uses, lot size, lot coverage, setback, building height and screening in the C-3 district; B. Chapter 17.G0 relating to paving and landscaping z-equirezrzents; C. The approval of the Site Plan shall expire in one year on March 19, 1999 Mess an application far a building permit or an application for extension has been received by the City. 2. The project must comply with all applicable local, state and federal regulations. 3. The applicant shall install or enter into a deferment of construction agreement with the City for improvements including, but not limited to; a six foot wide sidewalk, and a standard driveway approach. 4. The applicant shall prepare, submit and implement landscaping and sign plans to the Planning Department for approval prior to obtaining a permit to operate.
