HomeMy WebLinkAboutCouncil Resolution No. 143 RESOLUTION N0. 143 A RESOLUTION APPROVING MEMBERSHIP BY THE CITY OF CENTRAL POINT IN THE JACKSON COUNTY ASSOCIATION OF GOVERNMENTS AND APPOINTING A REPRESENTATIVE OF SAID CITY. WHEREAS, The City of Central Point desires to join with other local governments of Jackson County in creation of an association of governments and to secure the benefits of participation in such an agency; and WHEREAS, the council of the City of Central Point has considered the provisions of the agreement establishing. the Jackson County Association of governments, a copy of which is attached to this Resolution, and agrees to such provisions; therefore $E IT RESOLVED by the City Council of the City of Central Point as follows: SECTION 1. The City of Central Point hereby approves the agreement establishing the Jackson County Association of Governments, ' and authorizes the. Mayor `and City Adntinstrator to execute the same on behalf of the City of Central Point, and agrees to become a member of the Jackson County Association of Governments.. SECTION 2. Councilmen Sterling Tucker is hereby appointed by the City of Central Point to represent said City in said association, until said association is notified further by the City of Central Point. SUGGESTED FORM OF AGREEMENT ESTABLISHING THE JACKSON COUNTY ASSOCIATION OF GOVERNMENTS IT IS AGREED BETWEEN ~ FARTIDS HERETO AS FOLLOWS: ARTICLE I ESTABLI3FIl~NT l.i The Jackson County Association of Governments, hereinafter referred to as JCAG, is hereby established, by authority of state laws auth- orizing intergovernmental cooperation. and by agreement among its members. ARTICLE II FUNCTIONS AND PdWERB 2.1 Basic Functions. The basic functions of JCAG shall be to: (1) study or cause to be studied any governmental operation, facil- ity, service, or problem of concern to two or more governmental units in Jackson County; (2) report and pub]:icize the findings of any such study; (3) recoa~mend action by public and private agencies, including the enactment of state legislation and the adoption of ordinances, conducive to coordination sad other improvement of governmental operations, facilities, and services in Jackson County and to the solution or alleviation of problems of intergovernmental concern in the county; (4) render advice and technical assistance to governmmental agencies , upon their request; and .~ < L (5) prepare comprehensive plans for areas of the county. and recom- mend official adoption of the plans by the appropriate instru- mentalities oP the governmental units concerned. 2.2 Anc~ Powers. To the extent necessary for carrying out its basic functions and otherwise administering its affairs, and within limitations prescribed by this agreement and by bylaws of its council, JCAG may: (1) establish advisory and technical study co~nitteea; (2) employ administrative, technical, and clerical assistance; (3) seek and accept contributions and grants-in-aid; (4) enter into contracts; (5) acquire and dispose of property; and (6) have other necessary and proper powers as authorized by the JCAG council. 2.3 Wh~ ~ Vested. Except as this agreement provides to the con- trary, the powers of JCAti are vested in its council. The council may, however, delegate anpr of its powers except the power to adopt bylaws. ARTICLE III 3.1 M mber~p. Arty unit of government in Jackson County mey become a member of JCAG by: (1) adopting a resolution approving this agreement and agreeing to become a member, (2) contributing to JCAG in accordance with this agreement an$ the JCAiO bylaws, and -2- .~ (3) complying otherwise with the requirements of this agreement and the JCAG bylaws. 3.2 Termination of Membership. Membership of a unit of government in JCAG shall terminate upon: (1} dissolution of JCAG, (2) withdrawal of the unit from JCAG, or (3} failure of the unit to comply by the end of the first six months of a fiscal year with the requirements of this agreement and JCAG's bylaws concerning financial contributions of its members for that year. ARTICLE N COUNCIL 4.1. Basic Functions. Subject to the limitations of this agreement, the council of JCAG shall be the main policy-making body of the organiza- tion and mqy adopt bylaws consistent with this agreement to govern the affairs of the organization. 4.2 Representation. The governing body of any unit of government that is a member of JCAG may appoint one member of that body to represent the unit in the council. Jackson County and the cities of Medford and Ashland may each designate an additional person so to represent them. The additional representatives need not be members of the governing bodies of their respective units. 4.3 Term of Office. The .term of oftYce of a member of the council shall be- gin the day he is appointed to the office and shall continue until the second June 30 at`ter he assumes the office and until his successor to the office is appointed to it acid assumes it os until the termination of his -3- ,®, status as an official of the unit of government which appointed him. A vacancy in the office shall be filled in the same,manner as the original appointment. 4.4 Meetings. The council shall convene in regular meeting at least ~_ four times each calendar year and shall prescribe by bylaw: (1) the times and places of the meetings, (2) the advance notice to be given of them, and (3) the rules according to which they shall be conducted. Special meetings of the council may be held upon call of the Chairman or of any three members of the council upon notice to be specified in the bylaws. 4.g Vow. A majority of the members of the council shall constitute a quorum for transacting its business. Each of the members shall have one vote on any matter before the body. Action on such a matter may be taken only with the affirmative consent of a majority of those present. ARTICLE Y OFFICERS 5.1 Cha~. As soon as possible after Juay 1, 1967, the council shall elect a chairman of J'CAti who shall be a resident of Jackson County but may not be an officer or employe of acgr, unit of government. His term of office shall be two years, except that he ~Y be removed during that time by a-two-thirds wte of the members of the council. He shall serve without compensation other than actual and necessary expenses. He shall have the following powers and duties: -4- "` (1) to preside. at meetings of the council; (2) to appoint with the consent of the council the members of whatever committees the council establishes; (3) to appoint, with like cons~nt~ admitZistrative, clerical, and tech- ni~al staff to assist JCAG in the carrying out of its functions'; (4) to exercise the budgetary functions prescribed in section 6.2 of this agreement; and (5) to exercise whatever other powers the council delegates to him and discharge whatever other duties the council imposes on him. 5.2 Other Officers. Until the council appoints a chairman of JCAG, the fudge of Jackson County shall sexve as chairman prot~m of JCAG. The oxganization shall have such additional officers as its bylaws pre- scribe. These officers shall be designated. in the manner, and hold office for the terms, prescribed by the bylaws. 5.3 Functions. Except as this agreement prescribes to the contrary, JCAG officers shall have whatever powers and duties the council prescribes for them by bylaw. 5.4 Vacs ties. The council shall prescribe by bylaw when JCAG offices shall be deemed or may be declared vacant and how and for what terms vacancies in the offices may be filled. ARTICLE VI FINANCES 6.1 Fiscal Year. The fiscal year of JCAG shall begin Ju],y 1 and end the following June 30. 6~g et. C1) During the third quarter of each fiscal year the chairman shall -5- ... submit to the council his estimate of JCAG's expenditures for the immediately ensuing fiscal year and his recommendations regarding income sufficient to defray the expenditures. (2) The council shall review the budget and, with whatever modifica- tions it deems advisable, submit the budget to the governmental units that are members of JCAG. (3) The budget, as adopted by the Council with whatever modifications it deems advisable, shall constitute (a) the determination of what contribution each member of JCAG shall make to the organization during the immediately ensuing fiscal year and (b) the limit, with whatever qualifications the council authorizes by bylaw or order, on JCAG expenditures during that year. 6.3 Contributions of Members. During the first six months of a fiscal year each member of JCAG shall contribute to the organization the amount determined as due from that member for that year. 6.4 Depositary. Jackson County shall be responsible for custody of JCAG funds and shall disburse and account for them in accordance with by- laws of the council. Audit of the funds shall be provided for by the county as a part of the regular annual audit of its funds, and the county shall provide JCAt} a report of the audit insofar as it deals with JCAG funds. 6.5 Financial Re rts. This agreement may be amended at any regular meeting of the council, provided written notice of the amendment, including its full text, has been supplied each member of the council at least ten days before the meeting. -7-
