('; a;.;.~ PLANNING COMMISSION RLSOLU"hION NO. 428 A RESOLUTION APPROVING A SITE PLAN APPLICATION E1ND ZONE VARIANCE (Applicant (s): Stan I Tenderer) {372W02CC Tax Lot 1500} Recitals 1. This matter came before the Planning Coznrnission for hearing on July 21, 1998, an applicant's site plan application for the remodel and minor expansion of an existing commercial business in a C-2,Commercial-Professional, district of the City. The Planning Commission reviewed the application and the City staff reports, and received comments from all persozls wi shizlg to be heard in favor of and apposed to the application. 2. The proposal expands the building into the front yard setback which also requires a zone variance. 3 . A second variance was determined to be necessary to address pre-existing parking which uses a public write of way for maneuvering. Now, therefore; BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Criteria A licable to Decision. The following chapters of the Central Point Municipal Code apply to this application: A. Chapter 17.36, C-2, Commercial-Professional District; B. Chapter 17.60, General Regulations; C, Chapter 17.64, Off Street Parking and Loading; D. Chapter 17.72, Site Plan, Landscaping and Construction Plan Approval. Section 2. Findings and Conclusions. The Planning Commission hereby adopts by refez•ence all finding of fact set forth in the City staffreports, and concludes that, except where addressed in the conditions of approval, the application and proposal comply with the requirements of the above mentioned chapters of the Central Point Municipal Code. 1 -PLANNING COMMISSION RESOLUTION NO. 428 {072198) Section 3. The applicant shall submit a revised site plan depicting any chazages discussed and approved at the public hearing within 30 days of Planning Coz~~znission approval. 2. The project must comply with all applicable local, state and federal regulations including, but not limited to, the Oregon Uniform 1?iz•e Code and Structural Specialty Code. 3. The remodel and building expaz7sion will be completed enfiizely within the boundaries of the subject property. The applicant shall verify and receive confirmation from the Public Works Department of the exact location ofthe public right-off way and their corresponding property line. 4. The applicant shall improve the area between the curb and sidewalk by rezxzoving the asphalt and replacing it with concrete. if the whole sidewalk .has to be z•eplaced, the City will pay for the sidewalk replacement while the applicant pays foz• the portion in between the curb and sidewalk. The applicant shall enter into a defezred izxzpz•ovezxzent agreezxzent {D1A) with fihe City to pay for one half of a new driveway apron on fihe north side of his tax lot.
