A RESOLUTION GRANTING A VARIANCI;
(Applicant: Michael and Erica Burton, Mark Soloman and "Tiffany Smith)
(372W12CB Tax Lots 7500, 7000, and 7700)
Recitals
This matter carne before the Planning Coznmissioza for hearing on Azzgnzst 18,1998, on applicant's
application for a variance fxozn fence height requirements. The applicants Have requested to vazy fx om the
City's six foot maximum fence height requirement at the rear of their property Iocated at 1130 and 1 134
Mayfair Place and 115 8 I Iampton Drive, in order to create a rrzore private and secure boundary along a
proposed pedestrian path to a City Park. The Planning Commission reviewed the application and the City
staff reports, and received comments from all persons wishing to be heard in favor of and opposed to the
application.
Now, therefore;
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL
POINT, OREGON, AS FOLLOWS:
Section 1. Criteria Applicable to D~,ci~ion. The following chapters of the Central Point
Municipal Code apply to this application:
A. Chapter 17.20, R-1, Residential Single-Family District;
B. Chapter 15.20.080, Fence Variances.
Section 2. Findin~?s and Conclusions. The Planning Commission hereby adopts by reference
all finding of fact set forth in the City staff reports, and concludes that applicant has demonstrated
compliance with the requirements of CPMC Chapter 15.20.080, pertaining to fence variances.
Section 3. Variance Granted. Applicants are hereby granted approval far the requested
variance from the maximum fence height requirements on property located at 1130 and 1134 Mayfair
Place, and 11 S 8 Hampton Drive in the R-1 zoning district. The Commission also made a recommendation
to the City Council that the City consider building a block wall along the easement or access way to the
City park.
