This contract, made and entered uito this "V day of \lar 2018, by and between the CITY
OF CENTRAL POINT, OREGON. hereinafter called the'O\k NFR", and L I �I Inc.. dha
Knife River blatenals , hereinafter called the "CONTRACTOR'
bVITN ESSETH;
Said Contractor, in consideration of the sum and or unit prices to be pard to him'her bt the
Owner, and of the covenants and ani cements herein contained. hereby agrees, at his own proper
cost and expense, to do all work and furnish all materials, supplies, supervision, labor, tools,
equipment, transportation and incidentals, and .hall pay all applicable taxes and fees necessary
for the completion of the construction of the _'017 Roadwa, Rehabi htation in the City of Central
Point, Oregon, for said Owner. to the extent of the Proposal, with unit prices tilled in made and
submitted by the Contractor on the 10th day of \-lay, 2018 all in full compliance with
COV FRAC I DOC(VIFN'IS. which includes l he Performance Bond and the applicable
portions of the City's Public W orks Standard Specifications and Details, included herewith, and
in accordance with the Plans prepared by RH' for the City of Central Point, Public R arks
Department, dated Spring, 2019, entitled. 2Roadwa, Rehabilitation which Plans acrd
aforementioned Contract Documents are hereby referred to, and by reference made a part of this
CONTR-\C T FOR CONSTRUCTION as fully and completely as if the same were fully set forth
herein, and are mutually coopemtke herewith. In consideration of the faithful performance of
the work herein set forth, and in accordance with the directions of the Engineer, and to his -
satisfaction as provided herein, the Owner agrees to pay, to the Contractor the amounts bid in the
Proposal, $'_01.745 00, adj usted in accordance with the General Conditions, and to make ,itch
payments in the manner and at the times provided for in the General Conditions.
Fhe Contractor agrees to complete the work within the time limits as specified herein and to
accept as full payment the amounts set forth in the Proposal and computed in accord.mee with
the Contract Documents
It is agreed that the Contractor shall complete the work in all respects by 45 days atter the notice
to proceed
In the went the Contractor shall fail to complete the work within the time limits or the extended
time limits agreed upon, liquidated danmgcs shall be paid to the Owner in the amount of $5011 00
per day until the work is completed as set forth in the Contract Documents and to the satisfaction
of the Fngincer Sunday, and legal holidays will be excluded when determining day s in default.
The Contractor agrees to hold harmless the Cin from, and to repair and replace (as directed by
the City's Public Works Director) arts and all detects and deficiencies which develop in
workmanship and, or materials for a period of'one 11) %ear or as stated in the special
specifications after the date of the written notice trom the Engineer of the final acceptance of the
project by the Coy
