PLANNING COMMISSION RESOLUTION NO. 487 A RESOLUTION CONDITIONALLY APPROVING A SITE PLAN AND CONDITIONAL USE APPLICATION (Applicant (s): Albcrtsons Inc) (372W10D, Tax Lot 1300) Recitals 1. This matter came before the Planning Commission for hearing on June O6, 2000, on applicant's site plaza and conditional use application for a fuel station and a carwash in the C-4 district of the City. The Planning Commissions reviewed the application and the City staff reports, and received comments from all persons wishing to be heard in favor of and opposed to the application. Now, tlaerefoz•e; BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Criteria A licable to Decision. The following chapters of the Central Point Mzazaicipal Code apply to this application: A. Chapter 17.44, C-4, Tourist and Office-Professional District B. Chapter 17.60, General Regulations; C. Chapter 17.64, Off Street Parking and Loading; D. Chapter 17.72, Site Plan, Landscaping and Construction Plan Approval. section 2. Findings and Conclusions. The Planning Commission hereby adopts by reference alI findings of fact set forth in the City staff reports, and concludes that, except where addressed in the conditions to approval, the application and proposal comply with the requirements of the following chapters of the Central Point Municipal Code: A. Chapter 17.44, rolating to uses, lot size, lot coverage, setback, building height and screening in the C-4 district; B. Chapter 17.60 relating to paving and landscaping requirements; C. Chapter 17.64 relating to off-street parking and loading facilities; D. Chapter 17.72 relating to site plan requirements. Section 3. Conditional Approval. The application for site plan approval is hereby conditionally approved, subject to the conditions set foz-tla in Exhibits "A", "B", and "C", which are attached hereto and by this reference incorporated heroin. N T E R O F F I C E To: Tam Humphrey, Planning Director From: Lee Brennan, Public Works DirecforlCity Engineer Subject: Memorandum of Public Works Department/City Engineer Recommendations for the Site Plan Review and Conditional Use Permit for an Albertsons Fuel Station and Carwash to be located in the Mountain View Plaza Shopping Center, east of Freeman Road. Date: May 31, 2000 The following is the Public Works Depar#ment's/City Engineer's recommendations regarding the subject project that we feel should be included as conditions of approval, should the Planning Commission approve the development plan and conditional use permit for Ehe subject project. Traffic Circulation Plan Si nin /Sfri in Plan and Enfrance/Exits Revisions: The Developer should prepare and submit for City PW© approval a suifable site traffic circulation plan for the proposed development. The traffic circulation plan shall illustrate that all driveways and connections to stree#s shall accommodate the turning and access movements of all expected truck, recreational vehicle, emergency vehicle (i.e fire truck) and all other applicable vehicles including but not limited to a single unit truck; fuel delivery truck and trailer; a motor home in combination with a bcat trailer; and hre-fighting equipment. All vehicular movements shat[ be designed to avoid infringing into opposing or adjoining trove! lanes when the traffic movements are made by the studied vehicle. A striping and signing plan will also need to be prepared and submitted for review and approval so a clear pattern for traffic circulation and movement can be obtained. The plans note that the entrance off of the main entrance to the shopping center is an "entrance only" type driveway. We would recommend That ibis enfrance be moved as far as possible to the east away from the main shopping center entrance connection with Freeman Raad. We would also request that this enfrance be narrowed and made smoother: narrowed to prevent two-way access, and smoother or rounder to make access to the islands and car wash easier for larger Vehicles. The access driveway to the northwest of the proposed developmenf is stated as a "controlled access bypass drive". We inferpret this driveway to be used only as an exit for vehictes who decide they don't want a car wash, or when the car wash is not operating. How wilt this access be "controlled" (i,e gated, anti-back-up device, etc.) 2. Clear Vision Areas/Triangles, All driveway approaches of the proposed Development connecting to the private roads need to maintain a minimum of 25-foot clear vision triangle to the center of the driveway to the edge of the private road. This requirement may be adjusted by the City PW©, depending on final orientation and lane/driveway layout of the adjoining roadsldrives, in accordance with AASHTO clear sight-vision requirements. Storm Drairragp S. stern: The storm drain system sha€I be designed io have a petroleum product separation system (riot just petroleum traps in the catch basins), included in the system that is connected to all the catch basins tltai can possibly be impacted by inadvertent spilled fuel from the filling of the underground storage tanks, or dispensing of fuel from the islands and which connect to the City's storm drain system or which discharge directly into Mingus Creek. This system shall be designed to meet all the requirements of the City, DEQ, and the State Fire Marshal. ~#. Flood Stud of Min us Creek: The proposed development places improvements and structures within the 1t)0-year flaodzone associated with Mingus Creek. The shopping center's developer (Cris Galpin) retained a consultant (Marquess and Associates) who prepared and submitted a flood study that was accepted by Ehe City. However a fetter of map amendment or revision was not obtained from FEMA. So the FEMA mapped floodplain is still applicable. All structures and other improvements will have to be built to meet the requirements of CPMC 8.24, as the structures are within the area of special flood hazard. The information from the flood study will be used to determine minimum finished floor elevations for any structures that will be placed within the area of special flood hazard. General Public lm rovemertfs: All construction of public irttprovements shall conform to the City's PWD Standards, the conditions approved and stipulated by the Planning Commission, and other special specifications, details, standards, andlor upgrades as may be approved by the City Administrator or his designee prior to the approval of the construction plans for the proposed development. During consfrucfian, changes proposed by the Developer shall be submitted in writing by the Developer's engineer to the City PWD far approval prior to implementation. 2. P~rntits arrdAanravals: ©evelaper shah provide copies of any permits, variances, approvals, and conditions as may be required by outer agencies, including, but not Limited to~Oregon:~State Fire Marshal, Oregon Department of Environmental Quality (DEQ), i=ire District No. 3, and Bear Creek Valley Sanitary Authority {BCVSA}. The Developer shall submit written approvals of the final construction plans from these agencies prior to final construction plan review and approval by City PWD, 3. Elevations: All elevations used on the construction plans, on ten~parary benchmarks, and on any permanent benchmark shall be tied into an established City approved benchrrrark and be so noted an the plans. 5. Existin_g irtfrasfructure: As applicable, field verify alt existing infrastructure elevations and locations (i.e. pipe inverts, curb elevations, street elevations, etc.), to which the proposed development will connect into existing improvements, prior to final construction plan design and submittaE for final approval. The accurate locations of any existing underground and above ground public infrastructure, and the location of the associated easements with these facilities, shall be accurately portrayed (both horizontally and vertically} on the construction plans. 6. Fill Placemenf: All fill placed in the development shall be engineered fill that is suitably placed and compacted in accordance with City PWD and Building ©epartmeni standards, except for the upper 1.5-feet of fill placed outside of public rights-of-way and that does not underlie building, structures, or traveled vehicular access ways or parking areas. 7. Road/Drivewa /Parkrn Areas: The Developer shall evaluate the strength of the native soils and determine the access road, parking, and driveway section designs to handle the expected loads (including fire equipment) to be traveled on these private driveways, access roads, and parking areas. Need to provide designed rand section for review. 8. Ufilify Plans: The utility plans shall be drawn to scale with accurate horizontal and vertical depiction of utility lines and appurtenances (transformers, valves, etc.). Utility infrastructure location must be accurately included on the as-built drawings, or as a separate set of drawings attached to fhe as-built drawings. g. Area Llghtln_g Plan: Need to provide and implement an adequate area lighting plan for parking and public access areas, Including all of the driveway entrances, and the parking area to the south. Lights within or attached to the underside of the canopy need to be shielded or-otherwise constructed so that the side-projected light is leapt to a minimum. 10. Wafer S stern Cross Connection Control: Developer shelf comply with Oregon Health Division (OHD) and City requirements for cross connection control. The proposed development will require that aft water services be equipped with an approved backflow prevention assemblies which shall be located directly behind the City's water meters. 11. Water System: Construction draw"sags shall include the size, type, and location of ail water mains, hydrants, valves, service connection, meter, service laterals, and other appurtenance details in accordance with City PWD Standards and as required by the City PWD. 12. Roof/Area Drains: Ail structures shall have roof drains, area drains, and/or crawl spaces with positive drainage away from the building. Roof drains shall not be directly connected to the public storm drain systerr3. 13. Grading Plans: Grading plans shall have original/existing grades and final grades plotted on the plan. Typically, existing grade contour fines are dashed and screened back, and final grade contour lines are overlaid on top of the existing grades and are in a heavier line width and solid.
