This matter came before the Planning Commission for hearing on September 5, 2000, an applicant's site plan application for a drive through espresso cart in the C-4 district of the City. TYze Planning Camznission reviewed the application and the City staff reports, and received comments from all persons wishing to be heard in favor of and opposed to the application. Now, therefore; BE 1T RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Criteria A licable to Decision. The following chapters of the Central Point Municipal Code apply to this application: A. Chapter 17.46.010, C-4, Tourist and Office-Professional District B. Chapter 17.60, General Regulations; C. Chapter 17.64, Off Street Parking and Loading; D. Chapter 17.72, Site Plan, Landscaping and Construction Plan Approval. Section 2. Findings and Conclusions,. The Planning Commission hereby adopts by reference all findings of fact set forth in the City staff reports, and concludes that, except where addressed in the conditions to approval, the application and proposal comply with the requirements of the following chapters of the Central Point Municipal Cade: A. Chapter 17.46.010, relating to uses, lot size, lot coverage, setback, building height and screening in the C-4 district; B. Chapter 17.60 relating to paving and landscaping requirements; C. Chapter 17.64 relating to off-street parking and loading facilities; D. Chapter 17.72 relating to site plan requirements. Section. 3. Conditional Approval The application for site plan approval is hereby conditionally approved, subject to the conditions set forth an Exhibit "A", "B", and "C"which is attached hereto and by this reference incorporated herein. Anew Site-Plan needs to be submitted showing the striping plan, n•zoving tllc building North ail additional 7 feet, and indicating where an additional parking space will be added to the site. A N 33 ATTACHMENT C RECOMMENDED PLANNING DEPARTMENT CONDITIONS OF APPROVAL 1. The approval of the Site flan shall expire in one year on September 5, 2001 unless an application far a building permit or an application for extension has been received by the City. The applicant shall submit a revised site plan depicting any changes discussed and approved at the public hearing within 60 days of Planning Con~.mission approval. 2. The praject must comply with all applicable local, state and federal regulations . 3. The applicant/property owner shall submit final traffic circulation striping, landscaping, lighting and sign plans as applicable to the Planning, Public Works and Building Departments for approval prior to obtaining any building permits. 4. The applicant shall obtain a letter from the property owner rescinding the application for the drive through wj.ndow that,was originally proposed a few months ago at the Union 76 gas station. ~ - 5.
