This matter carne before the Planning Commission for hearing on September 19, 20oa, on applicant's site plan and variance application fora cellular tower in the C-4, Tourist and Office Professional district of the City. The Planning Cozxzzrzissian reviewed the application and the City staff reports, and received comments from all persons wishing to he heaz-d in favor of and opposed to the application. Now, therefore; BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Criteria Applicable, to„Decision. The following chapters of the Central Point Municipal Code apply to this application: A. Chapter 17.44, C-4, Tourist and Office-Professional District B. Chapter 17.60, General Regulations; C. Chapter 17.64, Off-Street Parking and Loading; D. Chapter 17.72, Site Plan, Landscaping and Construction Plan Approval. E. Chapter 17.80, Variances. Section 2. Findings and Conclusions. The Planning Commission hereby adopts by reference all findings of fact set forth in the City staff reports, and concludes that, Except where addressed in the conditions to approval, the application and proposal comply with the requirements of the following chapters of the Central Point Municipal Code: A. Chapter 17.44, relating to uses, lot size, Iot coverage, setback, building height and screening in the C-4 district; B. Chapter 17.b0 relating to paving and Iandscaping requirements; C. Chapter 17.64 relating to off street parking and loading facilities; D. Chapter 17.72 relating to site plan requirements. E. Chapter 17.80, Variances. Section 3. Conditional Approval and„Variance Granted. Attachment B RECOMMENDED PLANNING DEPARTMENT CONDITIONS OF APPROVAL The approval of the Variance and Site Plan shall expire in one year on September l9, 2001 unless an application far a building permit or an application for extension has been received by the City. The applicant shall submit a revised site plan depicting any changes discussed and approved at the public hearing within 60 days of Planning Commission approval. 2. The project must comply with all applicable local, state and federal regulations . 3. The monopole will be painted a tan color. 4. The applicant will investigate with the Engineering Division of AT&T to find the smallest antenna array that will function an the monopole to reduce visual impact upon surrounding parcels. 5. No lighting of any sort shall be affixed to the monopole or antenna strutures. 6. The utility building shall have a gable roof similar in pitch anal composition to the proposed motel development that is expected on the adjoining parcel. Additionally, the exterior of the utility building shall have a siding that is similar to the motel. 7. A six foot high wrought iron fence shall enclose the monopole and maintenance building. The fence will be allowed to have square tips at the top to discourage unlawful entrance to the facility. 8. A landscaping plan shall be submitted with shrubs and trees that surround the exterior portion of the wrought iron fence. The plant species shall be of a variety that will retain adequate foliage year round. Trees will be planted conspicuously near the northern portion of the project site to improve the aesthetic atmosphere of vehicles that will enter from Pine Street when the motel and other commercial activities develop. MEMORANDUM DATE: September 5, 2040 TO: Central Point Planning Cozxamission FROM: Jim Bennett, City Administrator City of Centraf point Attachment C r; :r Planning vepartment SUBJECT: Public Works Requirerr~ents for AT&T Cellular Tower Site Plan Review The following conditions are recommended to be attached to any approval of the above Site Pian Review to ensure that all Public Works eoncerns have been addressed. 1. The applicant shall comply with all applicable provisions of the City of Central Point Standards and Specifications and Uniform Standard Details for Public Works Construction. 2. The applicant Shall submit a site drainage plan that demonstrates how any runoff from the development will be retained on site and, if necessary, discharged to any public or private storm drain system. The applicant shall pay all applicable systems development charges (SDCs} collected by the City at the time of building permit issuance. Appeal of Planning Commission Decision to Approve a Site Pfan Review for an AT&T Cellular Tower Mr. Humphrey explained that at its regular meeting of Tuesday, September 19, 2000, the Central Point Planning Commission approved a request by AT&T to vary from City height requirements and construct an $0-foot cellular monopole and corresponding equipment building behind the Chevron Service Station on East Pine Street near the I-5 interchange. The approval would allow the applicant to proceed with the preparation of improvement plans and subsequent property development. The Planning Commission imposed a number of conditions with their approval including but not limited to; 1) painting the monopole a tan color and making an effort to find the smallest workable antenna array for both 80 and 60 foot placements, 2) prohibiting lighting of any sort affixed to the pole or antenna, 3) constructing an equipment building that has a gabled roof of similar pitch and composition #o proposed motel development in the area, 4) constructing asix-foot high wrought iron fence with square tips around the building and pole, and 5) the installation of landscaping. Mr. William Cornitius has exercised his rights under CPMC 1.24.080 and requested the City Council review the Planning Commission's action. Notice of public hearing was also given in accordance with CPMC ~ .24.080 Mr. Cornitius is in the process of planning new development on his property which is adjacen# to the Chevron site. He has appealed this decision because he would like it located further away from his property where he plans to build a new motel and restaurant. Mr. Humphrey stated that the #awer placement and conditions were consistent with the City's proposed telecommunication ordinance and acceptable to both the Commission, the applicants and Mr. Cornitius at the time of the meeting. Mr. John Brosy, AT&T Representative Mr. Brosy explained the reasons for the placement and the height of the Cell Tower, He s#a#ed that AT&T will meet all the requirements of the Planning Carnmission. Mr. Brosy does not feel that a proposed Hotel and Restaurant that the appellant wants to build in the area should be a factor in the approval of this project. Mr. William Cornitius, appellant. Mr. Cornitius stated his concerns for placement of the tower. He stated that this location wil[ effect two sides of his property and could be an eyesore to his prospective customers. He stated that AT&T should be required to move the tower to a less conspicuous location or lowered to code regulations of 65 feet. Mr. Raymond Smith, hotel representative. Mr. Smith stated that the appellant was never con#acted by the applicant and should have been able to give his opinion of the project. He stated that the hate! and restaurant are still in the planning stages but they will be located in that area. A Cell Tower that close to the hotel would be an eyesore. Bob Gilkey made a motion to deny the appeal and to uphold the Planning Commission Decision to Approve a Site Plan Review for an AT&T Cellular Telephone Tower. Carol Fischer seconded. Roil Call: Motion passed unanimously, Garth Ellard made a motion to take a ten minute recess. Bob Gilkey seconded. All said aye and the meeting was adjourned for a ten minute recess.
