A RESOLUTION MODIFYING FINAL PUD APPROVAL TO ADJUST
FRONT AND SIDE YARD SE i'BACKS IN CEDAR SHADOWS

Recitals
1. Applicant{s) hasChave submitted an application for modifications to a final plan fora 2.49-
acreparcel, located East of Freeman Road, in the R-3, Residential Multiple Family Zoning District
in the City of Central Point, Oz'egon.
2. On November 7, 2000, the Central Point Planning Commission conducted aduly-noticed
public hearing on the application, at which tune it reviewed the City staff reports and heard
testimony and comments on the application.
Now, therefore;
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL
POINT, OREGON, AS FOLLOWS:
Section 1. Approval Criteria. The rEquirezxzents for approval of land partitions and tentative
plans are set forth in CPMC Title l b and I7, relating to informational requirements, zoning, lot
dimension, access, and similar requirements. The requests for approval of a PUD are set forth in
CPMC I7.b8.
Section 2. Finding and Conclusions. The Planning Cozrzzxzission ands and detezxrzines as
follows:
A. Tentative Plan Requirements. The application and final plan are in the cozrect form
and contain all of the infoz~rnation required 6y CPMC I6.10.
B. Area and Width of Lot. This modification in an R-3 zone would allow for building
setbacks to be adjusted.
All parcels meet the minimum area requirements for lots in the R-3 zone as set forth in the
PUD CPMC 17.28, and such parcels meet the general requirements for lots contained in
CPMC 16.24.050.
C. Final Development Plan. The final develaprnent plan and modifications the
preliminary development plan per CPMC 17.68.
Section 3. Conditional A royal. The application for tentative plan for land partition herein

RECOMMENDED PLANNING DEPARTMENT CONDITIONS OF APPROVAL
Approved modil`xcations to the front yard setback shall apply only to the habitable portion
of the structure with no portion of the structure being closer than thirteen anti one half feet
when measured from the front lot line. All units proposed for the reduced setback shall have
a porch with useable outdoor space to accommodate activities. Any changes from this
condition shall require approval by the Planning Commission.
2. The project must comply with all applicable local, state and federal regulations .
