S20 A RESOLU"PION CONDITIONALLY APPROVING A SI"I'E PLAN APPLICA"PION (Applicant {s): Linda a~~d Willard Hcrzbcrg} {37 2W 03D, Tax Lat 2300) Recitals 1. This matter came before the Planning Conlmissio~~ for Dearing on June S, 2001, on applicant's site plan application to construct a utility building and sign next to the Rogue Express II in the TOD-GC district of the City. The Planning Cormission reviewed the application and the City staff reports, and received coznznents from all persons wishing to be heard in favor of and opposed to the application. Now, therefore; BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section _1. ____Criteria Applicable to Decision. The fallowing chapters of the Central Point Municipal Code apply to this application: A. Chapter 17.65, TOD Districts and Corridors B. Chapter 17.60, General Regulations; C. Chapter 17.64, Off Street Parking and Loading; D. Chapter 17.72, Site Plan, Landscaping and Construction Plan Approval. Section 2. Findings and, Conclusions. The Planning Commission hereby adopts by reference all findings of fact set forth in the City staff reports, and concludes that, except where addressed in the conditions to approval, the application and proposal comply with the requirements of the following chapters of the Central Point Municipal Cade: A. Chapter i 7.65, relating to uses, lot size, lot coverage, setback, building height and screening in the TOD-GC district; B. Chapter 17.65 relating to paving and landscaping requirements; C. Chapter 17.65 relating to off-street parking and loading facilities; D. Chapter 17.72 relating to site plan requirements. Sect_i_on 3. Conditional Approval. The application for situ plan approval is hereby conditionally approved, subject to the conditions set forth on Exhibits "A" and "B", which is attached hereto and by this reference incorporated herein. 1 -PLANNING COMMISSION RESOLUTION NO. The approval of the Site Plan shall expire in one year on June 5, 2Q02 unless an application for a building pemut or an application for extension has been received by the City. The applicant shall submit a revised site plan depicting any changes discussed and approved at the public hearing within 30 days of Planning Commission approval. 2. The project must comply with ali applicable local, state and federal regulations . 3. The applicants shall work with staff from the Planning Department to bring the landscape plan into compliance with the T.O.D. standards.
