Coffee Site Plan~;~ ~~c ~ , l ~ : ,- PLANNING COMMISSION RESOLUTION NO. 529 A RESOLUTION CONDITIONALLY APPROVING A SITE PLAN APPLICATION (Applicant (s}: Bz-iaza Maxwell and Ty Sullivan for Dutch Bros. Coffee} (372W10CB, Tax Lot 405) Recitals 1. This matter camebefore the Plan~ling Commissionfor hearing on Septeznber4, 2001, an applicant's site plan application for a drive through espresso cart in the C-5 and TOD-GC district of the City. The Planning Commission reviewed the application and the City staff reports, and received comments from all persons wishing to be heard in favor of and opposed to the application. Now, therefore; BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY Oh' CENTRAL POfNT, OREGON, AS FOLLOWS: Section 1. Criteria Applicable to„Decision. The following chapters of the Central Point Municipal Code apply to this application: A. Chapter 17.46.010, C-5, Thoroughfare Commercial District B. Chapter 17.60, General Regulations; C. Chapter 17.64, Off Street Parking and Loading; D. Chapter 17.72, Site Plan, Landscaping and Construction Plan Approval. E. Chapter 17.65, TOD Districts and Corz-idors Section 2. Findings and_Conclusions. The Planning Commission hereby adopts by reference all findings of fact set forth in the City staff reports, and concludes that, except where addressed in the conditions to approval, the application and proposal comply with the requirements of the fallowing chapters of the Central Point Municipal Code: A. Chapter 17.46.010 and 17.65.010, relating to uses, lot size, lot coverage, setback, building height and screening in the C-5 and TOD-GC districts; B. Chapter 17.60 relating to paving and landscaping requirements; C. Chapter 17.64 relating to off-street parking and loading facilities; D. Chapter 17.72 relating to site plan requirements. Section 3. Conditional, Ap r~ oval. The application for site plan approval is hereby conditionally approved, subj ect to the conditions set faz-th on Exhibits "A" and "B", which is attached hereto and by this zeference incorporated herein. Cb 74 ~4~kT ~~4..~~ rar:s£,i~.,~l ~~~~~ ~~~ C~~ ~ !~`~ ~ ~~ Ex~i~ i~ ~ RECOMMENDED PLANNING DEPARTMENT CONDITIONS OF APPROVAL The approval of the Site Plan shall expire in one year oz~ September 4, 2002 unless an application for a building permit or an application for extension has been received by the City. The applicant shall submit a revised site plan depicting any changes discussed and approved at the public hearing within 60 days of Planning Coanmission approval. 2. The project must comply with ail applicable local, state and federal regulations including but not limited to the requirements of the Central Point Building Department {Attachment "E"). 3. The applicantlproperty owner shall submit final traffic circulation striping, landscaping, lighting and sign.plans as applicable to the Planning, Public Works and Building Departments far approval prior to obtaining any building permits. 4. The applicant shall enter into a shared parking agreement with the property owner to address on-site parking needs. Said agreement shall be provided to city staff prior to the issuance of a Building Department Certificate of Occupancy. ~~ Prk
