Applicant{s} lags/have submitted an application for 1'irzal Development flan approval for a Planned Unit Development on a .41 acre lot, locates[ at 431 N. Second Street, i~~ tl~e City of Central Point, Oregon.. 2. On June 3, 2003, the Central Point Planning Commission conducted a drily noticed public hearing on the application, at which time it reviewed the City staff reports and heard testi~xzony and comments on the application. Now, therefore; I3E IT RESOLVED BY THE PLANNING COMMISSION Oli THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Approval, Cl,iteria. The requirements for approval of land partitions and tentative plans are set forth in CPMC Title 16 and 17, relating to informational requirements, zoning, lot dimension, access, and similar requirements. follows: Section 2. T'indings and Conclusions. The Planning Commission finds and determines as A. Final Plan Requirements. The application and tentative plan are in the correct form and contain all of the information required by CPMC 17.65 and CPMC 17.68. All parcels meet the area requirements of the Planned Unit Development set forth in CPMC 17.68, anti such parcels meet the general requirements foc~ lots contained in CPMC 17.65. Section 3. Conditional Approval. The application for Final Development Plan for Planned Unit Development subdivision herein is hereby approved, subject to the conditions set forth on Exhibits "A" and "B", attached hereto by reference incorporated herein, unposed under authority of CPMC Chapter 16.36. A f nal development plan, containing in final form the information required in the preliminary plan shall be submitted to the City within six months of approval or by October €, 2043. A six month extension maybe gruited by the City upon the applicant's request and far good cause. 2. The project must comply with all applicable local, state, and federal regulations including, but not lizuited to, the Oregon Uniform Fire Code and Structural Specialty Code. 3. 'The applicant shall submit final parking, landscaping, lighting and sign plans to the City for approval as part of the final development plan. A suitable landscape and irrigation plan shall show the types of tree's, shrubs, and ground cover that will be planted and the imgation for the common space. 4, The applicant shall submit a copy of the Covenants, Codes and Restrictions (CC&R's) or any comparable agreement governing the use, maintenance and continued protection of the PUD as part of the final development plan. S. The applicant shall reduce the width of paved areas in front of the units to increase landscape area. Off street parking requirements stipulate that two spaces must be provided for each unit (1 covered and 1 uncovered) but the Commission felt that the paved area was excessive since each unit had area provided for three cars. 6. The Planning Commission would like to have units 5 and 6 built with higher quality composition roof material as both units face Second Street. APPROVAL DATE: 5-28-2003 Commissioners: The following were special requirements established in the Public Works Staff report for Habitat for Humanity: Existing infrastructure: The Developer shall derrzonstrate that all connections to existing infrastructure (i.e. streets; water, sanitary sewer, storm drain systems; natural drainage systems; etc.,) will not interfere with or provide for the degradation of the existing effective level of service or operation of the infrastructure facilities, and that the existing infrastructure facilities have either adequate capacities to accozxzzxzodate the flows and/or demands imposed on the existing infrastructure as the result of the connection of the proposed development's infrastructure, or will be improved by and at the expense of the Developer to accommodate the additional flows and/or demands; while maintaining or improving the existing level of service of the affected facility, as approved by (as applicable), the regulatory agency, utility owner, and/or property owner involved. The Deveioper's engineer satisfied the existing Infrastructure requirements. Utility Easements: The Developer's suzveyar will be required to work with local utility to develop adequate public utility easements. Necessary utility easements have been created. Storm Drainage Infrastructure: The developer shall develop a facility plan for the storm drain collection and conveyance system which provides for zuza-off from and run-on onto the proposed development, any fixture clcvclopment on adjacent properties, and any ar•cas deerxred by the City that will need to tie-into the proposed development's storm water collection and conveyance system. It is aur~ understanding that the storm drainage infrastructure will be a private system, operated arlci rnaintaincd by the property owners. Developer's engineer suhntitted the regrsirerl data to demonstrate the capabilities of the development's private storm drain system. however floe Developer ltas not completed old requirements stipulated in floe storm druirtage portion of the staff report. The Fublic Works Department is recommending no additional building permits relevant to the subject development be issued until such a time that all required storm drain infrastructure is constructed.
