A RESOLUTION APPROVING A FINAL DEVELOPMENT PLAN AND SUBDIVISION
KNOWN AS MTNGUS CREEK ESTATES A PLANNED UNIT DEVELOPMENT
{Applicant {s): River City Developzncnt, LLC & Adderson Builders, Inc.
(37 2W 11 BA, Tax Lot 8600,8800, & 8900
Recitals
1. Applicant{s) has/have submitted applications for preliminary development and tentative plan
approval for a subdivision on a .90 acre Tot located near the intersection of Shadow Way and Freeman
Road in the City of Central Point, Oregon.
2. On, June 3, 2003, the Central Point Planning Cozxzmission conducted aduly-noticed public
hearing on the application, at which time it reviewed the City staff repoz-ts and heard testizxzony and
comments on the application.
Now, therefore;
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL
POINT, OREGON, AS FOLLOWS:
Section 1. A royal Criteria. The requirements for approval of planned unit development and
tentative plans are set forth in the following chapters of the Central Point Municipal Code, relating to
information requirements, zoning, lot dimension, access, and similar requirements.
Section 2. Criteria A licable to Decision. The Planning Commission finds and determines as
follows:
A. Chapter 17.28, R-3, Residential Multiple Family;
B. Chapter 17.&0, General Regulations;
C. Chapter 17.64, Off Street Parl~ing and Loading and
D. Chapter 17.68, Planned Unit Developments {PUD).
Section 3. Pindin~ and Conclusio~ls.
The Planning Commission hereby adopts by reference all findings of fact set forth in the City Staff
reports, and concludes that, except where addressed in the conditions to approval, the application and
proposal comply with the requirements of the following chapters of the Central Point Municipal Code:
A. Chapter 17.28, relating to allowed used in the R-3, Residential Multiple Family zoning
district:
B. Chapter 17.60, relating to paving and landscaping requirements;
C. Chapter 17.64, relating off street parking and loading facilities; and
D. Chapter 17.68, relating to Planned Unit Developments.
Section 4. Conditional Approval. The within application for a Preliminary Development Plan for
a Planned Unit Development and subdivision is hereby approved, subject to the conditions set forth on
Exhibits "A" and "B", attached hereto by reference incorporated herein, imposed under authority of
CPMC Chapter 16.3 6.

The following were special requirements established iz~ the Public Works Staff report for
Mingus Creek Estates:
F,xistin~zf ~astructarre: The Developer shall demonstrate that all connections to existing
infrastructure (i.e. streets; water, sanitary sewer, storzrz drain systems; natural drainage
systems; etc.,) will not interfere with or provide for the degradation of the existing
effective Ievel of service or operation of the infrastructure facilities, and that the existing
infrastructure facilities have either adequate capacities to accommodate the flows and/or
demands imposed on the existing infrastructure as the result of the connection of the
proposed development's infrast~zcture, or will be improved by and at the expense of the
Developer to accommodate the additional flows and/or demands; while maintaining or
improving the existing level of service of the affected facility, as approved by (as
applicable), the regulatory agency, utility owner, and/or property owner involved.
The Developer's engineer satisfied the existing Infrastructure requii•etnesats.
Right-o~i~Dediccatr'ofz: An approximate 12-foot section ofRight-of--Way along the
westez-n property boundary shall be dedicated for the widening and improvement of
Freeman Road.
Developer dedicated rer~arired right-of-~vay along Ff•eematr Road.
Defer°r•ed ,Irzzproverrrerzt ~,~reersrerrt: The Developer's consult will be recluir•ed for the
creation of a deferred improvement agreen~cnt outlining the clevelapcr's responsibility far
the cost of improvements including but not lir~~ited to: C'cn~b, Gutter, and Sidewalk
bordering Freeman Road.

Storm Drainage Irrf ~a,structure: The developer shall develop a facility plan for the storm
drain collection and conveyance system which provides for rc~r~-off fi-or~~ and rua~-on onto
the proposed develapznent, azay future development on adjacent properties, and any areas
deezrzed by the City that will need to tie-into tl3e proposed development's stoz-m water
collection and conveyance system. It is our ~inderstanding that the starn7 drainage
infrastructure will be a private system, operated and maintained by the property owners.
Developer's errgineer submitted the reyrrired data to rlentartstr•ate the capabilities of tl:e
developitrettt's private storfrr drain system.
Dr°iveway LightingYlan: The Public Works Department does not recommend standard
street lighting for the driveway access to Mingus Creek Estates. However, the Public
Works Department suggests each residence be provided with an individual driveway
lighting system.
Developer demonstrated a Liglttirtg Plan was riot necessary for the subject
development. Existing Irtfrastructtcre elinrinated the -reed for the creation of a liglrti-rg
plan.
Utility Easernents: The Developer's surveyor will be required to work with local utility
to develop adequate public utility easen-zents.
Necessary utility easetnerrts laave been created.
All special and general requirements of the Public Works staff report have been satisfied
or resolved in a manner adequate far final P.U.D. approval.
