PURSUANT TO THE AUTHORITY granted by Central Point City Charter § 4, 16, & 34, which empowers the City of Central Point to issue a citation upon any property owner whose property
is reasonably believed to be in violation of any ordinance listed in the Central Point Municipal Code, as amended, it appears, upon information and belief, that you are in violation
of the Drainage Channel Maintenance, Central Point Municipal Code § 8.28 et seq. In particular, the City of Central Point alleges:
(Count #1) That on or about «Inspection Date», the real property located «Street Number» «ST DIRECTION» «Street Name» «St Suffix» «Map Taxlot» at was found to have obstructions within
«Creek» due to debris accumulation that reduces channel capacity, including intentional or unintentional disposal of grass clippings, brush, fill, trash or other debris; or, excessive
non-native vegetation growth that substantially impedes, diverts or alters water flow from its most efficient course. . (Fine: Minimum of $500.00 or cost of abatment of blockage
and/or debris)

IMPORTANT NOTICE – READ CAREFULLY
THIS CITATION CAN BE DISMISSED simply by bringing the listed property into compliance by removing the unlawful growth, blockage and/or debris from the drainage prior to the end of the
15th day from the date of this letter. After such date, this citation becomes fully enforced and the fine cannot be reduced. Additionally, the city may cause the obstruction or debris
accumulation to be removed from the premises as described in Municipal Code 8.28.030(C). This cost is covered by the fine amount. If the fine is not immediately paid a lien will be
filed against the property as outlined in Municipal Code 8.28.040.
A PETITION MAY BE FILED with the City Manager within ten (10) days from the date of this letter to request relief, as outlined in the Municipal Code 8.28.030(B). The petition shall
include the facts upon which the petitioner relies for relief from the obligations of this chapter in relation to the property. If the City Manager finds that it would work a real and
unnecessary hardship upon the petitioner to comply with the terms herein, then the City Manager may relieve the petitioner of the obligations of the chapter in relation to the particular
property, but nothing therein shall be construed as obligating the City to remove or abate the nuisance without charging the cost as a lien against the said property.

Please understand that the enforcement of this ordinance is not done so without a sincere and empathetic understanding of our current economy and its effects on property owners. The
sole intent of this process is to address the health and safety issues identified by the citizen of Central Point, as they pertain to flood damage reduction and general public safety
issues.
Our desire is to educate property owners of the ordinance and solicit voluntary compliance. As a demonstration we mailed a notice of the ordinance changes to owners and occupants affected
by the program changes.
The fine amounts were carefully calculated to accurately cover the administrative costs associated with processing the documentation and completion of labor. A detailed breakdown of
costs is available upon request. We assure you that this is not revenue generating venture but rather a means of ensuring that the overall livability of our community continues at the
highest possible level. Thank you very much for your understanding and cooperation.
