PINE STREET (FORMALLY THE INDEPENDENT BAPTIST CHURCH) (Applicant (s): Kym Weathers) (37 2W 10AB, Tax Lot 5300} Recitals l . This matter came before the P1an~ning Commission for hearing on March 2, 2004, an applicant's conditional use application for operating a daycare facility inthe R-1-8, Residential Single Family district ofthe City. The Planning Commission reviewed the application and the City staffreports, and received comments from all persons wishing to be heard in favor of and opposed to the application. Now, therefore; BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Criteria A licable to Decision. The following chapters of the Central Point Municipal Code apply to this application: A. Chapter 17.20, Residential Single Family B. Chapter 17.60, General Regulations; C. Chapter 17.64, Off-Street Parking anal Loading; D. Chapter 17.72, Site Plan, Landscaping and Construction Plan Approval. Section 2. Findings and Conclusions. The Planning Commission. hereby adopts by reference all findings of fact set forth in the City staffreports, and concludes that, except where addressed in the conditions to approval, the application and proposal comply with the requirements of the following chapters of the Central Point Municipal Code: A. Chapter 17.20, relating to uses, lot size, lot coverage, setback, building height and screening in the R-1-8, Residential Single Family district; B. Chapter 17.60 relating to paving and landscaping requirements; C. Chapter T 7.64 relating to off-street parking and loading facilities; D. Chapter 17.72 relating to site plan requirements. Section 3. Conditional Approval. CPMC 17.76.070 -Revocation. 1. No more than 12 children at any one time per the provisions set forth in the child care facility license issued to Kym Weathers by the State of Oregon. 2. The day care center will not be operational on Saturdays and Sundays. 3. Hours and days of operation shall be Monday through Friday; 6a.m. to fip.m. 4. The applicant shall notify the City of Central Paint of any desired changes to conditions associated with the conditional use permit. 5. Fencing guidelines will be determined per State of Oregon child day care center requirements. The applicant shall affix the fence for the play area to the ground in the area shown on the site plan. 6. The proposed day care center will be subject to alI applicable city, county and state laws that address child care facilities. 7. The applicant is limited to three signs as defined in CPMC 15.24. A sign pezxnit shall be obtained by the applicant and approved by city staff prior to installation. _~~_
