A RESOLUTION OF THE CITY OF CENTRAL POINT
ESTABLISHING PROCEDURES ON WATER ACCOUNT BALANCES ON HOMES
GOING THROUGH THE FORECLOSURE PROCESS EFFECTIVE MARCH 21, 2018
Recitals:
A. Current City practice on properties going through the foreclosure process has been to
leave the account in "active" status under the property owner's name or, upon receipt
of notice of foreclosure,the lender's name until the property is conveyed.
B. Fees accumulate on properties that have been vacant with no water consumption while
the property is going through the foreclosure process
C. Outstanding account balances are entered in the City's lien docket and water service will
not be turned on until the unpaid charges are settled; either by the lender or the new
property owner.
D. The Council has determined that it would be in the public interest to have procedures in
place to allow staff to waive certain fees when a person provide evidence that the
property is going through foreclosure, and the property is vacant.
The City of Central Point resolves as follows:
• Section 1. Policy.The Finance Director, or his/her designee, has the authority to waive
the following fees Base Water;Street Utility; Street Decorative Lighting, Stormwater;
Stormwater Quality; Parks; Public Safety, Repair& Replacement; and Blackflow fees on a
property where the homeowner provides the City of Central Point a notice of foreclosure on the
subject property,and there is evidence that the property has been vacant for a minimum of 60-
days. In such instance the Finance Director or his/her designee may waive fees accruing after
such 60-day vacancy period, but all fees and charges incurred prior to such 60-day period
remain a debt of the homeowner subject to lien. If the Finance Director,or his/her designee,
does not feel that fees should be waived, or there are other circumstances that do not meet
these criteria, a person may request a hearing before Council.
