regarding this issue. A review of the enclosed copies should address your concerns, however, if you have
further questions or concerns, please feel free to contact me.
As a result of my review of the documents I concluded you are responsible for the outstanding invoice.
Therefore, if payment is remitted prior to July 1, 2014 there will be no further interest due. If we do not
receive payment, the Lien will remain on the property until payment is received and interest will continue
accrue.

Recitals

Dear Mr. Ryerson:
The purpose of this letter is to respond to your concerns and inquiries regarding the Drainage Channel
Maintenance Abatement activities and subsequent charges assessed for your property located at 50L Glenn Way
as stated in your letter dated February 6,2010. The Drainage Channel Maintenance regulations are established in
Chapter 8.28 of the Central Point Municipal Code and have been in effect since October 22, L985. I have attached
a copy of the regulations for your reference.
Based on the letter that our office received, you indicated that you were unable to satisfy the requirement to
remove the overgrown blackberries along Daisy Creek within the timeframe allowed following the annual stream
inspection due to access problems associated with your renters. You were, however, able to begin work prior to
the date that members of the City crew arrived to conduct the weed abatement work as provided in the City's
Drainage Channel Maintenance Ordinance. You noted additional concerns about the ownership of the property
east of Daisy Creek, as well as the use of City equipment near the creek and potential adverse impacts to the
creek.
As you are aware, property owners or occupants are required to ensure that no obstructions exist in the City's
drainage system. These rules are in effect to reduce flood impacts on our community by preventing obstructions
that cause increased water heights. ln addition to avoiding adverse impacts associated with heightened flood
waters, the City's enforcement of these rules helps the City earn flood insurance discounts for floodplain residents
in Central Point through the National Flood lnsurance Program's Community Rating System. Mitigating flood
heights and helping to keep insurance rates affordable is beneficial to the community. Failure to comply with the
drainage channel maintenance requirements by allowing the unlawful obstruction of the drainage system is not in
thebestinterestofthecommunity. Whenthisoccurs,staffprovideswr¡ttennoticetothepropertyowneror
occupantoftheobstructionandprovidessometimeforcorrectiveactiontooccur. Whencorrectiveactionisnot
taken and relief has not been granted, the City may abate the situation and charge the property owner for the
total cost, including: investigative cost, removal cost and overhead cost. This may be assessed against the
property as a lien that is payable within 3O-days.
ln the case of 501 Glenn Way, no correspondence was received regarding your intent to comply with the
regulations in the allotted time orto request an extension due to extenuating circumstances associated with your
rental situation. Please note that the regulations permit the City to abate removal of any noted obstructions, if
the condition has not been corrected and relief has not been granted. Absent any correspondence to request an
extension or grant of relief, the City complied with its obligation to enforce the provisions of Chapter 8.28 as
prescribed therein. The City finds that you are responsible for reimbursing the City for the weed abatement
activities conducted, in the amount of $a26.00 as provided on the invoice dated January 25,20L0. Payment was
due February 9,2OIO. Payment must be received immediately to avoid the City Council's assessment of a lien on
your property. Please contact Clarice Johnson with the Finance Department to make payment arrangements.

2009 Drainage Channel Maintenance Activities: 501 Glenn Way
The following activities were conducted by Public Works staff in 2009 to ensure compliance with the drainage
channel maintenance requirements:
Annual reminder dated September 1-, 2009 was sent to all streamside property owners. A Resident's
Guide to Drainage Channel Maintenance was included to clarify the maintenance requirement, provide
guidelines to prevent and remove obstructions, and provide stream corridor restoration resources.
lnspections of the natural stream drainage system were conducted on September 24,2009 and October 1,
2009. Obstructions were documented and letters of non-compliance were prepared along with
photographs and an explanation of the drainage channel maintenance activities needed to be in
compliance. The letter of non-compliance for 501- Glenn Way was mailed on October 15, 2009.
A second inspection was conducted on November 9, 2009 during which it appeared that no work had
been conducted. Notice was provided to the City's Community Service Officer that work had not been
completed as required by the City's code.
The final notice of non-compliance was mailed by the Central Point Police Department on November L2,
2009.
A third inspection was conducted by Public Works staff on December L4,2OO9 and no work appeared to
have been conducted. Public Works notified the Community Service Officer in the Police Department that
weed abatement activities had not been conducted.
The Public Works Department staff conducted weed abatement activities pursuant to a work order
provided to them on December 29,2009. The work was conducted on January 1.1.,2010. At the time work
was conducted, one staff person reported speaking to two individuals who had conducted some work, but
it was determined that additional work was necessary. The four crew members were on-site conducting
work for 2 hours, including mobilization, vegetation maintenance and clean-up and demobilization. They
reported that the little dump did get stuck. The crew reported using the backhoe to free the dump truck,
which took 1-0-15 minutes. The backhoe did not get stuck at any point in time and was not located near
the creek.

DRAINAGE CHANNEL MAINTENAI\CE

8.28.010 Drainage channel obstruction--Nuisance.
The causation or allowance by any owner or occupant of real property within the city of the growth of vegetation
or the presence of a blockage or accumulation of debris within any natural or manmade drainage channel within
the city, to the point that the natural flow of water within that drainage is impeded, diverted or otherwise altered
from its most efficient course is hereby declared to be a nuisance and dangerous to the public health, welfare and
safety of the city and its occupants. (Ord. 1557 51(part), 1985).
8.28.020 Drainage channel obstruction--Unlawful.
It is unlawful for any person, persons, firm or corporation, or any agent for such person, persons, firm or
corporation, or any employee thereof, to cause or allow the growth of vegetation or the presence of a blockage or
accumulation of debris within any natural or manmade drainage channel within the city to the point that the
natural flow of water within that drainage is substantially impeded, diverted or altered from its most efficient
course. Violation of this section may be abated as hereinafter provided, and in addition thereto, shall be
punishable as an ordinance violation under the general penalty ordinance of the city as set forth in Chapter 1.1.6
of this code. (Ord. L590 S1, 1987; Ord. 1557 $1(part), L985).
8.28.030 Notice--Proceedings.
A. Whenever a complaint is made that a condition prohibited by Section 8.28.010 exists, or if the city
administrator believes that such a condition exists, the city administrator may cause an investigation to be made
into the nature and extent of the obstruction and thefault, if any, forthe creation thereof. Such investigation may
include utilization of engineers or such other experts as may be necessary, and in connection therewith, the city
administrator shall keep a record of the cost thereof. lf, following such investigation, the city administrator
determines, in his discretion, that a condition prohibited by Section 8.28.010 exists, and has been caused or
allowed by the owner or occupant of the property upon which the condition exists, he shall give notice to the
owner(s) and occupant(s) of the property by causing the notice to be sent by mail to such persons at their last
known address, as the same shall appear on the records of the Jackson County Assessor. The notice shall:
L. Be directed to all persons shown on the assessor's records or otherwise known to the city to be owners and
occupants, whether corporate or otherwise;
2. Refer to the premises involved with convenient certainty, the street address, if any, being sufficient;
3. lnclude the name, if any, of the subject drainage;
4. Notify the addressees to remove the unlawful growth, blockage and/or debris from the drainage within a
period of fifteen days from the date of mailing. The notice shall further inform the owners and occupants that, if
the condition is not corrected within said period of time, the city may cause the unlawful blockage of growth
and/or debris to be removed from the premises, and will assess the costs thereof against the subject property and
make the same a lien against said property. Said notice shall further inform said owners and occupants that the
condition is a violation of city ordinance and is subject to the general penalty ordinance of the city.
Dear Sirs,
Thank you for coming to our rescue from flooding and finishing off the last few
stragglers of black berry vines hanging over the ditch. We did not flood r;i'1997 although
we pay flood inswance, and did not have the restrictions that we have now. We had cut
the vines every weekend for the first two weeks in January and hauled off a 5 yard trailer
full of vines. This is a rental property and I was not able to gain access until after
Christmas when my delinquent renters vacated. Officer Banry can attest to the problem
renters at 501 Glenn Way.
The creek was clean except for a few stragglers into the ditch. I was on my way to finish
the project with a gas powered hedge trimmer, much like what yow employees used
when I found them coming from the other side of the creek. (I assume they had
permission.)
Who owns the property across the creek? I used to think that I owned it when I bought it
in 1987 .I thought that I owned ten feet passed the ditch which would include the dirt
bunn whigh was previously blocking my view of the hi-way, railway and commercial
business leaving me with a pristine view of Mt. McGloughlin or as us locals call it Mt.
Pitt. I ¿iln sure that my property value was affected as I have many friends and
acquaintances (witnesses) that have commented that they never knew that the property

I spoke with your employees who agreed that we had most of the work done when they
showed up and I witnessed their 20 minutes of work and l-ll2 hotr of equipment
removal from being stuck in the mud. (Am I being charged for their negligence?) As you
know this waterway is a sensitive issue as it is a fish bearing designated creek (Dixie
Creek) I am not sure about your aggressive stance on native plant removal.
Dave at ODFW was particularly interested to hear about the city having heavy equipment
stuck near the creek. The pictures I have of the backhoe and the dump truck without a silt
fence not to mention the ruts that are still there should be enough for you to realize that
you are in trouble.

RE: Creek Maintenance Needs at 501 Glenn Way.
Dear Michael& Leslie Ryerson:
City staff conducted the annual drainage channel maintenance inspection during the weeks of
September 24tt and October 1't, 2009. The annual drainage channel maintenance inspection
program aims to ensure that our local creeks are free of obstructions that can impede, alter or divert
the flow of water from its most efficient course during a flood event. This helps to protect you and
other residents from increased flood hazards including high water, erosion, safety risks and negative
local economic impacts.
During this year's inspection, obstructions were noted on most of the creeks in Central Point, including
but not limited to:
Overgrown blackberries that extend into or over the water. Blackberries increase flood hazards
by increasing water levels and by collecting debris as it floats downstream. ln fact, staff observed up
to a 1-foot increase in flood water height due to blackberries obstructing a stream during the
1996/1997 New Years Day flood event. To reduce increased flood risk, keep blackbenies alonq the
creek trimmed back so that water can flow freelv throuqh the channel.
Yard debris, including lawn clippings, tree branches and blackberry vines. Yard debris is easily
swept downstream and has been known to obstruct the flow of water. ln addition, it contributes to
declines in water quality by promoting the growth of algae, which reduces the aesthetic and
recreational value of our local streams and rivers. Remember to comoost vard debris outside of the

your property located at 501 Glenn Way during the annual creek maintenance inspection. ln
accordance with Chapter 8.28 of the Central Point Municipal Code, property owners or occupants are
required to keep the creeks clear of obstructions. Attached for your reference is a photo with an
explanation of the type of obstruction observed and the actions necessary to be in compliance with
the City's ordinance.

Remember to remove all vines from the channel toprevent further spread of Himalayan Blackberries, a Class C Noxious Weed.

Sorry I did not get this back to you any sooner
I have talked to Tom, Scott and Andrew, Brian is on vacation
What I now know:
1.. The little dump truck DID get stuck. This took about 1,0 - 15 minutes to get unstuck.
2. The backhoe DID NOT get stuck. They went down a path and it started bogging down and they backed out and
used another path. lt was never stuck. They used it to get the truck out. The backhoe was not near the creek.
3. They were there for about 2 hours. Right at 1%hours were spent working on the blackberries and bushes.
4. Neither Andrew or Scott saw anyone taking pictures of them while they were stuck. Have you asked them for
the pictures?
5. Andrew did not talk to anyone on the job. Scott did talk to two guys that came through the fence. They told
Scott that they did some work out there but their hedge trimmer had broken. No one told them that what they
had did should have been sufficient.
I am not sure if you needed any other questions answered. Let me know if you have any other quest¡ons

(10) days from the date of this notice and you will be scheduled to appear before the City Council at the next
regularly scheduled Council meeting to remonstrate against said lien.
An assessment for the total costs shal1 be determined by City Council and made by resolution at the regularly
scheduled Council meeting and shall thereupon be entered in the docket of City liens and then shall
constitute a lien against the property from which the drainage channel was maintained.
