A RESOLUTION AUTHORIZING THE ACQUISITION OF REAL PROPERTY AND AN
UTILITY EASEMENT FOR THE PURPOSE OF WIDENING SNOWY BUTTE LANE
THE CITY COUNCIL OF THE CITY OF CENTRAL POINT RESOLVES AS FOLLOWS:
SECTION 1. The acquisition of real property and a utility easement for the widening of
Snowy Butte Lane is necessary and in the interest of the general public.
SECTION 2. It is the judgment of the City of Central Point that it is necessary to
acquire the real property described in the attached Exhibit A and the utility easement
described in the attached Exhibit B for such purpose.
SECTION 3. The council establishes as just compensation for the real property and
easement being acquired, and any damages, the sum of $15,455.
SECTION 4. If an agreement with the owners of the property is not reached with
respect to the compensation to be paid for the property and easement, and the
damages, for such acquisition, then the city shall commence an action to acquire this
property from the owners and any and all persons having or claiming an interest. If it is
necessary to commence an action, immediate possession is considered necessary and
the funds described in ORS 35.265 shall be deposited with the clerk of the court.
This resolution takes effect upon signing by the Mayor.

30.0 feet to the North line of the County Road (known as Beall Lane) at a 1 1/4" iron
pipe; thence South 8959' East, along the North line of said road, 196.93 feet; thence

of the strip to be described for street dedication; thence South, along said roadway
centerline, 172.33 feet to the southeast corner thereof; thence North 8959' West, along
the south boundary of said described tract, 25.00 feet; thence North, parallel with said
roadway centerline, 172.33 feet to the north boundary of said described tract; thence
South 8959' East, along said north boundary, 25.00 feet to the true point of beginning.
