A RESOLUTION OF AGRE:EMF.NT TO EXTEND THE CABLE
FRANCHISE THROUGH .IANUARY 31, 2007, W1TI~I CHARTER
COMMUNICATIONS UNTIL. THE CITY FORMALLY GRANTS OR DENIES A
FRANCHISE RENEWAL
This Agreement to Extend the Cable Television Franchise in the City of Central Point, Jackson
County, in the State of Oregon is entered into by and between the City of Central Point, Oregon
(the "City"), and Falcon Cable Systems Company II, L.P., locally known as Charter
Communications ("Charter").
WHEREAS, the existing non-exclusive franchise agreement granted by the City to
Charter, to install and operate a cable television system in the City of Central Point, Oregon,
expired June 24, 2005; and
WHEREAS, Charter has requested that the City extend the existing franchise while a new
franchise is being negotiated; and
WHEREAS, to allow time for negotiation for a new franchise, the City Council for the
City deems it in the public interest and welfare to extend the term of the current franchise
through January 31, 2007 , until a new franchise is negotiated.
NOW, THEREFORE, IT IS HEREBY AGREED that the City and Charter shall be
bound by the terms of the existing franchise agreement until such time as the City shall formally
grant or deny franchise renewal, consistent with the provisions of Section 626 of the Cable
Communications Policy Act of 1984, as amended. The extension of time, agreed to by both
parties, shall not operate to materially modify, revoke or terminate any rights previously granted
in the original franchise agreement.
