A RESOLUTION UPHOLDING CITY PLANNING COMMISSION RESOLUTION NO.
693, A RESOLUTION APPROVING THE GRAY COURT PUD AND SUBDIVISION
WHEREAS, the City Planning Commission adopted Resolution No. 693 on May 2, 2006
granting tentative approval for the Gray Court subdivision and planned unit development located
in the R-3, Residential Multiple-Family zoning district; and
WHEREAS, said approval was subject to the conditions imposed by the Planning Commission
as recommended by staff and affected agencies; and
WHEREAS, adjoining property owners appealed the decision of the Planning Commission
within the time allotted by the municipal code and that furthermore, the City Council chose to
review the application on its own motion as allowed by the municipal code; and
WHEREAS, the Central Point City Council decided to judge the proposal on its merits and
independent of its procedural flaws, judging that the applicant had been working with City staff
well before changes to the PUD requirements had gone into effect; and
WHEREAS, the Central Point City Council determined that the Gray Court housing design met
local needs for affordability and household size;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CENTRAL POINT, OREGON that Planning Commission Resolution Number 693 is hereby
upheld to allow the property owner or his agent to proceed with- development plans in accordance
with City approval, the provisions of the municipal code and the Public Works Standards and
Specifications.
